Crimes (Search Warrant) Regulations 2023

The Regulations operate as a form-prescribing instrument tied to the search-warrant provisions of the Crimes Act 1958. The central concepts are: standardised warrant form; standardised execution report; and a standardised application form to extend the time allowed for securing and operating electronic equipment. Each of these concepts maps to a specific statutory hook in the Crimes Act.

Form as instrument of legal certainty. The Regulations substitute concrete text for the items a magistrate, an executing officer, and a court require to record and authorise actions under the Act. Regulation 5 requires that warrants under s 465 be in Form 1; Regulation 6 ties the execution report to s 465AAC(3)(b); and Regulation 7 makes Form 3 available for s 465AAAAD proceedings. The Schedule therefore functions as a binding drafting template for the content of court and police records relating to searches and post-search reporting.

Authorised actions and limits. Form 1 lists the specific actions a magistrate can authorise that implement statutory powers. These include forcible entry and search of premises, breaking or unlocking receptacles, accessing, copying and converting data from computers or storage devices that are on premises or have been seized, bringing onto premises equipment, vehicles, animals or material reasonably required, securing electronic equipment for up to 24 hours and arranging for an expert to operate it where the executing officer has reasonable grounds to believe specified conditions exist, moving receptacles for up to 7 business days for examination, and holding or retaining seized things according to law (Form 1). The Form explicitly connects the 24 hour securing period to section 465AAAAC and the 7 business day movement to section 465AAAA, thereby making the statutory time limits operational on the face of the warrant.

Assistance and compulsion. The Form incorporates two distinct mechanisms to obtain non-police assistance. First, it authorises the executing officers to be assisted by any assistant possessing necessary specialised skills or technical knowledge, where such assistance is necessary to exercise a power in the warrant (Form 1). Second, it includes a model endorsement of authority to give directions under s 465AAA(2) of the Crimes Act, enabling police to direct specified persons to provide information or assistance reasonably required to access, copy or convert data. The endorsement is framed to capture specified persons by name and address. Both mechanisms rely on the judge or magistrate providing the authorisation on the face of the warrant.

Electronic evidence handling. A recurring concept is the interaction between physical seizure and electronic evidence. The Forms articulate permissions to access data on devices on the premises or on seized devices located elsewhere, to copy data to another device, and to convert data into documentary form. The Forms also supply the procedural path for securing equipment short term and for applying to the Magistrates' Court for an extension if expert attendance or operation will not be completed within the initial 24 hours, via Form 3.

Reporting, notice and court oversight. Form 2 implements statutory reporting requirements in s 465AAC(3)(b) by requiring a detailed account of what occurred when executing the warrant, including whether the occupier was informed of the obligation to the court under s 465AAB. Form 3 requires notification of the occupier of the intention to apply for an extension and records the occupier's entitlement to be heard. The forms therefore connect police actions on the ground to court oversight and occupier procedural rights created in the Crimes Act.

Interaction with confiscation and retention regimes. Form 1 includes an explicit content block allowing the magistrate to certify that seized property is suspected tainted property within the meaning of the Confiscation Act 1997 and to direct that the applicant hold or retain the thing as if it were tainted property seized under s 79 of that Act as from the date the property is no longer required for evidentiary purposes under the Crimes Act. This integrates the search-warrant procedures with the confiscation retention regime and creates a trans-system direction to treat certain seized things as tainted property.

Administrative structure and legal provenance. The Endnotes and interpretation notes included in the Regulations make clear that the instrument follows style rules in the Interpretation of Legislation Act 1984, is made under constitutional administration provisions, and will sunset under the Subordinate Legislation Act 1994. The main legal provenance is sections 465(4) and 585AAA of the Crimes Act 1958 (reg 2).

Primary decision-makers. The Regulations shape the behaviour of magistrates and other judicial officers who issue warrants under section 465 of the Crimes Act 1958 by prescribing Form 1 as the mandatory warrant form (reg 5). The magistrate must complete the fields and select or delete options provided. The magistrate's choices on the form determine the scope of authority granted to executing officers, including whether to authorise compulsion of outside persons under section 465AAA(2), whether to include a tainted property direction referring to the Confiscation Act 1997, and whether to endorse bail conditions for any arrest powers exercised pursuant to the warrant.

Executing officers and police. The Regulations directly affect police officers to whom the warrant is issued, and any police officer who may act under an authorisation that is directed to all police officers or specified persons (Form 1). The executing officer is the person required to file the report under Form 2 for the purposes of s 465AAC(3)(b). Police must interpret and apply the warrant's specific authorisations, arrange or use assistants with specialised skills, secure electronic equipment, move receptacles for examination for up to 7 business days, and apply for an extension under section 465AAAAD if required, using Form 3 (Forms 1, 2, 3).

Experts and assistants. The Forms explicitly envisage the use of assistants possessing specialised skills or technical knowledge to exercise a power under the warrant and the attendance of an expert to operate secured electronic equipment (Form 1; Form 2). These provisions create demand for forensic computer examiners, technicians, or other specialists able to operate or extract data from devices. The Regulations do not stipulate qualifications, remuneration or procurement practices for those assistants, but the forms require recording the name and expertise of assistants in the execution report (Form 2).

Occupiers and third parties. Occupiers of the warrant premises are affected in several ways. Form 2 records whether the occupier was informed that a report must be made to the Magistrates' Court and of the particulars required by section 465AAB, including the venue where the report will be lodged, the time period for lodgement, and persons who may be authorised to inspect the report under section 465AAE (Form 2). Form 3 requires that the occupier be notified of the intention to apply for an extension and of the occupier's entitlement to be heard in relation to that application. Specified persons who are directed under section 465AAA(2) to provide assistance are affected by the potential obligation to provide information or assistance in accordance with a warrant endorsement.

Courts and court officers. The Magistrates' Court is the forum for both issuing warrants and considering applications to extend the period for securing equipment. The report in Form 2 is addressed to the Registrar at the Magistrates' Court venue nearest to the warrant premises. Court registrars will receive and process these prescribed reports and extension applications, and magistrates will adjudicate extension applications filed on Form 3.

Owners, businesses and data custodians. Owners of devices and businesses that act as data custodians or service providers may be named or directed to assist under a section 465AAA(2) endorsement captured in Form 1. The forms therefore have operational consequences for firms that provide technical support or host services for devices located on warrant premises or seized under warrants.

Inter-agency relations. The tainted property direction in Form 1 explicitly engages the Confiscation Act 1997 and the applicant's obligation to treat property as tainted property under that Act when no longer required for evidentiary purposes. This affects prosecutors, confiscation authorities, and any agency responsible for administering forfeiture or restraint under the Confiscation Act.

Administrative personnel. Bail justices, Magistrates' Court registrars, and the person making lodgements in the court will be affected by the forms because they structure the content of bail endorsements, report lodgements and extension applications, and the notices required to be given to occupiers.

In sum, the Regulations prescribe forms that distribute obligations and recordkeeping duties across magistrates, police, experts, occupiers and court officers. The forms also delineate where statutory rights to be heard and to be informed attach, thereby channeling how affected persons participate in post-search processes.

Mandated forms and completion duties. The primary duty imposed by the Regulations is to use the prescribed forms for specified actions under the Crimes Act 1958. Regulation 5 requires warrants under section 465 to be in Form 1. Regulation 6 prescribes that the execution report required by section 465AAC(3)(b) be in Form 2. Regulation 7 authorises the use of Form 3 for applications to extend the period in which electronic equipment may be secured under section 465AAAAD. These duties entail completing the fields and endorsements in the Schedule 1 forms when issuing, executing or reporting on warrants.

Execution duties for police. Form 1 authorises police executing a warrant to undertake a set of actions, and Form 2 requires an executing officer to report particulars of actions taken. The executing officer must, where relevant, direct assistants with specialised skills to assist and must record their identity and expertise (Form 2). If electronic equipment is secured and an expert operates it, the execution report must identify the expert and the duration the equipment was secured (Form 2). If an extension application is made under section 465AAAAD, the executing officer must lodge the application on Form 3 and report the outcome in Form 2.

Notification duties to occupiers. Form 2 requires the executing officer to record whether the occupier was informed, in accordance with section 465AAB, that a report will be made to the Magistrates' Court, the venue for lodgement, the time period for lodgement, and the persons who may be authorised to inspect the report under section 465AAE. Form 3 requires the executing officer who applies for an extension to confirm that the occupier was notified of the intention to apply and of the occupier's entitlement to be heard in relation to the application. These entries operationalise occupier rights to be informed and to be heard in extension proceedings and create duties to give those notices.

Authority to direct specified persons. Form 1 provides an optional endorsement that, as authorised by section 465AAA(2), a police officer executing the warrant may direct named persons of specified addresses to provide information or assistance that is reasonable and necessary to access, copy or convert data. The endorsement is written so the magistrate may specify the person or persons and their addresses. Once authorised on the warrant, the executing officer has the power to give such directions, and the execution report must record any use of those directions and the reasons why the information or assistance was considered reasonable and necessary (Form 2).

Time-limited seizure and extension applications. Form 1 authorises securing electronic equipment at the warrant premises for a period not exceeding 24 hours or any extended period under section 465AAAAC(6) where the executing officer believes on reasonable grounds that evidentiary material may be accessible by operating the equipment, expert assistance is required, and material may be destroyed altered or otherwise interfered with. The 24 hour limitation creates a duty to either have the expert arrive and complete work within the statutory window, or to apply to the Magistrates' Court on Form 3 for an extension under section 465AAAAD if the expert will not arrive within 24 hours or will not finish in that time. Form 3 requires the applicant to set out reasons and to state the extension sought and why the extension is necessary. The applicant must also notify the occupier and record that notification.

Arrest, detention and bail endorsements. Form 1 expressly authorises, in a specific section, police officers to arrest any person apparently having possession custody or control of the things named in the warrant. The form then requires that the executing officer cause any such person who is arrested to be brought before a bail justice or court within a reasonable time or to be released on bail in accordance with the endorsement on the warrant. The Form includes a space for an endorsement of bail conditions and a line for the magistrate's signature. The duty to implement these arrest and bail processes is therefore embedded into the form.

Retention as tainted property. Form 1 includes a magistrate's certifying text that the issuing magistrate is satisfied on reasonable grounds that an item is tainted property within the Confiscation Act 1997 and directs the applicant to hold or retain the item as if seized under s 79 of that Act as and from the date when the property is no longer required for evidentiary purposes under the Crimes Act. This endorsement creates a duty on the applicant to hold the property under the confiscation regime once evidentiary use ceases.

Reporting obligations. The Form 2 layout imposes an obligation on the executing officer to provide a detailed report to the Magistrates' Court registrar on what occurred during execution, including whether searches required forcible entry, descriptions of receptacles opened, unlocked, moved, destroyed or disposed of, descriptions of things seized, details of electronic data accessed, copied or converted, and particulars of experts engaged and outcomes of extension applications. The reporting duty ties the ground actions to court oversight and creates a record that the Magistrates' Court may inspect, and which occupiers may have rights to inspect under section 465AAE, as noted in Form 2.

Rights to be heard and to inspect. The Regulations embed occupier procedural rights created by the Crimes Act into the forms. Form 3 asserts the occupier's entitlement to be heard in relation to an extension application, and Form 2 records whether the occupier was informed of the right to have the report lodged and of who may inspect it. These entries preserve an avenue for occupiers to make submissions to the court in extension proceedings and to apply to inspect execution reports in accordance with section 465AAE.

Administrative and procedural duties. The Endnotes and interpretation notes show that the Regulations adhere to the Interpretation of Legislation Act 1984 styling rules and that they will sunset under the Subordinate Legislation Act 1994. While not imposing duties on practitioners directly, those provisions affect the regulatory lifecycle of the instrument and impose an implicit duty to use the current version of the forms until repeal or sunsetting.

Overall, the Regulations shift practical duties onto magistrates and police to use standardised forms and to follow the statutory time limits and notice processes embedded in the Crimes Act. They also give occupiers specified procedural entitlements as part of the extension and reporting processes.

The Regulations are primarily prescriptive of form and do not, on their face, create new criminal offences or augment penalty regimes. The body of the instrument prescribes Form 1, Form 2 and Form 3 for use under particular provisions of the Crimes Act 1958 (regs 5, 6, 7). There is no penalty provision set out in the Regulations themselves. Enforcement and sanctions for non-compliance with the obligations created by the Regulations must therefore be located in the Crimes Act and other statutes that the Forms reference, rather than in the Regulations.

Enforcement via the Crimes Act framework. The Forms operate as instruments within the statutory powers conferred by the Crimes Act. Actions taken under authorisations in Form 1, such as breaking and entering, seizure, arrest, securing electronic equipment, and compelling assistance under section 465AAA(2), derive their legality from the magistrate's warrant and the statutory authority in the Crimes Act. Any unauthorised exercise of those powers would be governed by the Crimes Act and general common law restraint on executive action. Conversely, adherence to the form should be understood as part of the procedural matrix that supports lawful exercise of the referenced statutory powers.

Court supervision and procedural remedies. The Forms are designed to create an auditable record that is lodged with the Magistrates' Court. Form 2 is explicitly addressed to the Registrar at the Magistrates' Court and records the items the court may use to scrutinise the execution of the warrant, including whether an occupier was informed of the report and whether extension applications were made and decided. Judicial oversight of extension applications is provided for via filing and hearing in the Magistrates' Court on Form 3. Procedural remedies for incorrect or improper use of the form are likely to be sought within the court system, including by application under relevant provisions of the Crimes Act, but the Regulations do not create a bespoke enforcement mechanism.

Administrative consequences. Non-compliance with the forms may have administrative consequences for police and courts, such as the court refusing to accept an application in the prescribed form or querying the validity of an executed warrant if mandatory fields or statutory endorsements are omitted. The Regulations require that warrants under section 465 be in Form 1. Failure to use the prescribed Form 1 could give rise to legal argument about compliance with section 465(4), the authorising power for these Regulations, but the Regulations themselves do not specify administrative penalties.

Interplay with confiscation and retention provisions. Where the magistrate endorses a tainted property direction reference to the Confiscation Act 1997 on Form 1, retention of the property as tainted property is to be done "as if it were tainted property seized under section 79 of the Confiscation Act 1997" (Form 1). The enforcement of obligations to treat property as tainted therefore falls under the Confiscation Act's processes, including its enforcement, forfeiture or restraint mechanisms.

No penalty details in instrument. The Endnotes and Table of Amendments do not list any penalty provisions, nor do the Forms reference penalties for failing to use the correct form. The Regulations therefore function principally as administrative instruments that standardise procedure and recordkeeping, leaving the enforcement of substantive legal obligations to the relevant provisions of the Crimes Act, the Confiscation Act, and general court process.

Consequential legal challenges. Because the forms are the mandatory vehicle for executing and recording warrants, omissions, errors or substantive misstatements on the prescribed forms are likely to be relevant in any legal challenge to the lawfulness of search or seizure actions. Such challenges would proceed under the Crimes Act and judicial review principles, but the Regulations themselves set the baseline content that courts will expect to see when reviewing compliance with the statutory warrant and reporting regime.

In short, these Regulations do not add separate prosecutorial penalties, rather they operationalise statutory powers whose compliance and any non-compliance are enforced through the Crimes Act and existing judicial and administrative remedies.

Direct cross-references to the Crimes Act 1958. The Regulations are expressly tied to multiple sections of the Crimes Act 1958. Regulation 1 identifies the objective as prescribing forms for s 465, s 465AAC, and s 465AAAAD of the Crimes Act. Regulation 2 states that they are made under sections 465(4) and 585AAA of the Crimes Act. The Forms themselves reference section 465 for the warrant authority, section 465AAAAC for securing electronic equipment for up to 24 hours and arranging for an expert, section 465AAAAD for extension applications, section 465AAAA for moving receptacles up to 7 business days, section 465AAC for reporting obligations, section 465AAA(2) for directions to specified persons to assist, and section 465AAB and 465AAE for occupier notification and inspection entitlements. The Regulations therefore function as subordinate rules giving procedural effect to these specific Acts provisions.

Interaction with the Confiscation Act 1997. Form 1 contains a textual block that permits the issuing magistrate to state they are satisfied there are reasonable grounds that the seized thing is tainted property within the meaning of the Confiscation Act 1997, and to direct that the applicant hold or retain the thing "as if it were tainted property seized under section 79 of the Confiscation Act 1997 as and from the date when the property is no longer required for evidentiary purposes under the Crimes Act 1958" (Form 1). This endorsement creates a direct operational link between the search-warrant procedure and the confiscation regime. The consequences of that endorsement, including the procedures for subsequent restraint or forfeiture, would be governed by the Confiscation Act under that cross-reference.

Subordinate Legislation Act 1994 and sunset. The Endnotes record that the Regulations will sunset 10 years after the day of making on 25 July 2033, pursuant to section 5 of the Subordinate Legislation Act 1994. This places a statutory temporal limit on the Regulations and ties their legislative lifecycle to other subordinate legislation practices.

Interpretation of Legislation Act 1984. The Endnotes include interpretive and style notes referencing the Interpretation of Legislation Act 1984, including the incorporation of headings, examples, punctuation, and provision numbering rules. Those interpretative provisions affect how courts and practitioners read and apply the forms and the Regulations as a matter of statutory construction.

Court procedural rules. The Forms are addressed to Magistrates' Court registrars, refer to bail justices and to lodging and hearing processes in the Magistrates' Court for extension applications. The day-to-day operation of these forms intersects with court practice directions and registry rules, although the Regulations themselves do not vary or prescribe those court rules. The Forms create procedural inputs that the Magistrates' Court must accept and process under its ordinary powers.

Revocation of earlier subordinate instruments. Regulation 4 revokes the Crimes (Search Warrant) Regulations 2014 and the 2015 amendment, explicitly replacing those instruments. Any references, practices or forms left over from the prior instruments are superseded by Schedule 1 of the 2023 Regulations. Practitioners must therefore use the new forms to align with the current subordinate legislative framework.

No stand-alone interaction with other statutes on penalties. The Regulations do not create new penalties, but their operation ties into other statutes that do, such as the Crimes Act and the Confiscation Act. Any legal consequences, forfeiture, or procedural sanctions arising from the exercise of powers under the Forms will be handled under the provisions of those Acts.

In sum, the Regulations act as an implementation layer for particular sections of the Crimes Act while cross-linking to the Confiscation Act for tainted property handling, and they are constrained by the usual interpretive and lifecycle rules applying to subordinate legislation in Victoria.

The Regulations replace and revoke two predecessor instruments. Regulation 4(1) expressly revokes the Crimes (Search Warrant) Regulations 2014, and regulation 4(2) revokes the Crimes (Search Warrant) Amendment Regulations 2015. The Explanatory Details in the Endnotes confirm those references, citing S.R. No. 137/2014 as amended by S.R. No. 138/2015 (Endnotes, Explanatory details). The instrument itself is Version No. 001, with a Version as at 1 August 2023 header.

Table of Amendments. The statutory Table of Amendments included in the instrument reports that there are no amendments made to the Crimes (Search Warrant) Regulations 2023 by statutory rules, subordinate instruments or Acts as at the version date (Endnotes, Table of Amendments). This means the text in Schedule 1 and the regulation headings are the operative text until or unless a later amending instrument is made.

Making date and commencement. The Endnotes record the making date and commencement: the Regulations were made on 25 July 2023 by the Lieutenant-Governor under section 6B of the Constitution Act 1975, with the advice of the Executive Council, under sections 465(4) and 585AAA of the Crimes Act 1958, and came into operation on 1 August 2023 (Endnotes, General information).

Sunset provision. The Endnotes further record that the Regulations will sunset 10 years after the day of making, on 25 July 2033, pursuant to section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). This sunset is an automatic expiry mechanism for the subordinate instrument and will require renewal, replacement or re-enactment to continue the specific form prescriptions beyond that date.

Interpretation and style changes. The Endnotes include material on the Interpretation of Legislation Act 1984 and how headings, examples, diagrams, punctuation, provision numbers and other material are to be read as part of the Statutory Rule. These entries are not amendments to substantive content, but they affect how any future amendments will be interpreted and structured.

Practical import for practitioners. The revocation of the 2014 and 2015 instruments and the lack of subsequent amendments mean that those earlier versions of the forms are no longer legally current. Magistrates and police must use the Forms in Schedule 1 of the 2023 Regulations for warrants, execution reports and extension applications under the named sections of the Crimes Act.

Future amendment pathway. Any future changes to the required forms will require a statutory instrument amending these Regulations, made under the same authorising provisions, and would be reflected in the Table of Amendments and the Endnotes in later versions. The Subordinate Legislation Act sunset imposes a planning horizon for policymakers and practitioners to consider whether forms will be updated, replaced or preserved before 25 July 2033.

The instrument as presented contains no recorded litigation history. The Table of Amendments explicitly states there are no amendments to the Regulations and the Endnotes do not list any judicial decisions concerning these Regulations (Endnotes, Table of Amendments). The Schedule and the Explanatory Details do not cite any cases. Therefore, within the text of the Regulations and its Endnotes, there is no litigation history reported.

Implications of absence of litigation record. The absence of reported litigation in the instrument does not mean that the underlying statutory powers in the Crimes Act have not been litigated. The Regulations are procedural and record-keeping instruments intended to be used under statutory powers that themselves may have been the subject of judicial interpretation. However, the Regulations do not reference or summarise such case law, and they provide no internal account of how courts have interpreted the specific links between warrants, securing equipment, and the exercise of s 465AAA powers.

Areas likely to generate litigation that the Regulations touch on. While the instrument does not document litigation, the Forms address elements that are common sources of disputes: (a) the scope of a warrant and whether an executing officer exceeded it, particularly when breaking into receptacles or using specialist assistance; (b) the lawfulness of securing electronic equipment and the proper use of the 24 hour window and any extensions; (c) compulsion of third parties to assist under s 465AAA(2) and whether directions were reasonable and necessary; (d) the correctness and sufficiency of the execution report lodged with the Magistrates' Court; and (e) treatment of seized property as tainted property under the Confiscation Act. Each of these touchpoints is visible on the face of the Forms and therefore would be material in any judicial review or evidence challenge, should litigation arise.

No recorded decisions about the new forms. Because the new Regulations and forms came into force on 1 August 2023 and the instrument does not include any litigation references, practitioners must look to separate case law under the Crimes Act and related statutes for precedent on the exercise of the powers that these forms enable. The Regulations themselves do not attempt to settle or summarise prior judicial constructions.

Practical note for litigators. Where litigation is contemplated in relation to the exercise of warrant powers, the Forms fixed by these Regulations will be evidentially relevant as contemporaneous records of authorisation, execution and notice. Courts reviewing warrants will therefore expect compliance with the prescribed forms and will scrutinise the contents of Form 1, Form 2 and Form 3 where they have been used.

In short, the Regulation does not include or report any litigation history. The forms it prescribes create material that will be central to any future litigation concerning search warrant issuance, execution, and post-seizure procedures.

Mandatory form use. Regulation 5 requires that warrants issued under s 465 be in Form 1, and Regulation 6 ties the s 465AAC(3)(b) report to Form 2. Practitioners should not assume optionality; using a prior or modified form risks non-compliance with the Regulations. The instrument also explicitly revokes the 2014 and 2015 subordinate instruments (reg 4), so those older forms are no longer current.

24 hour securing period and extension mechanics. Form 1 authorises securing electronic equipment for a period not exceeding 24 hours or any extended period under section 465AAAAC(6) where the executing officer believes on reasonable grounds that evidentiary material may be accessible by operating the equipment, expert assistance is required to operate the equipment, and if action is not taken the material may be destroyed, altered or otherwise interfered with (Form 1). The initial 24 hour limit is strict on the face of the form; if an expert will not arrive within that window or will not finish within 24 hours of arriving, the executing officer must apply to the Magistrates' Court under s 465AAAAD using Form 3. Form 3 requires reasons and the extension sought, and confirms the occupier was notified and entitled to be heard. Practitioners should therefore ensure that the decision to secure equipment and to apply for an extension is documented contemporaneously, that Form 3 is lodged in the Magistrates' Court when required, and that occupiers are given the required notices. Failure to follow the notice and hearing procedures applicable to extension applications could be material to the lawfulness of prolonged retention.

Record completeness and evidential value. Form 2 is the vehicle for the execution report and includes multiple specific fields, including whether the occupier was informed under s 465AAB. Omissions, incomplete entries or failure to attach additional pages where necessary may create evidentiary or procedural vulnerabilities. The Form anticipates the attachment of extra pages and asks whether pages are attached. Practitioners should ensure that reports are comprehensive, legible and lodged with the registrar promptly in accordance with the Crimes Act requirements, because the court will expect the detail that Form 2 prescribes.

Tainted property endorsement. Form 1 contains an explicit block for the magistrate to indicate satisfaction on reasonable grounds that a seized thing is tainted property and to direct that it be treated as tainted property under the Confiscation Act 1997 as from the time it is no longer required for evidentiary purposes (Form 1). The legal effect is that retention and subsequent handling of that property will follow the Confiscation Act. Users of the form must be careful that such an endorsement is supported by the facts and the legal threshold for declaring property tainted, because it imports a different statutory regime with its own procedures.

Options and deletions. The Forms contain multiple "delete if not applicable" directives and choices such as whether the warrant is directed to a named officer, all police officers, or another person (Form 1). Incomplete deletions or failure to tailor endorsements precisely may lead to ambiguities about who is authorised or about the scope of directions given to third parties. Ensure deletions are done with care and that any named persons and address details are accurate.

Compulsion to assist and scope of directions. The Form includes a model "Authority to give a direction under section 465AAA(2)" to specified persons to provide information or assistance. The executing officer may give such directions only where the magistrate has authorised that capacity on the warrant. The execution report requires that the person(s) directed to assist be identified and that the reasons why the assistance was considered reasonable and necessary be recorded (Form 2). Practitioners should ensure that any direction fits within the statutory test for reasonableness and necessity, and that the execution report explains the basis for the direction, because this will be a focus in any challenge.

Moving receptacles and temporary removal. Form 1 authorises moving any receptacle to another place for up to 7 business days for examination to determine whether it contains a thing that may be seized under the warrant, as provided in section 465AAAA (Form 1). The 7 business day limit is binding on the face of the Form. The executing officer must record any such movement in Form 2, including the duration. Failure to comply with the 7 business day limit, or failure to correctly record movements, may affect the lawfulness of interim custody or subsequent use of seized items.

Expert procurement and market constraints. The Forms require arranging an expert to operate secured electronic equipment where police reasonably believe an expert is needed (Form 1). Form 3 asks the applicant to identify the expert and give reasons why the expert will not arrive within 24 hours or finish within 24 hours of arriving. The Regulations do not set procurement rules, timeframes, or funding for experts. Practitioners should therefore anticipate logistical issues when arranging suitable expertise and ensure that the Form 3 application explains why the expert will not be available in the statutory window, rather than relying on ad hoc or undocumented arrangements.

Court timing and lodgement. The Forms are addressed to Magistrates' Court registrars and the Forms require details of where the report will be lodged and the timing for lodgement to be provided to the occupier (Form 2). The Regulations do not set specific lodgement deadlines in the text of the Forms; those deadlines are created by the Crimes Act. Practitioners must cross-check the Crimes Act for precise time limits and ensure reports and applications are physically lodged in the correct venue and within the statutory time windows.

No new penalties in the Regulations. The instrument does not create new penalties. That means challenges related to misuse of the forms will be litigated under the Crimes Act and existing court processes, and practitioners should not expect enforcement provisions to be embedded within these Regulations.

In short, the main practical pitfalls are mandatory use of the new forms, tight time windows for securing and operating electronic equipment, the need to notify and allow occupiers to be heard for extension applications, careful use of the tainted property endorsement, and the need for complete, contemporaneous execution reports to be lodged with the Magistrates' Court.

Step 1, use the correct form. Ensure the magistrate issues the warrant on Form 1 as prescribed by regulation 5. If you are a magistrate, populate all fields applicable to the particular warrant, delete inapplicable options as indicated on the form, endorse bail conditions where arrest will be authorised, and decide whether to include the tainted property direction referring to the Confiscation Act 1997. If the warrant is intended to authorise directions under s 465AAA(2), ensure the person(s) to be directed and their addresses are accurately specified in the endorsement area of Form 1.

Step 2, document authorised powers precisely. On Form 1, identify the full address of the premises to be searched and any vehicle details if relevant. Specify clearly the "name and description of thing" to be searched for. Where expert assistance or specialised assistants are anticipated, ensure the warrant text expressly authorises assistance by assistants possessing necessary specialised skills or technical knowledge, and include any authority to bring such assistants onto the premises.

Step 3, observe the 24 hour rule for secured electronic equipment. If electronic equipment will be secured at the warrant premises, ensure the executing officer records on the warrant the statutory basis for securing the equipment, consistent with the conditions listed in Form 1. Remember the initial authorisation to secure equipment is for "a period not exceeding 24 hours" unless an extended period is ordered. If the executing officer believes on reasonable grounds that an expert will not arrive within 24 hours of securing the equipment, or will not finish operating it within 24 hours of arriving, prepare and lodge Form 3 with the Magistrates' Court without delay.

Step 4, lodge an extension application with Form 3 when necessary. Use Form 3 for an application under section 465AAAAD. Provide all required details: identification of the officer making the application, the time and date execution commenced, a list and description of the electronic equipment secured and the date/time it was secured, details of the expert arranged to operate the equipment, reasons forming the reasonable belief that the expert will not arrive within 24 hours or will not finish within 24 hours of arrival, the precise extension sought, reasons justifying the extension including likelihood that operation will yield evidentiary material, and confirmation that the occupier has been notified and given the opportunity to be heard. File the application in the Magistrates' Court at the venue shown in the Forms and bring any supporting material to the hearing.

Step 5, give required notices to occupiers. Where the executing officer secures equipment or intends to apply for an extension, ensure the occupier is notified as required by the Crimes Act and the Forms. Form 3 requires confirmation that the occupier was notified of the intention to apply and of their right to be heard. Form 2 requires the executing officer to record whether the occupier was informed that a report would be lodged with the Magistrates' Court and the particulars of venue and timing. Maintain proof of notice such as dated hand-delivery receipts or contemporaneous signed statements.

Step 6, keep thorough contemporaneous records during execution. Use Form 2 for the execution report under section 465AAC(3)(b). The report must record whether the warrant was executed or not executed, the name and rank of the executing officer, name and expertise of any assistants, arrests, searches, receptacle openings, unlockings, destructions or disposals, receptacles moved and the duration, things seized with number and description, and actions taken with electronic data including devices accessed, data copied and data converted to documentary form. Attach extra pages where details exceed the space provided and tick the "Are there any pages attached?" box.

Step 7, record expert attendance and extension outcomes. Where an expert operated secured equipment under section 465AAAAC, record the expert's identity, qualifications and the duration the equipment was secured, as required by Form 2. If an extension application was made under section 465AAAAD, include the date of the application and the outcome in the execution report.

Step 8, follow retention and tainted property directives. If the magistrate endorses a tainted property direction on Form 1, comply with the direction to hold or retain the item as if seized under s 79 of the Confiscation Act 1997 once evidentiary use ends. Ensure chain of custody and secure storage practices are in place and document the transition from evidentiary control to confiscation retention processes.

Step 9, lodge reports and applications at the correct venue. Address Form 2 to the Registrar at the Magistrates' Court venue nearest to the warrant premises as specified in the form, and lodge Form 3 at the Magistrates' Court where the application will be heard. Preserve copies of lodged documents and receipts.

Step 10, co-ordinate with experts and assistants in advance where possible. The Forms make expert attendance central to extensions and securing equipment. Although the Regulations do not prescribe procurement details, pragmatic compliance requires early engagement with forensic or technical experts, confirmation of availability, and contemporaneous documentation of any delays or obstacles that will form the factual foundation of a Form 3 extension application.

Step 11, ensure accuracy when naming persons to be directed to assist. If a s 465AAA(2) direction is to be used, ensure the specified persons and addresses are correctly identified on the warrant, and that the execution report sets out why the assistance requested was reasonable and necessary. This reduces the risk of successful challenge to the direction or to evidence derived from it.

Step 12, cross-check statutory time limits. The Forms reference statutory limits and rights set out in the Crimes Act. Practitioners should cross-reference the Crimes Act sections cited in the Forms to ensure compliance with all time limits and notice periods, because the Regulations prescribe form but do not reproduce every statutory deadline.

Step 13, train relevant personnel. Ensure magistrates’ clerks, police officers who execute warrants, court registrars and legal advisers are familiar with the new forms and the specific content required by the Schedule. Failure to comply with the prescribed form content may raise legal risk and impede the admissibility or lawful retention of seized materials.

Following these steps will align practice with the regulatory prescription in S.R. No. 75/2023 and connect the operational steps on the ground with the statutory requirements embedded in the Crimes Act and the Confiscation Act.
