8 Exclusions from Division 3 of Part VIIC of Act (Act s 85ZZH)

(1) For the purposes of paragraph 85ZZH(k) of the Act, the persons and bodies specified in column 2 of Schedule 4 are prescribed for the purposes, and in relation to convictions for the offences, respectively specified in columns 3 and 4 of that Schedule in relation to those persons and bodies. (2) In Schedule 4, drug offence means an offence constituted by the production, possession, supply, importation or export of a substance that is: (a) a narcotic substance within the meaning of the Customs Act 1901; or (b) a drug within the meaning given by: (i) subregulation 9A(1) of the Customs (Prohibited Exports) Regulations 1958; or (ii) subregulation 5(20) of the Customs (Prohibited Imports) Regulations 1956. (3) In Schedule 4, designated offence has the meaning given by section 85ZL of the Act.
