40B Arrest, removal and detention of suspect
(1) This section applies if a police officer has power to arrest a suspect
under an arrest and removal order.
(2) The police officer must—
(a) use the minimum amount of force necessary to arrest or remove
the suspect; and
(b) before removing the suspect, explain to the suspect the reason
for the arrest.
Note The Crimes Act 1900, s 252I requires that a responsible person for a child
be told if the child is arrested.
(3) The suspect may be detained in custody for as long as reasonably
necessary to carry out the forensic procedure.
