> > (1) The collection, use or disclosure of information under this Part does not affect the application of Division 2 of Part 5 of Chapter 6 of the [Criminal Procedure Act 1986](/view/html/inforce/current/act-1986-209) to any of that information that is a protected confidence.

> > (2) This section applies whether or not a protected confider consents to the collection, use or disclosure of the information under this Part.
