Crimes (DNA Database) Regulations 2022

The Regulations use a small number of legal mechanisms and cross‑references. Reg 1 establishes the objective: prescribing which external laws "relating to the carrying out of forensic procedures and DNA databases" count as corresponding laws for s 464(2) of the Crimes Act 1958. Reg 2 identifies the statutory head of power: the instrument is made under s 464ZJ of the Crimes Act 1958. Reg 3 fixes commencement on 19 November 2022. Reg 4 expressly revokes the earlier 2012 Regulations (Crimes (DNA Database) Regulations 2012). Reg 5 contains the operative list of corresponding laws, expressed as a schedule of prescribed statutes, parts, chapters, divisions and sections.

Key definitional mechanism: the Regulations do not define "corresponding law" themselves; instead they supply a list to be read into the statutory definition in s 464(2) of the Crimes Act 1958. In other words, the Regulations perform a statutory‑reference function: they declare that, for the purposes of Victoria’s Crimes Act definition, certain provisions of other jurisdictions are to be treated as corresponding laws. That is the only operative effect set out by the Regulations themselves: see Reg 1 and Reg 5.

The list in Reg 5 is precise about what is prescribed, and varies in scope by entry. Some entries prescribe an entire Part (for example Part 1D of the Commonwealth Crimes Act 1914, Reg 5(a)); other entries prescribe whole Acts of States or Territories (for example the Crimes (Forensic Procedures) Act 2000 (NSW), Reg 5(b), and the Forensic Procedures Act 2000 (Tasmania), Reg 5(c)); some entries prescribe specific chapters, divisions or individual sections within an Act (for example the Northern Territory entries: Division 2 of Part 1, Division 3 of Part 2 and s 159 of the Youth Justice Act 2005; and ss 52 and 199 of the Correctional Services Act 2014, Reg 5(j)-(k)). The Western Australian list includes two Acts, the Criminal Investigation (Identifying People) Act 2002 and the Criminal Investigation Act 2006 (Reg 5(d)-(e)). Queensland’s prescription is by chapter (Chapter 17 of the Police Powers and Responsibilities Act 2000, Reg 5(g)). South Australia’s entry is the Criminal Law (Forensic Procedures) Act 2007 (Reg 5(h)). The Australian Capital Territory’s Act is the Crimes (Forensic Procedures) Act 2000 (Reg 5(f)). The Northern Territory also appears at Reg 5(i)-(k) with multiple discrete statutory references.

Interpretative material in the Endnotes records that, for the purposes of interpreting the Statutory Rule, the usual provisions of the Interpretation of Legislation Act 1984 apply (Endnotes, "INTERPRETATION OF LEGISLATION ACT 1984 (ILA)"). The Endnotes also record that the instrument will sunset ten years after making (see Endnotes, General information). The Endnotes explicitly state that explanatory memoranda and other printed matter after the Endnotes do not form part of the Statutory Rule (Endnotes, "Other material").

In short, the main conceptual point is that the Regulations are a prescription instrument: they do not create substantive forensic powers but determine which non‑Victorian statutory provisions will be recognised under a Victorian statutory definition of "corresponding law", with the attendant consequence that other provisions of the Crimes Act 1958 that operate by reference to a "corresponding law" will have those non‑Victorian provisions available for the purposes of the Victorian definition.

The Regulations affect three distinct groups of actors by way of legal recognition and operational interface.

1. Practitioners and decision‑makers who rely on section 464(2) of the Crimes Act 1958. The Regulations alter the set of external statutes that are "prescribed" as corresponding laws for the purpose of that definition. Any Victorian official, prosecutor, police officer, or legal adviser who must determine whether a particular non‑Victorian forensic procedure or DNA database provision qualifies as a "corresponding law" for operation of the Victorian Crimes Act will now consult this Regulation (Reg 1 and Reg 5).

2. State and Territory authorities that operate the listed forensic or DNA laws. The specific Commonwealth, State and Territory laws listed in Reg 5 are brought into the Victorian statutory definition. Those external authorities will find their provisions singled out as instruments recognised by Victoria when Victoria’s s 464 uses the "corresponding law" concept. The list includes Commonwealth Part 1D of the Crimes Act 1914, New South Wales (Crimes (Forensic Procedures) Act 2000), Tasmania (Forensic Procedures Act 2000), Western Australia (both the Criminal Investigation (Identifying People) Act 2002 and the Criminal Investigation Act 2006), the Australian Capital Territory (Crimes (Forensic Procedures) Act 2000), Queensland (Chapter 17 of the Police Powers and Responsibilities Act 2000), South Australia (Criminal Law (Forensic Procedures) Act 2007), and multiple discrete provisions of the Northern Territory legislation (Reg 5(a)-(k)).

3. Individuals subject to forensic procedures or to data being placed on a DNA database. Although the Regulations do not themselves create the forensic powers, they change the external statutory sources that Victoria will treat as "corresponding laws". Where Victoria’s Crimes Act invokes "corresponding law" to authorise a measure, the list in these Regulations determines whether a particular external law can be relied upon as part of that mechanism. Consequently, persons subject to forensic sampling, retention, or database inclusion should be aware that a prescribed external law may be relevant when the Victorian Act refers to "corresponding law" (Reg 5).

Other affected parties include legal advisers and compliance officers who must reconcile forensic‑procedure practice across jurisdictions. Because the list is by specific provisions rather than broad labels, those advising on compliance must check both the Regulations (Reg 5) and the relevant external statutory provisions cited to establish the operative rights, duties and procedures that may be treated as corresponding laws by Victoria.

Finally, by Revocation (Reg 4) the instrument replaces the prior 2012 Regulations; anyone tracking historical practice or transition arrangements needs to note the replacement and consult the prior instrument where transitional issues arise. The Endnotes record that the Regulations will sunset on 11 October 2032 unless remade or otherwise extended under the Subordinate Legislation Act 1994 (Endnotes, General information).

The Regulations themselves impose no new policing or forensic duties and confer no direct rights upon individuals separate from the substantive external statutes they prescribe. Their legal effect is to designate particular external provisions as "corresponding laws" for the narrow purpose of the statutory definition in s 464(2) of the Crimes Act 1958 (Reg 1 and Reg 5). Therefore, the substantive duties and rights remain those contained in the external Acts listed at Reg 5. Practitioners must therefore read the Regulations in tandem with those listed provisions to ascertain what actual powers, obligations and safeguards apply in a given case.

Duties of Victorian officials: where the Victorian Crimes Act relies on the concept of a "corresponding law", officials will rely on this list to determine whether a specific external statute is available to be treated as corresponding. This creates an administrative duty to consult the Regulations (Reg 5) in any decision that invokes s 464(2). Failure to consult or mis‑classifying a provision could have legal consequences in downstream decisions, although the Regulations do not themselves set remedies or enforcement mechanisms.

Rights of individuals: any legal rights that arise in the interaction between the Victorian Crimes Act and an external "corresponding law" are grounded in the external statute and the way the Victorian Act uses "corresponding law". The Regulations merely identify which external statutes count under the Victorian definition. For example, if a person's right to object, to seek review, or to require retention/destruction of a sample is set out in a prescribed external law, that procedural content will be relevant wherever Victoria’s s 464(2) calls for a "corresponding law". The Regulations do not alter substantive content; they determine recognition.

Administrative obligations for cross‑jurisdictional operations: agencies that operate across borders (for example, where samples or DNA data are to be shared with Commonwealth or other State/Territory authorities) need to incorporate the list in Reg 5 into their compliance frameworks. The Regulations require that the relevant external provisions specified be treated as corresponding laws, which will affect legal analyses about data sharing, mutual assistance, recognition of forensic procedures, and the legal basis for using DNA information under the Victorian Act.

Temporal obligations: because the Regulations replace the 2012 Regulations (Reg 4) and will sunset on 11 October 2032 (Endnotes), agencies and advisers must track that temporal boundary and any future amendments to the list; there is an implicit duty to monitor the Regulations, their sunset and any successor instruments for ongoing compliance.

In sum, the Regulations affect duties and rights indirectly: they supply the list of external statutory sources that, when invoked by the Victorian Crimes Act, will determine the substantive duties officials must follow and the rights available to individuals. The Regulations therefore create an obligation for advice and operational practice: to consult the prescribed list in Reg 5 and the external provisions themselves when applying s 464(2).

The Regulations contain no penalties, enforcement mechanisms, inspection powers, or direct sanctioning provisions. They are a non‑substantive, prescribing instrument: Reg 1‑5 set out the purpose, power, commencement, revocation and the list of corresponding laws. There is no provision within the Regulations imposing offences or civil penalties. Consequently, any penalty or enforcement consequence that applies in a situation where a "corresponding law" is relevant will derive from the substantive Acts listed in Reg 5 or from the Crimes Act 1958 itself, not from these Regulations.

Operational consequence for enforcement frameworks: because the Regulations determine which external provisions are to be treated as corresponding laws under s 464(2) of the Crimes Act 1958, they affect which external Acts' enforcement and penalties may be relevant when Victoria invokes corresponding‑law linkage. For example, where the Victorian Act permits action only if a "corresponding law" provides certain powers or sanctions, the inclusion of an external law in Reg 5 may import that external law’s enforcement architecture into the Victorian legal analysis. The Regulations do not themselves specify whether, or how, external penalties apply in Victoria; practitioners must look to the Crimes Act 1958 and the external statutory provisions.

Administrative oversight and review: the Endnotes state that the Regulations will sunset ten years after making (on 11 October 2032) under the Subordinate Legislation Act 1994 (Endnotes, General information). The sunset mechanism is an indirect enforcement and review tool in the sense that the instrument will expire unless remade; this requires executive decision‑making before expiry if the prescribed list is to continue in force. The Regulations do not specify any reporting, review schedule or automatic amendment mechanism.

Revocation and transitional enforcement questions: Reg 4 revokes the 2012 Regulations. The instrument does not record transitionary enforcement provisions or savings clauses in the text provided. Any questions about how actions taken under the 2012 Regulations are treated following revocation must be resolved by reference to the revocation provision and any saving or transitional provisions in the enabling statute (s 464ZJ) or the Crimes Act 1958; however, those enabling provisions are not set out in these Regulations. Practitioners should therefore treat enforcement questions as depending on the Crimes Act 1958 and the listed external statutes.

In short, there are no penalties or enforcement measures created by these Regulations; their enforcement consequences operate only through their effect on the statutory definition in the Crimes Act 1958 and the substantive enforcement regimes of the prescribed external laws.

The Regulations are an instrument of delegated legislation that functions by cross‑reference to both Victorian primary legislation and a range of external statutes.

Primary enabling and target provisions: the Regulations are made under s 464ZJ of the Crimes Act 1958 (Reg 2) and expressly address the definition of "corresponding law" in s 464(2) of the same Act (Reg 1). Thus the Regulations interact directly with Victoria’s Crimes Act: they populate the statutory definition with a prescribed list of non‑Victorian laws. Any provision of the Victorian Crimes Act that uses the term "corresponding law" and relies on the definition in s 464(2) will be affected.

Prescribed external statutes: Reg 5 lists specific Commonwealth, State and Territory Acts and parts or sections of those Acts. Those external provisions remain substantive sources of law for forensic procedures and DNA databases; the Regulations do not amend those Acts. Instead, the Regulations alter the Victorian statutory landscape by specifying which external provisions count as corresponding laws. Readers must therefore read the Regulations alongside the external Acts listed at Reg 5(a)-(k) to establish the full legal regime applicable in cross‑jurisdictional forensic matters.

Interpretation Act interactions: the Endnotes point to the application of the Interpretation of Legislation Act 1984 (ILA) principles to this Statutory Rule. The Endnotes set out the effect of ILA provisions on headings, examples, punctuation and provision numbers, and state that explanatory memoranda and similar materials printed after the Endnotes do not form part of the Statutory Rule. This means the usual interpretive presumptions apply when construing the Regulations and their headings, and that external explanatory materials are not part of the operative law (Endnotes, "INTERPRETATION OF LEGISLATION ACT 1984 (ILA)" and "Other material").

Revocation of prior instrument: Reg 4 revokes the Crimes (DNA Database) Regulations 2012. Where transitional or savings issues arise, the interaction will depend on the enabling statute (s 464ZJ) and any transitional provisions in the Crimes Act 1958. The Regulations as provided do not include explicit saving clauses; practitioners should check the enabling and related Victorian legislation for transitional rules.

Sunset mechanism under subordinate‑legislation law: the Endnotes record that these Regulations will sunset ten years after making under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That Act’s operation will therefore interact with the continuing validity of these Regulations; the prescribed list will cease to operate on the sunset date unless the instrument is remade or otherwise extended in accordance with the Subordinate Legislation Act 1994.

Practical cross‑jurisdictional effects: because the Regulations name specific parts of other jurisdictions’ Acts, alterations to those external Acts will change the substance of what is available to be treated as a corresponding law even though the Regulations remain numerically unchanged. The Regulations do not themselves purport to assimilate external law content into Victorian law; they simply nominate those external provisions for the definitional purpose in the Crimes Act 1958. The precise legal effect in any case will depend on how s 464(2) and other provisions in the Crimes Act 1958 incorporate the corresponding law concept; that analysis requires reading the Crimes Act together with the list in Reg 5 and the external statutes.

In conclusion, these Regulations are a connective instrument: they operate at the intersection of Victorian statutory definition and a set of external forensic/DNA statutes, and are subject to the interpretative rules set out by the ILA and the expiry rules of the Subordinate Legislation Act 1994.

The Regulations as printed record no amendments made to them by subsequent statutory rules, subordinate instruments or Acts (Endnotes, Table of Amendments). The instrument expressly revokes the prior Crimes (DNA Database) Regulations 2012 (Reg 4). The Endnotes record the date of making as 11 October 2022 and the date of operation as 19 November 2022 (Endnotes, General information, and Regs 1 and 3).

The Endnotes also record that the Regulations will sunset ten years after the day of making, namely on 11 October 2032, by operation of section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). No amendment history entries are listed in the Table of Amendments; the Table of Amendments states explicitly that there are no amendments made to these Regulations by statutory rules, subordinate instruments and Acts (Endnotes, 2 Table of Amendments).

Practically, the only changes effected in relation to earlier instruments are: (a) revocation of the 2012 Regulations (Reg 4), and (b) the making of this new instrument on 11 October 2022 which commenced 19 November 2022. There is no record in this instrument of transitional amendments, modifications, or time‑limited entries beyond the sunset provision noted above. Any further changes to the list of corresponding laws or to the instrument’s structure would require either amendment by subsequent Statutory Rule made under s 464ZJ or replacement prior to the statutory sunset.

The Endnotes also include a short explanatory detail identifying the revoked instrument as S.R. No. 127/2012 (Explanatory details 1. Reg. 4). That is the only explicit cross‑reference to the prior instrument in the legislative history provided here.

Users should therefore regard the Regulations as current in the form printed, with their operative life limited by the ten‑year sunset, and with no recorded in‑force amendments between making and the date of the Version as at 19 November 2022.

The statutory material supplied contains no record of litigation, judicial decisions, or challenges to these Regulations. The Endnotes and the body of the Regulations include no references to judicial consideration, recorded appeals, or case law. The instrument therefore contains no litigated history in the provided text.

Because the Regulations operate by prescribing external laws to be treated as "corresponding laws" for s 464(2) of the Crimes Act 1958, it is possible that litigation in the future could arise over whether particular external provisions operate as corresponding laws in a specific case, the scope of any imported procedural protections, or the legality of actions taken under a Victorian provision that relies on the concept of a "corresponding law". However, the provided Regulations text contains no such cases, and does not name or cite any judicial authorities. Accordingly, any discussion of litigation history would be speculative and is not present in the source.

Practitioners needing precedent on disputes about the interaction of Victoria’s corresponding‑law mechanism with the listed external laws must search case law on the Crimes Act 1958 and relevant instances where s 464 or related provisions were litigated. The Regulations themselves contain no litigation history or interpretive cases to cite.

The Regulations are concise, but their simplicity gives rise to several practical pitfalls to watch for, each grounded in the instrument’s text and structure.

1. Static list versus dynamic external law. Reg 5 prescribes a specific list of external provisions as corresponding laws. The Regulations do not provide any mechanism to update that list automatically when the external statutes are amended. The instrument records its making date and commencement date (Endnotes, General information; Regs 1 and 3). Practitioners should therefore not assume that later amendments in a listed external Act are automatically reflected in the Regulations; the Regulations nominate the external statutes as they stand for the definitional purpose, and any divergence between the external law content and the Victorian prescription may require administrative or legislative amendment to the Regulations.

2. Granular prescription creates potential mismatches. Some entries in Reg 5 prescribe entire Acts or parts; others single out chapters, divisions or specific sections (Reg 5(a)-(k)). This precision causes risk of error if advisers assume that an entire Act is included where only a part is prescribed. For example, the Northern Territory entries include Division 7 of Part VII of the Police Administration Act 1978 (Reg 5(i)), but also separate entries for parts of the Youth Justice Act 2005 and sections of the Correctional Services Act 2014 (Reg 5(j)-(k). Lawyers must check the exact wording of Reg 5 and the external provisions to avoid overinclusive or underinclusive assumptions.

3. Revocation without transitional text. Reg 4 revokes the 2012 Regulations but the current instrument contains no express transitional or savings provisions in the text provided. If there are matters that were authorised or underway under the 2012 Regulations prior to revocation, the absence of stated savings clauses in this instrument means that resolution depends on the enabling legislation (s 464ZJ) or the Crimes Act 1958. Practitioners should not assume transitional continuity; they should check enabling provisions and administrative guidance.

4. No substantive procedure or safeguards in the Regulations themselves. Reg 1 makes clear the objective is prescription for the definition in s 464(2). The Regulations do not themselves set out procedural safeguards, consent requirements, retention limits, or chain‑of‑custody rules. Any such protections will be found in the external statutes listed (Reg 5) or in the Crimes Act 1958. It would be a mistake to rely on the Regulations alone to determine an individual’s rights.

5. Sunset expiry. The instrument will sunset on 11 October 2032 by operation of the Subordinate Legislation Act 1994 (Endnotes). If the list is still intended to apply after that date, there must be remaking or replacement. Organisations that embed the current list into operational policies need to diarise the sunset date and arrange for review well in advance.

6. Interpretive reliance on ILA rules. The Endnotes state various ILA effects apply to the statutory rule, including that headings and notes form part of the instrument and that explanatory memoranda printed after Endnotes do not form part of the Rule. Misreading the Endnotes or mistakenly relying on extrinsic explanatory material printed with the instrument could lead to flawed interpretation.

7. Cross‑jurisdictional procedural complexity. Because Reg 5 links Victorian operation to a range of external statutes with potentially different procedural frameworks, operational actors may confront inconsistent standards or requirements when coordinating forensic sampling, database inclusion, or data sharing. The Regulations do not harmonise those substantive differences; they only nominate the external provisions for definitional purposes.

8. Multiple Western Australian Acts listed. WA is represented by two separate Acts (Reg 5(d)-(e)). That raises a practical question when deciding which WA provision is the operative corresponding law in a particular case. The Regulations do not provide selection rules where multiple external laws might be relevant.

In short, the primary gotchas are that the Regulations are a static prescribing instrument that must be read with the listed external provisions and that they contain no substantive procedural content or transitional clauses. Practitioners should be alert to the precise textual scope of each listed entry and to the sunset and revocation mechanics.

Compliance with the practical effects of these Regulations requires a disciplined cross‑reference process and ongoing monitoring. Because the Regulations do not themselves create forensic powers or procedural rules, compliance means correctly identifying when the Victorian Crimes Act’s relevant provisions invoke a "corresponding law" and then applying the external statute listed in Reg 5.

Actionable steps for practitioners and agencies:

1. Incorporate Reg 5 into decision checklists. Where a decision under the Victorian Crimes Act depends on whether a provision of another jurisdiction qualifies as a "corresponding law", include a mandatory check of the Regulations (Reg 5) as part of the legal due diligence. Document that the relevant external provision is one of those prescribed.

2. Read the external provision. After identifying the relevant external law from Reg 5(a)-(k), read the operative parts of that external Act to determine substantive powers, thresholds, safeguards and penalties. The Regulations name the external source; they do not state its content.

3. Pay attention to the exact wording of Reg 5 entries. Some entries are parts, divisions, chapters or sections only. For example, Reg 5(a) prescribes "Part 1D of the Crimes Act 1914 (Commonwealth)" while Reg 5(j) prescribes "Division 2 of Part 1, Division 3 of Part 2 and section 159 of the Youth Justice Act 2005 of the Northern Territory". Insert cross‑references in case files noting the precise parts/sections that are the relevant corresponding law.

4. Track amendments to external Acts and to these Regulations. Because the Regulations are a static list made on 11 October 2022 and commenced 19 November 2022 (Endnotes and Reg 3), any changes to the external Acts will affect the substantive legal landscape but will not change this list unless the Regulations are amended. Ensure legal teams monitor both the Regulations and the external statutes for amendments that may affect operational compliance.

5. Note sunset and revocation dates. Diarise the sunset date of 11 October 2032 (Endnotes) and the revocation date of the 2012 Regulations (Reg 4) in compliance registers. If your operational arrangements depend on continuity of this list beyond the sunset date, plan for executive or legislative action to maintain or replace the prescribing instrument.

6. Do not rely on explanatory materials attached to the instrument. The Endnotes state explanatory memoranda and other printed material after the Endnotes do not form part of the Statutory Rule. For legal compliance, rely on the Regulations and the external statutes themselves rather than on accompanying explanatory text (Endnotes, "Other material").

7. Record cross‑jurisdictional authority and chain of legal basis. In advice, state both the Victorian statutory provision that requires a corresponding law and the specific external law prescribed by Reg 5 that is being relied upon. That dual citation clarifies the legal foundation for any forensic procedure or data‑sharing action.

8. Seek targeted advice on transitional issues. If actions were initiated under the revoked 2012 Regulations, advise stakeholders to obtain formal legal advice about transitional legality and whether enabling statutes supply any savings or validation clauses. The current Regulations contain no explicit transitional provisions.

9. Update policies and templates. For organisations that prepare warrants, orders, or mutual‑assistance requests tied to the concept of "corresponding law", update templates to include citations to these Regulations and to the external provisions listed at Reg 5 where relevant. Include fields showing the Reg 5 entry relied upon and a link to the corresponding external statutory text.

10. Train operational staff in precise textual matching. Because Reg 5’s entries are precise and sometimes narrow, training should emphasise careful textual matching rather than reliance on informal descriptions like "the WA forensic law" or "the NT youth justice provisions".

Following these steps will ensure that where the Victorian Crimes Act requires identification of a "corresponding law" under s 464(2), the organisation can demonstrate it relied on the Regulation’s prescribed list, and on the substantive provisions of the external statute chosen.
