Crimes (Child Sex Offenders) Regulation 2005

The regulation operationalises several core administrative concepts from the Act by specifying methods, documents and authorised recipients. The principal concepts are: registrable offender reporting procedures; approved reporting places and methods; identification and verification of personal details; notice and information flows between sentencing/release authorities and the police; disclosure pathways from the child sex offenders register; inter-jurisdictional equivalence; and the supervising authority.

Registrable offender reporting procedures

• The regulation details permissible channels for initial, annual and travel-related reports: telephone, email and prepaid post, and in-person at approved reporting places (ss 7-9, 10). These are the concrete means by which the Act’s reporting obligations are to be satisfied.

Approved reporting places and chief police officer discretion

• Woden Police Station is a specified approved reporting place (s 10(1)). The chief police officer can declare others by notifiable instrument (s 10(2)-(3)), creating an administrative discretion that must be exercised by formal instrument.

Identification and verifying documentation

• For persons reporting in person for an offender, acceptable identification includes a current Australian passport or the primary-plus-two-secondary documents combination (s 11; Dictionary). Table 17 in s 17 maps particular personal-detail items in the Act (defined at s 59(1) of the Act) to required verifying documents (e.g., birth certificate for name and birth details; vehicle registration certificate for motor vehicles; passport for travel/passport-related details), making evidentiary compliance explicit.

Notices and inter-agency reporting

• The regulation prescribes entities required to give reporting obligations notices (courts, director-generals, chief police officer in certain circumstances) and stipulates content elements that must be included in a notice (e.g., statutory sections requiring reporting, whether in-person reporting is required, ID and supporting documentation requirements, consequences of non-compliance) (s 12, s 13). It imposes timing and transmission duties on entities that give notices, including an obligation to notify the chief police officer in writing within three days and to provide copies of acknowledgements (s 14).

Disclosure pathways and authorised recipients

• s 16A prescribes a broad list of entities that may be given personal information from the child sex offenders register for law enforcement functions or activities; the list includes courts, legal representatives (including Legal Aid and the Aboriginal Legal Service), employment service officers, customs, director-generals of key Territory directorates, law enforcement agencies (Australian Federal Police and Commonwealth/State agencies), registrars-general, Commonwealth Secretaries of Health and Home Affairs, Attorneys-General, DPPs and the commissioner for fair trading under the Working with Vulnerable People (Background Checking) Act 2011, among others. The regulation also enables disclosure to Commonwealth passport ministers for passport functions (s 16B).

Inter-jurisdictional correspondence

• The regulation prescribes a list of corresponding orders and laws from other Australian jurisdictions (ss 18-19) that the ACT will treat as equivalent for the Act’s division on corresponding law and registration orders. This list affects who may be treated as a corresponding offender when entering the ACT and the functioning of cross-border reporting.

Supervising authority

• The regulation designates supervising authorities by offender age: director-general under the Crimes (Sentence Administration) Act 2005 for adults and director-general under the Children and Young People Act 2008 for children (s 20).

Dictionary and signpost definitions

• The dictionary incorporates definitions and signpost references to other legislation, for example, linking “credit card” and “debit card” to the Australian Consumer Law (ACT) (s 3; Dictionary). That cross-referencing pulls definitional content from other statutes into the regulation’s meaning.

Collectively these concepts translate the Act’s statutory duties into identifiable procedural steps, evidentiary thresholds and disclosure authorisations. The regulation focuses on process and inter-agency flows rather than expanding substantive criminal liability, allocating roles to police, registrars, courts and a set of administrative directors and agencies.

Directly affected persons and entities

• Registrable offenders and persons who report on their behalf are the primary subjects of the regulation’s operational rules. The regulation prescribes how these persons must make contact, the approved methods for reporting, the approved locations for in-person reporting, and the identity and verifying documents they must provide when reporting (ss 5-11, 17). That creates ongoing compliance obligations for offenders who fall within the Act’s definition of registrable offender (see Act, s 8 and s 9 as referenced in the Dictionary).

Courts and sentencing/release authorities

• Magistrates Court, Supreme Court, Childrens Court and various director-generals are required to give reporting obligations notices to registrable offenders in specified circumstances (s 12). Entities that give notices must also provide copies to the director-general under the Crimes (Sentence Administration) Act 2005 in certain contexts (s 12(2)). This imposes procedural duties on courts, correctional and welfare agencies at sentencing or release points.

Chief police officer and registrar functions

• The chief police officer has decision-making power to declare additional approved reporting places (s 10(2)-(3)). The chief police officer is also the recipient of written notification from entities that give reporting obligations notices, and receives copies of acknowledgements (s 14). The Registrar, ACT Child Sex Offender Registry (postal address specified in ss 7-9) is identified as the administrative contact for postal reports. These are operational nodes for enforcement and administration.

Supervising authorities

• The regulation designates the supervising authority for adults (director-general under the Crimes (Sentence Administration) Act 2005) and children (director-general under the Children and Young People Act 2008) (s 20). Those directorates will supervise offenders in accordance with the Act and the regulation; their functions include sending events notices to the chief police officer (s 15).

Legal representatives and support services

• Legal representatives of registered offenders, including Legal Aid and the Aboriginal Legal Service (NSW/ACT), are expressly listed as prescribed entities permitted to receive personal information from the child sex offenders register for law enforcement functions and activities (s 16A(1)(b)). That authorises lawyers to access register data as part of their representation duties.

Commonwealth and State agencies

• The regulation prescribes an extensive list of Commonwealth and State entities that may be given personal information for law enforcement functions, including Customs, Departmental Secretaries of Home Affairs and Health, Attorneys-General, DPPs and specified law enforcement agencies (s 16A). This affects any agency exercising passport, border, public health, prosecutorial or law enforcement functions that may interact with offender data.

Employment and service providers involved with children

• The regulation prescribes a non-exhaustive list of child-related events, activities and services (s 16C) that, if aimed at or designed to appeal to children or likely to have significant attendance by children, are treated as child-related employment for the Act (s 16C(a)-(g)). Entities providing those services will be affected by background checking regimes linked to the register and the Working with Vulnerable People (Background Checking) Act 2011, given that the commissioner for fair trading under that Act is a prescribed recipient of register information (s 16A(1)(p)).

Public and private intermediaries

• Employment screening services, pre-employment services and entities that find or help find employment are included in the definition of “employment service” in s 16A(2), and are therefore prescribed entities for disclosure. Private providers that perform employment screening who engage with registrable offenders in child-related roles may therefore be affected by authorised disclosures.

Wider civic registers and officials

• The registrar-general exercising functions under the Births, Deaths and Marriages Registration Act 1997 is listed (s 16A(1)(k)), meaning officers responsible for civil status records are prescribed recipients for law enforcement-related disclosures.

Entities not directly named but captured

• s 16A(1)(q) provides for “an entity responsible for exercising a function or activity for an entity mentioned in paragraphs (a) to (p)”, thereby capturing contractors or statutory officeholders performing functions on behalf of those listed agencies. That extends the regulation’s reach to outsourced service providers working for prescribed agencies.

Who pays and who decides

• Registrable offenders and persons reporting for them bear the compliance costs of identifying and verifying documents (Table 17, s 17) and following the reporting channels and in-person ID requirements (ss 7-11). Entities required to give reporting obligations notices (courts, director-generals, chief police officer) and the chief police officer bear administrative duties and time costs (s 12, s 14). Agencies receiving register disclosures bear responsibilities for appropriate use of disclosed information in specified functions (s 16A-16B), though the regulation does not itself set departmental obligations beyond authorisation.

Diffusion of costs and concentration of duties

• Costs are concentrated on offenders and on the specific public agencies responsible for notification and supervision. The disclosure authorisation concentrates informational benefits in law enforcement, prosecutorial and administrative agencies. The regulation creates pathways for many public-sector recipients to access register data; private actors may be affected where they function as employment services or contracted agents to prescribed entities (s 16A(2)).

Duties placed on registrable offenders

• Use approved reporting methods and places. The regulation authorises three approved reporting channels for travel and general reporting: telephone (1800 031 722), email (csort@afp.gov.au), and prepaid post to the Registrar’s GPO Box (ss 7-9). In-person reporting may be required in circumstances the Act prescribes, and the regulation specifies approved places (Woden Police Station and others declared by the chief police officer) (s 10).
• Provide verifying documentation. When required by the Act to report personal details, a registrable offender must supply the documentation mapped in Table 17 (s 17). For example, a birth certificate is required for proving name/dob (Table item 1), a document certifying a change of name if applicable (item 2), vehicle registration certificate or copy for motor vehicles (item 6), passport for passport-related details and travel (item 9), and itineraries/travel documents for travel details (item 7).
• Use specified identification when reporting in person. Persons reporting in person on behalf of an offender may present their current Australian passport or one primary and two secondary documents in lieu of an Australian driver licence (s 11; Dictionary definitions of primary and secondary documents).
• Comply with the Act’s reporting timelines and contents. The reporting obligations notice must set out time periods and the obligations in the Act sections listed (s 13(c)(i)-(v)), so the offender has a duty to comply with those statutory timeframes as communicated.

Duties placed on entities giving reporting obligations notices

• Identified entities must issue reporting obligations notices in the circumstances specified (s 12(1)). These include courts (Magistrates, Supreme, Childrens Court) on sentencing, director-generals on release from government custody, and the chief police officer where an offender enters and remains for seven days without prior notice or becomes a prescribed corresponding offender (s 12(1)(a)-(f)).
• Provide contents and transmission to police. Notices must include a detailed set of elements , offender identity, statutory reporting obligations and periods, how to report in person, required identification and supporting documentation, toll-free contact number and consequences for non-compliance , and the name, signature and position of the person giving notice (s 13). If an entity gives a notice, it must also tell the chief police officer in writing within three days that the notice was given and the date, and provide a copy of any acknowledgement from the offender (s 14).

Duties placed on supervising authorities

• Supervising authorities must give events notices to the chief police officer when particular events happen in relation to a registrable offender; the regulation prescribes the required contents of such notices (s 15). The supervising authorities are the director-general under the Crimes (Sentence Administration) Act 2005 for adults and the director-general under the Children and Young People Act 2008 for children (s 20).

Disclosure duties and authorised recipients

• The regulation prescribes which entities may receive personal information from the child sex offenders register for law enforcement functions or activities (s 16A). It does not itself create a duty to disclose in every instance, but it authorises disclosure to the listed recipients.
• The regulation also authorises disclosure to Commonwealth ministers for passport-related functions when the recipient is exercising functions under the Australian Passports Act 2005 or the Foreign Passports (Law Enforcement and Security) Act 2005 (s 16B).

Rights and protections

• Notes and signpost definitions are explicitly excluded from the regulation’s operative text (s 4), meaning explanatory material does not create enforceable obligations. The Dictionary links terms to other Acts, which provides legal certainty by tying definitions to established statutory meaning (s 3; Dictionary).
• Legal representation access is specifically authorised: legal representatives, including Legal Aid and the Aboriginal Legal Service, are prescribed recipients of register information for law enforcement functions (s 16A(1)(b)). This creates an explicit pathway for lawyers to access information necessary for representation.
• The regulation provides for formal notifiable instruments for declarations of approved reporting places by the chief police officer (s 10(3)), which imposes a public notification requirement under the Legislation Act for any change to approved reporting places.

Operational responsibilities and timelines

• Entities that give notices must act quickly; they are required to advise the chief police officer within three days of giving a notice and to provide any acknowledgement copy if the offender acknowledges receipt (s 14(2)). That introduces a short administrative timeframe for communication between judicial, custodial or supervisory bodies and the police.

Evidentiary obligations

• When reporting personal details, offenders must supply specified documents. The regulation provides a concrete evidentiary framework (Table 17) linked to the Act’s definition of “personal details” (Act, s 59(1) as referenced in Table 17). This reduces ambiguity about what constitutes acceptable proof for specific items.

Decision-making authorities

• The chief police officer, courts, director-generals and supervising authorities are the central decision-makers for exercise of the regulation’s administrative discretions. The regulation empowers the chief police officer to expand approved reporting places (s 10) and places responsibilities on courts and director-generals to issue notices (s 12).

In short, the regulation creates a tightly specified administrative regime of duties for offenders, procedural obligations for courts and supervisory agencies, and authorised disclosure conduits for a broad range of public-sector recipients, with specific evidentiary and notification timeframes established throughout.

Scope of penal framework referenced

• The regulation itself specifies procedural and administrative matters rather than creating new criminal offences. Enforcement of the Act’s reporting obligations and any penalties for non-compliance are principally matters of the Crimes (Child Sex Offenders) Act 2005. This regulation provides the operative detail that enables the Act to be enforced by setting approved methods, places, notice content and evidentiary standards (ss 5-20; Dictionary; s 13).

Penalty unit valuation

• The republication records the applicable penalty unit values at the republication date. It states that, at that date, the value of a penalty unit for an offence against this law is $160 for an individual and $810 for a corporation, as prescribed by the Legislation Act 2001, s 133 (front matter, “Penalties” paragraph). Where the Act or regulation prescribes an offence and attaches a number of penalty units, those monetary penalties are calculated using these values.

Enforcement actors and mechanisms

• The chief police officer and the Registrar of the ACT Child Sex Offender Registry are central to enforcement practicality. The chief police officer is the recipient of statutory notices and has discretion to declare reporting places (ss 10, 14). Supervising authorities (director-generals) and courts are obliged to issue reporting obligations notices and to inform police, creating reporting chains that enable enforcement oversight (ss 12-15, 20).
• Disclosure pathways to law enforcement and prosecutorial agencies are authorised in s 16A, enabling investigative and enforcement agencies to receive register data for their functions. The Australian Federal Police and other listed law enforcement agencies are explicitly included (s 16A(2)).

Procedural enforcement levers

• The regulation specifies the content that must be included in reporting obligations notices (s 13), including the statutory sections under which obligations arise and the consequences for non-compliance. That content empowers the chief police officer and prosecutorial agencies to evidence that an offender had been informed of obligations and potential consequences, which is likely relevant to enforcement decisions under the Act.
• The regulation’s evidentiary table (s 17, Table 17) reduces factual disputes about whether an offender provided acceptable verification of personal details, thereby assisting enforcement by clarifying documentary standards.

Administrative sanctions and consequences

• The regulation itself does not specify administrative sanctions (such as deregistration or supervision conditions), but it sets up the procedural steps (notifications, reports, disclosures) that feed into the Act’s enforcement apparatus. For example, supervising authorities must send events notices containing the event and date (s 15), which enable the chief police officer to monitor changes that may trigger enforcement activity under the Act.

Implementation and compliance oversight risks

• The regulation concentrates information flows through several public entities , courts, director-generals, chief police officer and the Registrar , creating dependence on timely interagency communication (ss 12, 14, 15). The regulation imposes a three-day timeframe for entities giving notices to inform the chief police officer (s 14(2)), which is a short administrative deadline that, if missed, could hamper enforcement timeliness.
• The chief police officer’s power to declare further approved reporting places by notifiable instrument (s 10(2)-(3)) places enforcement control in the hands of a single police official, subject to the formal requirement to notify; this centralisation reduces ambiguity but concentrates procedural discretion.

Limitations on public disclosure and authorised recipients

• Disclosure from the register is authorised to a specified set of recipients for law enforcement functions (s 16A) and for passport functions (s 16B). The regulation thereby limits routine public release and creates controlled disclosure channels, although the list of prescribed recipients is broad and includes both Commonwealth and State authorities, legal representatives, employment screening services and contracted entities (s 16A). The regulation does not itself set out detailed conditions on how recipients must handle personal information post-disclosure; those conditions fall to the Act, information-sharing policies, and privacy law.

Quantifying penalties

• To calculate actual monetary penalties for any offence the Act specifies, the practitioner must multiply the number of penalty units attached to the offence in the Act by the values stated in the Legislation Act at the time of sentencing ($160 individual, $810 corporation at the republication date). The regulation aids enforcement but does not itself set the penalty-unit amounts for particular offences.

In sum, the regulation is an enabling instrument for enforcement: it prescribes how obligations are notified, proven and monitored, names the enforcement and supervisory actors and authorises disclosure to enforcement and administrative agencies, while monetary penalties remain determined under the Act and Legislation Act penalty unit valuations.

Cross-references and signposting

• The regulation operates as a subordinate instrument to the Crimes (Child Sex Offenders) Act 2005, explicitly made under that Act (title page). It uses signpost definitions and cross-references to other Territory, State and Commonwealth Acts, which brings external statutory concepts into the regulation’s operation (s 3; Dictionary; multiple provisions referencing Act sections).

Relevant Territory Acts and authorities

• The regulation assigns supervisory authority functions to director-generals under the Crimes (Sentence Administration) Act 2005 and the Children and Young People Act 2008 (s 20). It requires copies of certain reporting obligations notices given by courts or director-generals to be sent to the director-general under the Crimes (Sentence Administration) Act 2005 (s 12(2)). It also references the ACAT in relation to release from detention under the Mental Health Act 2015 (s 12(1)(d)(ii)), demonstrating interaction with mental health and administrative tribunal regimes.

Interaction with federal passport and border laws

• s 16B authorises disclosure of personal information in the child sex offenders register to the Commonwealth Minister responsible for administering the Australian Passports Act 2005 and the Foreign Passports (Law Enforcement and Security) Act 2005, for the purpose of exercising functions under those Acts. This creates an explicit information-sharing pathway between the ACT register and Commonwealth passport authorities.

Inter-jurisdictional harmonisation

• The regulation prescribes corresponding child sex offender registration orders and corresponding laws from other Australian jurisdictions (ss 18-19). The list includes NSW, Victoria, Queensland, Western Australia, South Australia, Tasmania and the Northern Territory Acts. These prescriptions operationalise the Act’s corresponding-law and corresponding-order concepts, enabling automatic recognition or coordinated treatment of offenders who are subject to orders under other jurisdictions’ schemes.

Witness protection and confidentiality regimes

• s 16 lists State and Commonwealth witness protection Acts as prescribed laws in relation to the definition of “foreign protected witness” (s 16). That interacts with the Act’s provisions dealing with witness protection status and the confidentiality of register information as between jurisdictions and protection programs.

Privacy and background checking framework

• The regulation identifies the commissioner for fair trading exercising functions under the Working with Vulnerable People (Background Checking) Act 2011 as a prescribed recipient of register information (s 16A(1)(p)). This draws a direct link between the child sex offenders register and the Territory’s background checking regime for work with vulnerable people, aligning the register’s information flows with statutory background-checking processes.

Civil registration and identity law

• The Dictionary prescribes the Births, Deaths and Marriages Registration Act 1997 as the source for birth-certificate definitions and requires the registrar-general to be a prescribed recipient of register data (s 16A(1)(k); Dictionary). That interconnects civil status records and identity verification processes with reporting requirements under the Act.

Criminal justice and corrections legislation

• The regulation requires interplay with the Corrections Management Act 2007, insofar as the director-general exercising functions under that Act is a prescribed recipient under s 16A(1)(h). Sentencing and release authorities under the Corrections Management Act are therefore operationally linked to the register and reporting obligations.

Legislation Act and subordinate instrument rules

• The regulation relies on the Legislation Act for interpretative rules (s 3 notes) and for the legal status of notes (s 4). Declarations by the chief police officer are notifiable instruments subject to the Legislation Act’s notification requirements (s 10(3) and accompanying note). Penalty units are governed by the Legislation Act s 133 (front matter).

Interplay with state witness protection and registration laws

• By prescribing specific State statutes as corresponding laws and registration orders (ss 18-19), the regulation creates a statutory mechanism to treat offenders subject to other schemes as corresponding offenders in the ACT. This supports information-sharing and recognition across jurisdictions.

Administrative and prosecutorial functions

• The regulation’s authorisation for disclosure to Attorneys-General and directors of public prosecutions (s 16A(1)(n)-(o)) integrates prosecutorial and policy functions with the register. It therefore facilitates the use of register information in prosecutorial, policy and legal proceedings contexts.

Limitations and delegation

• The regulation authorises disclosures and prescribes duties but leaves substantive enforcement powers, penalties and privacy safeguards to the Act and to other identified legislation and administrative policies. For example, the regulation does not itself create privacy obligations for recipients; those are derived from other laws and departmental policies.

Overall, the regulation is an implementation layer that draws heavily on external laws for definitions, duties and institutional actors, and it creates a network of information flows across Territory and Commonwealth systems, corrections, courts, passport and background-checking regimes.

Legislative timeline and major instruments

• The regulation was originally made as SL2005-44 and first notified on the Legislation Register on 22 December 2005, with the remainder of the regulation commencing on 29 December 2005 (Legislation history, endnote 3). Since then it has been amended by multiple instruments and Acts across jurisdictions and years.

Chronology of notable amendments

• 2008: Amendments arising from the Children and Young People (Consequential Amendments) Act 2008 (A2008-20, sch 4 pt 4.9) and the ACT Civil and Administrative Tribunal Legislation Amendment Act 2008 (A2008-36, sch 1 pt 1.19) made changes including to the Dictionary and definitions, and these amendments commenced in stages in 2008-2009 (endnote 3; Amendment history).
• 2010: SL2010-27 (Crimes (Child Sex Offenders) Amendment Regulation 2010 (No 1)) inserted s 16A (Disclosure of personal information in child sex offenders register for law enforcement functions or activities , prescribed entities) and subsequently s 16A has been amended multiple times (endnote 4).
• 2011-2015: Several statute law amendment Acts between 2011 and 2015 made incremental changes to the Dictionary and to the roles of supervising authorities and prescribed entities (A2011-22; Statute Law Amendment Act 2011 A2011-52; A2012-21; A2014-51; A2015-35), with staggered commencements noted in the Legislation history (endnote 3).
• 2012: SL2012-39 made amendments to reporting methods and other technical changes (Amendment history).
• 2017: SL2017-31 added s 16B (Disclosure otherwise authorised) and made other adjustments; this instrument was notified on 26 October 2017 and parts commenced on 14 December 2017 (Legislation history; Amendment history).
• 2018-2019: SL2018-24 (2018) inserted s 16C (Child-related employment) and other clarifying provisions; Statute Law Amendment Act 2018 and 2019 made technical updates (endnote 3; Amendment history).
• 2022: Changes under the Crimes (Policing) Legislation Amendment Act 2022 (A2022-2, pt 3) adjusted headings and sections and amended s 13 details (Amendment history notes that s 13 was amended by A2022-2 s 32, s 33, and several headings were substituted by A2022-2 s 31).

Key content changes and their practical effects

• Addition of s 16A (SL2010-27 and subsequent amendments) expanded the list of prescribed entities authorised to receive register personal information for law enforcement functions and activities. The list has been broadened and clarified over time to include Commonwealth departments, Attorneys-General, DPPs, and entities carrying out functions for prescribed agencies (s 16A as amended, Amendment history).
• Insertion of s 16B (SL2017-31) explicitly authorised disclosure to Commonwealth Ministers responsible for the Australian Passports Act 2005 and the Foreign Passports (Law Enforcement and Security) Act 2005 for passport functions; this creates a direct federal interface.
• Insertion of s 16C (SL2018-24) prescribes a list of child-related events and services that qualify as child-related employment for the Act, clarifying what activities trigger background-checking implications under the Act and related Territory background-check legislation.
• Table 17 (verifying documentation) was substituted by A2015-35 s 1.15, making evidentiary requirements explicit for personal details, which reduced ambiguity about acceptable documents at reporting.
• Several amendments adjusted supervisory authority references to align with changes in Territory administrative structures (s 20 amended by A2008-20, A2011-22).

Commencement patterns and staging

• Many amendments were made with staggered commencement dates, reflecting connection to the commencement of other Acts or administrative arrangements (endnote 3). For example, changes tied to the Children and Young People Act 2008 and the Mental Health Act 2015 had staged commencements that aligned with those Acts coming into force.

Editorial and signpost changes

• The Legislation Act, part 11.3 authorises editorial amendments for republication. The amendment history records multiple editorial and definitional updates to the Dictionary, including changes to definitions like citizenship certificate and service bill, and signpost references to the Australian Consumer Law (ACT) (endnote 4).

How to locate amendment details

• The endnotes include a detailed legislation history and amendment history (endnotes 3 and 4). Each amendment entry identifies the amending instrument and commencement dates. Practitioners needing to trace legislative intent or historical versions should consult the amending Acts and notifiable/disallowable instruments listed in those endnotes and the ACT legislation register entries for each instrument.

Implications for compliance and transition

• Because the regulation links to numerous other Acts and administrative structures, amendments frequently accompany broader system changes (e.g., tribunal arrangements, mental health laws, children-and-young-people frameworks). This linkage creates a need for practitioners and agencies to monitor cross-commencing legislation for coordinated compliance and to adjust administrative procedures (e.g., which director-general is the supervising authority) accordingly.

In short, the regulation has been amended repeatedly to broaden authorised disclosures, clarify evidentiary requirements, tie the scheme into Territory and Commonwealth administrative arrangements, and reflect changes to supervisory structures. The amendment history is extensive and requires practitioners to check the legislation register for the current instrument versions and the historical amendments listed in the endnotes.

No cases named in the regulation

• The regulation text and its endnotes do not list any judicial decisions, reported cases or litigation history that interpret this regulation or its provisions. The document’s endnotes include legislation and amendment histories but no court decisions.

Implications of an absent litigation record in this republication

• The absence of litigation history in the republication does not mean there has been no judicial engagement with the Act or the regulation in practice; it means this particular republication does not record or annotate case law. Practitioners should not infer legal silence equates to settled practice. Instead, to identify relevant case law, one must search case law databases and the ACT registry for matters that involve the Crimes (Child Sex Offenders) Act 2005 or disputes about reporting, disclosure or administrative procedures under the Act and this regulation.

Where legal disputes are likely to arise

• Based on the regulation’s content, litigation or judicial review is most likely to concern:
  • disclosure and privacy disputes, for example, challenges to authorised disclosure to prescribed entities under s 16A or s 16B where privacy or procedural fairness is asserted;
  • challenges to administrative decisions, such as whether the chief police officer’s declaration of approved reporting places (s 10(2)-(3)) was lawfully made or whether an entity complied with the duty to give a reporting obligations notice (s 12) or to notify the chief police officer within three days (s 14);
  • evidentiary disputes over whether provided documents meet the requirements of Table 17 (s 17);
  • cases about enforcement where whether a registrable offender was properly informed via a compliant reporting obligations notice (s 13) might be material to a charge for failing to report under the Act.

Practical search points for litigation

• To find judicial consideration relevant to this regulation, search for cases that reference:
  • the Crimes (Child Sex Offenders) Act 2005 and its reporting and disclosure provisions;
  • the specific Act sections referenced in the regulation (e.g., Act ss 37, 42-49, 59, 103-108, 110, 118, 124, 137), because the regulation operationalises those sections;
  • errors of administrative process involving the chief police officer, courts, director-generals, or supervising authorities in issuing notices or disclosures;
  • privacy complaints or proceedings under privacy law frameworks that consider authorised data sharing.

Limitations of this republication as a litigation source

• This regulation’s republication provides statutory text and legislative history. It does not function as a case law database. Practitioners must consult legal databases (e.g., AustLII, Jade, LexisNexis, Westlaw) and tribunal records for any decisions interpreting either the Act or the regulation.

Summary

• The regulation’s republication does not contain a litigation history. Practitioners must independently search case law for judicial interpretation of the Act and this regulation, particularly around disclosure authorisations (s 16A/16B), evidentiary rules (s 17), notification duties (ss 12-15) and administrative exercises of discretion (s 10).

Short administrative deadlines and notification requirements

• Entities that give reporting obligations notices must inform the chief police officer in writing within three days and provide copies of any acknowledgement from the offender (s 14(2)). Missing this deadline creates a procedural gap between the sentencing/release entity and police oversight. Practitioners should note the short timeframe and ensure administrative processes (court registries, corrective services, directorate release procedures) capture and transmit notices within three days.

Narrowly specified verifying documents

• Table 17 prescribes particular documents for specific personal-detail items (s 17). For example, a payslip must be given within the last month for employment verification (Table item 4); vehicle evidence requires a current registration certificate (item 6); travel details require an itinerary and travel documents (item 7). Submitting alternative documents not listed may lead to rejection of the report as non-compliant. Offenders and their representatives should plan to produce the exact documents listed.

Alternative identification for persons reporting on behalf of offenders

• A person reporting in person for an offender may present either a current Australian passport or one primary document plus two secondary documents instead of an Australian driver licence (s 11; Dictionary). This substitution may be overlooked by front-line staff expecting a driver licence. Courts, registries and police desks should be prepared to accept the passport option or the primary-plus-two-secondary combination.

Email contact affects corresponding-law reporting obligations

• The regulation provides that the Act’s division on people required to report under corresponding law does not apply if the person has previously contacted a contact person by email in relation to the relevant entry into the ACT (s 6). This creates a discrete procedural effect: prior email contact can short-circuit the operation of a statutory division. Parties should confirm whether prior email contact exists before assuming the Act’s corresponding-law reporting rules apply.

Approved reporting places may change by notifiable instrument

• Woden Police Station is an approved reporting place but the chief police officer may declare additional approved reporting places by notifiable instrument (s 10(1)-(3)). Such declarations require notification under the Legislation Act and may alter where offenders must report. Practitioners should check whether any current notifiable instruments have added approved places since last review.

Broad list of authorised recipients and contractor exposure

• s 16A(1)(q) authorises disclosure to an “entity responsible for exercising a function or activity for an entity mentioned in paragraphs (a) to (p)”. That provision can extend to contractors, outsourced providers, or third-party employment screening services performing functions for prescribed agencies. Entities should be mindful that outsourcing can bring them into the disclosure loop and should architect data-handling and confidentiality arrangements accordingly.

Passport-related disclosure pathway

• s 16B authorises disclosure to the Commonwealth minister responsible for Australian Passports Act 2005 and Foreign Passports (Law Enforcement and Security) Act 2005 matters. This is a specific pathway that may affect an offender’s passport status. Offenders and advisers must be aware that passport decisions can be informed by register disclosures authorised by this regulation.

Overlap with background-checking regimes

• The commissioner for fair trading under the Working with Vulnerable People (Background Checking) Act 2011 is a prescribed recipient (s 16A(1)(p)), and s 16C lists events and services that count as child-related employment. This overlap means that an offender’s participation in activities in the s 16C list may trigger background-checking consequences and employer queries deriving from register disclosures.

Differences between “registrable offender”, “registered offender” and “reportable offender”

• The regulation references terms defined in the Act and in other Commonwealth Acts (for example, “reportable offender” in s 16B is defined by reference to the Australian Passports Act 2005, s 12(3)). Practitioners must carefully check applicable definitions in the Act and in the referenced Commonwealth or State statutes; similar-sounding terms carry jurisdiction-specific definitions and consequences.

Not all enforcement details are specified here

• The regulation provides procedural detail but does not set out penalties, enforcement processes or privacy handling obligations in full. Those matters are in the Act and in local and Commonwealth privacy and administrative law. Assuming the regulation contains the totality of enforcement rules would be an error.

Reliance on correct contact details

• The regulation names specific contact routes (telephone number and email) for reporting (ss 7-9). Updates to those contact points require administrative changes and publicisation. Practitioners should check the latest register or AFP contact details to ensure compliance.

Multiple organisations may have notice duties

• The list of entities that must issue notices includes multiple authorities depending on the offender’s circumstances (court of sentence, or different director-generals on release, or chief police officer in certain entry cases) (s 12). Confusion can arise about which entity ought to issue a notice in a particular set of facts; fail-safe administrative processes are necessary to avoid gaps.

Inter-jurisdictional recognition is limited to the prescribed list

• The regulation prescribes specific orders and laws from other jurisdictions as corresponding (ss 18-19). If an order or law from another State is not listed, it may not be treated as corresponding under the regulation; practitioners handling cross-border cases must verify whether a particular external instrument is included in the list.

Checklist for registrable offenders and their representatives

1. Know your reporting channels. Use the approved methods: telephone 1800 031 722, email csort@afp.gov.au, or prepaid post to “Registrar, ACT Child Sex Offender Registry, GPO Box 401, Canberra ACT 2601” for travel reporting, changes to travel details and other approved reporting (ss 7-9). Confirm whether in-person reporting is required under the Act (s 13(c)(vi)).
2. When reporting in person for an offender, carry acceptable ID. Present a current Australian passport, or one primary document and two secondary documents as defined in the Dictionary, if substituting for an Australian driver licence (s 11; Dictionary).
3. Prepare and provide verifying documentation. Match the items of personal detail you must report (per the Act’s s 59(1) definition of personal details) to the documents in Table 17 (s 17). For example:
   • Birth certificate for name/dob items (Table item 1).
   • Document certifying change of name if relevant (item 2).
   • Utilities bill, contract of sale or lease for address proof (item 3).
   • Recent payslip (within last month) for employment (item 4).
   • Current vehicle registration certificate for motor vehicles (item 6).
   • Itinerary and travel documents for travel details (item 7).
   • Passport for passport-related details (item 9).
4. Retain proof of notifications and deliveries. If a reporting obligations notice is given, keep an acknowledgement of receipt or other proof of service because the giving entity must forward copies to the chief police officer within three days (s 14). If you have contact by email prior to entering the ACT, note that the Act’s corresponding-law division may not apply (s 6).

For courts, sentencing and release authorities

1. Issue reporting obligations notices when required. If the offender is sentenced in the Magistrates, Supreme or Childrens Court, or released from government custody or meets the entry criteria in s 12, give the offender a reporting obligations notice setting out the items prescribed in s 13.
2. Ensure the notice contains all prescribed elements. The notice must include the offender’s name and date of birth, a statement of initial, annual and change-of-personal-details reporting obligations, the details required to be reported under the Act, the specific Act sections requiring reporting (listed in s 13(c)(v)), circumstances requiring in-person reporting, ID and supporting-documentation requirements, toll-free reporting number, other ways to report and the consequences of non-compliance (s 13).
3. Notify the chief police officer promptly. Within three days of giving the notice, inform the chief police officer in writing of the notice’s delivery and date, and provide any acknowledgement copy if the offender has acknowledged receipt (s 14(2)). Maintain administrative systems to meet this deadline.

For supervising authorities and directorates

1. Send events notices with required information. When an event covered by the Act occurs in relation to a registrable offender, notify the chief police officer with the offender’s name, date of the notice, the event description and date, and the name and signature of the person giving the notice (s 15).
2. Verify internal processes for supervision and reporting. As supervising authority (s 20), ensure your agency’s case management system records reporting obligations, evidence provided under Table 17 and triggers for events notices to police.

For agencies receiving disclosures

1. Confirm authorised function. Only use information from the child sex offenders register for the law enforcement functions or activities or passport functions authorised in ss 16A-16B. Ensure the recipient authority is listed or acting for a listed entity (s 16A(1)(q) permits entities exercising functions for a prescribed agency).
2. Implement data-handling and confidentiality protocols. Although the regulation authorises disclosure, data protection and privacy obligations arise under other laws and departmental policy. Put in place contracts, confidentiality undertakings and technical safeguards for any outsourced or contracted entity receiving information on behalf of a prescribed agency.

For employers and employment-screening services

1. Identify whether the role is child-related under s 16C. If the event, activity or service is aimed at or designed to appeal to children or likely to have significant attendance by children, it is prescribed as child-related employment (s 16C(a)-(g)). This includes entertainment or party activities, school events, sporting/recreational activities, photography services, talent or beauty competitions, promotional events and seasonal character appearances.
2. If engaging with registrable offenders, prepare to handle disclosures. Employment services and screening providers are expressly included in s 16A(2) as being within the “employment service” definition. Ensure compliance with background-checking and register-disclosure procedures.

Operational and administrative advice

• Maintain an up-to-date register of declared approved reporting places. Check for notifiable instruments under the Legislation Act that designate approved reporting places beyond Woden Police Station (s 10(1)-(3)).
• Train frontline staff. Court registries, prison release administrators, police station reception and welfare agency staff must know the acceptable ID and supporting documentary requirements (s 11, s 17, Dictionary) and the time-critical notification duty to the chief police officer (s 14).
• Cross-check inter-jurisdictional status when offenders enter from other States. Verify whether an offender is a prescribed corresponding offender under the list of corresponding orders and laws (ss 18-19), and ensure any previous email contact with a contact person is recorded because it affects the operation of the Act’s corresponding-law division (s 6).
• Document decisions and disclosures. When disclosing register information to any prescribed entity, record the statutory basis (s 16A or s 16B), the recipient, the purpose, the documents provided and the authority under which the disclosure took place.
• Keep documentary proof of eligibility for claimed exemptions or protections. If a registrable offender alleges foreign protected witness status or other protections, verify whether the relevant witness protection Acts are prescribed (s 16 lists prescribed witness protection laws) and follow any Act processes for confidentiality.

Practical steps for advisers

• For defendants or clients subject to reporting obligations, advise immediate steps: locate and prepare the documents in Table 17; verify whether the reporting obligations notice has been given and keep copies; if reporting by post or email, obtain a delivery or read receipt; and prepare to use the toll-free number if telephone reporting is appropriate (ss 7-9, 13, 17).
• For agencies and legal representatives, integrate cross-agency communication into case workflows to ensure the three-day notification requirement to the chief police officer is met (s 14).

In summary, compliance requires aligning documentary proof to Table 17, following the approved reporting channels and places, ensuring timely transmission of reporting obligations notices and acknowledgements to police, and treating register disclosure authorisations as tightly defined by ss 16A-16B and the regulation’s Dictionary.
