Crimes (Child Abuse Material) Regulations 2017

The Regulations deploy and clarify a very small set of concepts that link Victoria’s subordinate instrument to provisions in the Crimes Act 1958 and to Commonwealth office holders. The main concepts and how they are used in the Regulations are as follows.

Victoria Police: reg 5 declares that the term Victoria Police has the same meaning as in the Victoria Police Act 2013. The Regulations therefore do not attempt an independent definition; they import the statutory meaning from another Act. The effect is that any analysis of who qualifies as Victoria Police for the Regulations requires reference to the Victoria Police Act 2013, because reg 5 ties the meaning directly to that Act.

Authorised classifier: reg 6 prescribes, for the purpose of the definition of authorised classifier in s 51A(1) of the Crimes Act 1958, a specific subset of Victoria Police personnel. Those prescribed are members of Victoria Police personnel who have undertaken training conducted by Victoria Police in two areas: the examination of random samples of seized material (a phrase that directly echoes the Crimes Act s 51V(9)) and the certification of findings as to the nature and content of the samples. The concept is therefore operationalised as a status that depends on both employment in Victoria Police and completion of the specified training conducted by Victoria Police. The Regulations do not specify the content, length, assessment standards, accreditation or record‑keeping for that training; they simply prescribe training as the qualifying criterion.

Relevant industry regulatory authority: reg 7 prescribes the Children’s e‑Safety Commissioner (a Commonwealth office) as a relevant industry regulatory authority for the purposes of the definition in s 51A(1) of the Crimes Act, but specifically in respect of s 51S(2)(d). The Commissioner is identified by reference to section 50 of the Enhancing Online Safety for Children Act 2015 (Cth). The Regulations thus create an inter‑jurisdictional link between specified provisions of Victoria’s Crimes Act regime and a particular Commonwealth regulatory office.

Revoked instrument: reg 4 revokes the earlier Crimes (Child Pornography) Regulations 2015. The endnotes identify that instrument as S.R. No. 137/2015. The revocation function is administrative and terminates the prior subordinate rule.

Commencement and sunset: reg 3 sets the operational date as 1 July 2017. The endnotes record the date of making and that the instrument will sunset on 6 June 2027 under the Subordinate Legislation Act 1994. These temporal rules govern the Regulations’ legal life.

Authorising provision: reg 2 locates the Regulations under s 585AAA of the Crimes Act 1958. The Regulations therefore operate as subordinate legislation enacted pursuant to that head of power; the substantive content of the parent Act determines how the prescriptions operate in practice.

Interpretive link to ILA: the endnotes include detail about how the Interpretation of Legislation Act 1984 affects the Statutory Rule, for example treating headings, examples and punctuation as part of the instrument and locating legislative items. Those interpretive rules are part of the legal texture for reading this short rule.

Together, these concepts show that the Regulations are primarily definitional: they identify who may certify the nature and content of seized samples for Crimes Act purposes, and they nominate a named Commonwealth regulator for a specific subsection of the parent Act. The Regulations do not themselves elaborate procedures, penalties, or operational processes beyond those prescribed identities.

The Regulations have a narrow set of primary and secondary addressees because they perform a limited prescriptive role.

Primary operational addressees

• Victoria Police members who undertake the specific training described in reg 6. Those members are the only persons prescribed as authorised classifiers for the defined purposes in s 51A(1) of the Crimes Act 1958. Their status as authorised classifiers depends on being a Victoria Police member and having undertaken the Police‑conducted training in examination of random samples of seized material and in certifying findings about those samples (reg 6). The practical consequence is that only members who have completed that specified training will be able to be relied upon, under the Crimes Act provisions that reference an authorised classifier, to provide the prescribed certification.

• The Children’s e‑Safety Commissioner, a Commonwealth office holder appointed under s 50 of the Enhancing Online Safety for Children Act 2015 (Cth). Reg 7 prescribes that Commissioner as the relevant industry regulatory authority for the purposes of s 51S(2)(d) of the Crimes Act 1958. The Commissioner is thus formally identified in the Victorian statutory architecture for that specified subsection.

Secondary affected actors

• State and Commonwealth agencies and officials who interact under the Crimes Act provisions: because the Regulations tie the relevant industry regulatory authority to a Commonwealth office, they create cross‑jurisdictional points of contact, which may affect collaborative processes or information flows required by the Crimes Act. The Regulations do not specify the operational mechanics of such interactions; they simply name the body that counts for the statutory purpose in s 51S(2)(d) (reg 7).

• Defence, prosecution, courts and counsel engaged with evidence certification under the Crimes Act: when questions about the admissibility or sufficiency of certification or classification arise, parties must look to whether the person who gave the classification meets the narrow prescription in reg 6. The Regulations therefore affect evidentiary planning and chain of custody considerations where the Crimes Act provisions elsewhere rely on the existence of an authorised classifier.

• Industry participants who might, in other jurisdictions or contexts, be treated as relevant industry regulators. The Regulations remove ambiguity on this point for the specified subsection of the Crimes Act by naming only the Children’s e‑Safety Commissioner. Entities or industry bodies in Victoria cannot be treated as the prescribed relevant industry regulatory authority for that purpose unless the Regulation is amended.

Who does not become an authorised classifier under these Regulations

• Private sector experts, academic classifiers, independent specialists and non‑Victoria Police law enforcement personnel are not prescribed by these Regulations as authorised classifiers. The Regulations confine the permissible pool to Victoria Police members who have completed the named training (reg 6). The Regulations do not provide a pathway for non‑Victoria Police persons to be prescribed.

Who bears compliance and implementation costs

• The Regulations do not allocate explicit costs, but the practical costs of training, record keeping and certification will fall on Victoria Police as the body conducting the training and maintaining personnel. Any administrative costs associated with interaction with the Children’s e‑Safety Commissioner will fall on that office and on Victorian agencies or private parties to the extent the parent Act requires engagement (reg 7).

Temporal scope and legal continuity

• The Regulations came into operation on 1 July 2017 and replaced the 2015 Regulations that they revoke (reg 3 and reg 4). They will sunset on 6 June 2027 pursuant to the Subordinate Legislation Act 1994 (Endnote 1). Any party relying on the definitions must therefore be attentive to timing and any future replacement or amendment.

In summary, the Regulations directly affect Victoria Police members who undergo the prescribed training and the Children’s e‑Safety Commissioner. They indirectly affect prosecutors, defence counsel, courts and agencies that rely on the Crimes Act provisions connected to authorised classifiers and relevant industry regulatory authority, because those actors must ensure that any classification or regulatory engagement complies with the narrow prescriptions in regs 5-7.

The Regulations are not framed as a charter of duties and rights. They do not create freestanding obligations on private parties, nor do they provide statutory entitlements in the form of rights with enforcement mechanisms within the Regulations themselves. Instead, they operate by prescribing actors for definitional purposes in the Crimes Act 1958. The practical consequence is that duties and rights relevant to these prescriptions flow from the parent Act and associated training and administrative frameworks. The Regulations therefore change the landscape of who is empowered to perform certain functions under the Crimes Act. The principal practical effects on duties and rights are as follows.

Duties that follow from the prescription of authorised classifiers

• Duty to use prescribed classifier for specific statutory purposes: where the Crimes Act requires or permits reliance on an authorised classifier as defined in s 51A(1), the party seeking or relying on that classification must ensure that the person who provides the certification falls within the narrow class prescribed by reg 6. The Regulations make clear that only Victoria Police members who have undertaken the Police‑conducted training count. The duty is therefore practical and evidentiary; it attaches to parties using the Crimes Act mechanism rather than being a new duty in the Regulations.

• Administrative duty for Victoria Police to provide training and maintain competency: reg 6 ties the authorised classifier status to training conducted by Victoria Police. That creates an on‑us obligation for Victoria Police to provide, manage and record such training if it wishes personnel to be recognised as authorised classifiers for Crimes Act purposes. The Regulations do not set training standards, frequency, assessment or record‑keeping requirements; those operational duties will be established by Victoria Police policies and procedures, consistent with any requirements in the Crimes Act.

Rights and entitlements implied by the prescriptions

• Legal recognition of certification provided by prescribed classifiers: a person certified by a prescribed authorised classifier will be treated, for the purposes of the relevant Crimes Act provisions, as having the benefit of certification by an authorised classifier. The Regulations therefore create a definitional right of recognition, but the substantive legal consequences of that recognition are governed by the Crimes Act, not by the Regulations themselves (reg 6; reference to s 51A(1)).

• Recognition of the Children’s e‑Safety Commissioner as the relevant industry regulator: reg 7 creates a statutory recognition that the Commissioner is the relevant industry regulatory authority for the specified subsection. For third parties required to interact with or notify a relevant industry regulatory authority under the Crimes Act, the Regulations therefore clarify that the Commissioner is the entity to be engaged for s 51S(2)(d) purposes.

Absence of new enforcement or penalty regimes

• No new offences or penalties are created: the Regulations contain no penalty provisions and do not attempt to create criminal or civil consequences on their face. Any sanctions, duties or remedial measures that depend on the identification of an authorised classifier or a relevant industry regulator are matters for the Crimes Act and the administrative frameworks of the named entities.

Interplay with administrative discretion

• The Regulations vest no discretion in the maker about who qualifies beyond the single criterion of Victoria Police membership plus completion of Police‑conducted training. The selection and accreditation of authorised classifiers thus depends on internal Victoria Police decisions about training content and the selection of personnel to receive that training. The Regulations do not set objective thresholds, leaving that discretion with the Police.

In short, the Regulations do not themselves impose new duties or create freestanding rights. They determine who counts as an authorised classifier and which regulator counts for a specified statutory purpose. Duties and rights of practical significance flow from how the Crimes Act uses those definitions and from internal administrative arrangements of the prescribed bodies.

The Regulations do not contain penalty provisions, enforcement mechanisms, or procedural rules directing criminal sanctions. They are purely prescriptive about terminology and named actors. The enforcement and penalty architecture that may attach to the matters touched by these Regulations is therefore located in the Crimes Act 1958 and other relevant Acts, not within these Regulations themselves. Relevant observations from the text follow.

Absence of penalties or enforcement provisions in the Regulations

• No penalties: none of regs 1-7 create offences or prescribe fines, licensing conditions, or administrative sanctions. There are no enforcement powers conferred upon Victoria Police or the Children’s e‑Safety Commissioner within the Regulations.

• No procedural enforcement mechanisms: the Regulations do not set out powers to compel production, inspection, enforcement notices, or similar remedies. They do not change evidentiary rules directly. Any such procedural powers remain in the parent Act or in other laws.

Where enforcement and penalties will be found

• The Regulations repeatedly reference provisions in the Crimes Act 1958 (for example s 51A(1), s 51V(9) and s 51S(2)(d)) as the statutory contexts in which their prescriptions operate (regs 6 and 7). Therefore, to understand the enforcement consequences of an authorised classifier’s certification or the regulatory role of the Children’s e‑Safety Commissioner in the context of s 51S(2)(d), one must examine the Crimes Act. The Regulations function as definitional scaffolding for the Act’s enforcement regime, but they do not operate it themselves.

Practical enforcement implications

• Evidentiary consequences: although the Regulations do not create evidentiary rules, they will affect which persons’ certifications are treated as meeting the definition of authorised classifier in the Crimes Act. In legal proceedings that depend on that classification, parties and courts will need to assess whether the person who provided the classification falls within reg 6. Failures to rely on a prescribed authorised classifier where the Crimes Act requires one may have adverse evidentiary consequences in criminal prosecutions or other proceedings founded on the Crimes Act.

• Administrative follow‑through by Victoria Police and the Children’s e‑Safety Commissioner: any investigatory, enforcement or administrative functions that require a prescribed authorised classifier or consultations with a relevant industry regulator will be implemented, monitored and enforced via the parent Act or by the agencies’ internal policies. The Regulations do not delegate additional enforcement powers to those agencies.

Sunset and durability of enforcement architecture

• The endnotes record that the Regulations will sunset on 6 June 2027 (Endnote 1). If the Regulations expire without replacement, the definitional links they create will lapse, potentially affecting which persons are prescribed as authorised classifiers and which authority counts as relevant for s 51S(2)(d). The sunset is a procedural constraint on the durability of the current enforcement infrastructure insofar as it depends on these specific prescriptions.

In sum, enforcement and penalty questions are not answered by the Regulations themselves. The Regulations influence enforcement indirectly by specifying who, for statutory purposes, may perform certain certification or regulatory roles under the Crimes Act. The regulation of conduct, criminal liability and enforcement remedies must be located in the Crimes Act and in agency practices referenced by the Regulations.

These Regulations are deliberately minimal and operate exclusively as subordinate legislation under the Crimes Act 1958. They interact with other laws in defined ways by cross‑referencing and by importing meanings and office holders from other statutes. The principal points of legal interaction, taken from the text, are the following.

Reference to the Crimes Act 1958

• The Regulations are made under s 585AAA of the Crimes Act 1958 (reg 2) and are designed to give effect to certain provisions of that Act (reg 1). The substantive legal consequences of the Regulations therefore depend on the provisions of the Crimes Act that reference an authorised classifier and a relevant industry regulatory authority, specifically s 51A(1), s 51V(9) and s 51S(2)(d), which are cited in regs 6 and 7. To determine the full legal effect and procedural consequences of the Regulations, one must read them in conjunction with those parts of the Crimes Act.

Interaction with the Victoria Police Act 2013

• The Regulations import the meaning of Victoria Police from the Victoria Police Act 2013 (reg 5). That link means that membership criteria, employment status, and the organisational boundaries for who counts as Victoria Police are governed by the Victoria Police Act. Any dispute over whether a person is a Victoria Police member for the purpose of being an authorised classifier will be resolved by reference to the Victoria Police Act 2013 language the Regulations import.

Interaction with Commonwealth statute and office

• Reg 7 prescribes the Children’s e‑Safety Commissioner, appointed under section 50 of the Enhancing Online Safety for Children Act 2015 (Cth), as the relevant industry regulatory authority for the purposes of s 51S(2)(d) of the Crimes Act 1958. This is an explicit cross‑jurisdictional interaction. The Victorian statutory framework thereby nominates a Commonwealth regulatory office when the Crimes Act contemplates engagement with a relevant industry regulatory authority. The operational consequences and any power to share information, request regulatory assistance, or coordinate action will depend on the parent Act provisions and any applicable Commonwealth law or memoranda of understanding. The Regulations themselves do not alter Commonwealth statutory powers.

Revocation of a prior subordinate instrument

• Reg 4 revokes the Crimes (Child Pornography) Regulations 2015. The revocation is an internal Victorian legislative housekeeping step. Where the 2015 Regulations previously provided other prescriptions or administrative detail, those measures no longer apply. The endnotes identify that the revoked instrument was S.R. No. 137/2015.

Interpretation of Legislation Act 1984 effects

• The endnotes include detailed statements about how the Interpretation of Legislation Act 1984 affects the statutory rule. For example, headings, examples and punctuation are treated as part of the Statutory Rule (Endnote 1). Those interpretive rules may be relevant when construing the Regulations in litigation or administrative review.

Sunset under Subordinate Legislation Act 1994

• The Regulations will sunset ten years after the day of making, on 6 June 2027 (Endnote 1). This interacts with the Subordinate Legislation Act 1994 regime governing the lifecycle of subordinate instruments and the need for re‑enactment, replacement, or amendment if the prescriptions are to persist.

Operational interaction and administrative coordination

• The Regulations create roles that require administrative coordination across agencies and legislative instruments: Victoria Police must run training that confers authorised classifier status under the Crimes Act, and the Commonwealth Children’s e‑Safety Commissioner is the prescribed relevant industry regulatory authority for the Crimes Act subsection referenced. Any cross‑agency cooperation, data sharing or joint procedures must be based in the Crimes Act or separate interagency agreements; the Regulations simply identify the parties.

In short, these Regulations interact with other laws by importing meanings (Victoria Police Act 2013), by prescribing a Commonwealth regulator (Enhancing Online Safety for Children Act 2015 (Cth)), and by operating as subordinate instruments under the Crimes Act 1958. The Regulations are not freestanding; their legal force and practical impact depend entirely on the provisions and powers of the cited Acts.

The Regulations are short and the published version supplied contains a clear amendment history record in the endnotes. The factual amendment history, extracted from the instrument and endnotes, is as follows.

Original making and commencement

• The Crimes (Child Abuse Material) Regulations 2017, S.R. No. 39/2017, were made by the Governor in Council on 6 June 2017 under section 585AAA of the Crimes Act 1958, and they came into operation on 1 July 2017 (Endnote 1; reg 3).

Revocation of prior subordinate instrument

• The Regulations expressly revoke the earlier Crimes (Child Pornography) Regulations 2015 (reg 4). The endnotes reference S.R. No. 137/2015 in connection with that revoked instrument (Endnote 4).

Table of amendments and status as at version

• The Table of Amendments in the published version states that there are no amendments made to the Crimes (Child Abuse Material) Regulations 2017 by statutory rules, subordinate instruments or Acts (Endnote 2). That indicates that between the making date in June 2017 and the version date of 1 July 2017 no subsequent amending instruments had been made.

Amendments not in operation

• The endnotes confirm there are no amendments which were not in operation at the date of publication (Endnote 3). This means there were no dormant, future‑dated or otherwise suspended amendments on file at the version date.

Sunset and expiry

• The endnotes note that the Regulations will sunset 10 years after the day of making, on 6 June 2027, pursuant to section 5 of the Subordinate Legislation Act 1994 (Endnote 1). Unless replaced or re‑made, the Regulations will cease to have force on that date.

Interpretative amendments via the Interpretation of Legislation Act 1984

• The published instrument includes the standard interpretative material required by the Interpretation of Legislation Act 1984, and notes that style changes authorised under that Act apply (Endnote 1). Those are not amendments to the Regulations’ substance, but they affect how the Regulations are read and interpreted.

No recorded subsequent amending instruments

• The available version record shows zero subsequent statutory rules or Acts amending the Regulations. The text therefore stands as originally made in June 2017, subject only to the automatic sunset date.

Practical consequence of the amendment history

• Legal practitioners and agencies must be aware that the current prescriptions remain those enacted in 2017 and that unless the instrument is re‑enacted before 6 June 2027 the prescriptions will lapse. Any changes to the identity of authorised classifiers or the prescribed relevant industry regulatory authority require amendment via the legislative process enabled by the parent Act’s enabling provision, s 585AAA of the Crimes Act 1958.

This section is confined to the express amendment and lifecycle information supplied in the Regulations and the endnotes. There are no listed amending instruments, no suspended amendments, and a fixed sunsetting date recorded in the endnotes.

The Regulations as supplied include no report, reference or catalogue of litigation. The instrument and its endnotes do not name any judicial decisions, appeals, administrative review outcomes, or contested proceedings that interpret or challenge the Regulations. The document’s explicit statements about amendments and interpretation confirm an absence of recorded litigation within the text as published.

Concrete points from the source:

• No cases are named in the Regulations or the endnotes. The endnotes contain only administrative detail about making, commencement, revocation and the Interpretation of Legislation Act 1984 rules.

• The Table of Amendments and Amendments Not in Operation sections both state that there are no amendments made by statutory rules, subordinate instruments or Acts (Endnotes 2 and 3). They do not record any litigation outcomes or judicial amendments.

Practical implications for research and dispute resolution

• Because the Regulations do not themselves contain penalty provisions and operate as definitional instruments for the Crimes Act, any litigation that engages these Regulations is most likely to arise in the context of criminal proceedings, evidence challenges, or administrative disputes under the Crimes Act where the meaning of authorised classifier or the identity of the relevant industry regulatory authority is material. To locate such litigation one must therefore search case law that addresses the relevant sections of the Crimes Act that the Regulations reference, namely s 51A(1), s 51V(9) and s 51S(2)(d). The Regulations themselves do not list or summarise such cases.

• The absence of litigation history in the instrument means practitioners will need to consult court databases, tribunal records and other sources for any judicial treatment of the definitions created by these Regulations. The statutory text as published provides the starting point for any such research, but it contains no internal signposting to decisions.

• If litigation were to arise about whether a particular person qualifies as an authorised classifier, or whether the Children’s e‑Safety Commissioner qualifies for a particular interaction under s 51S(2)(d), the determining legal materials will be the Crimes Act provisions and the Victoria Police Act 2013 for Victoria Police membership, plus any procedural rules or agency documents that set out training standards and certification processes. The Regulations provide the definitional anchors; case law analysis would interpret how those anchors operate in disputes.

In summary, there is no litigation history recorded within these Regulations or their endnotes. Any adversarial or judicial interpretation of the Regulations will have to be sought outside the instrument, in case law applying the Crimes Act 1958 and the related statutes cited in regs 5-7.

Because the Regulations are short and technical, a number of practical pitfalls arise from their narrow drafting choices. These are not legal conclusions but points practitioners and agencies should note, based on the text.

Narrow scope of authorised classifier prescription

• The Regulations prescribe only Victoria Police members who have completed training conducted by Victoria Police (reg 6). That means non‑Police experts, contractors, consultants, academic experts and members of other law enforcement agencies are not prescribed as authorised classifiers by these Regulations. Parties relying on classification under the Crimes Act should verify that the person who performed the classification meets the reg 6 criteria. If the Crimes Act provision being relied on requires an authorised classifier as defined in s 51A(1), and the certification is from someone outside the class prescribed by reg 6, the certification may not meet the statutory definition.

Training content and sufficiency are unspecified

• Reg 6 requires that authorised classifiers have "undertaken training conducted by Victoria Police in the examination of random samples of seized material" and in certifying findings. The Regulations do not specify the curriculum, duration, assessment standards, re‑certification requirements or record‑keeping standards. Practitioners should not assume that completion of any generic training will be sufficient. Because the Regulations do not set objective criteria, disputes about whether a person has the requisite training will turn on Victoria Police records and internal policies.

Dependence on other statutes for meaning of terms

• Reg 5 imports the meaning of Victoria Police from the Victoria Police Act 2013. Any ambiguity about whether a particular person is a member for the purposes of being an authorised classifier requires consulting that Act. The Regulations do not define membership categories, ranks, or statuses. Similarly, reg 7 identifies the Children’s e‑Safety Commissioner by reference to the Commonwealth Act. Practitioners must cross‑check those other statutes to confirm office holders and appointment details.

Cross‑jurisdictional complexity

• Reg 7 prescribes a Commonwealth office as a relevant industry regulatory authority for a Victorian statutory purpose (s 51S(2)(d)). This creates an intergovernmental link that could raise practical issues about information sharing, regulatory cooperation, and differing statutory powers. The Regulations do not set out how Commonwealth and Victorian powers are to be coordinated. Parties should not presume automatic operational compatibility; any coordination will depend on the Crimes Act, Commonwealth law, and agency arrangements.

Sunset date and continuity risk

• The Regulations will sunset on 6 June 2027 under the Subordinate Legislation Act 1994 (Endnote 1). If the Regulations are not re‑made or replaced before that date, the definitional prescriptions will lapse. Stakeholders should be aware of the sunset clock and the need for legislative action to maintain continuity of the current prescription.

No penalties or enforcement details

• The Regulations do not provide penalties, enforcement mechanisms or procedural rules. If a practitioner seeks to rely on a prescribed status to obtain a particular legal outcome, the substantive legal effect will be governed by the Crimes Act. Do not assume that the Regulations themselves provide procedural comfort or an enforcement remedy.

Revocation of the 2015 Regulations

• Reg 4 revokes the Crimes (Child Pornography) Regulations 2015. If historical administrative practice or evidence was conducted under the 2015 instrument, parties should check for any transitional provisions or records relating to the changeover. The Regulations do not contain transitional provisions themselves; the endnotes merely record the revocation.

Interpretive technicalities under ILA

• The endnotes make clear that headings, punctuation and examples are part of the Statutory Rule per the Interpretation of Legislation Act 1984 and that legislative items are located at the foot of provisions in specified ways (Endnote 1). Small drafting features may thus have interpretive weight.

Practical litigational risk

• Because the Regulations tie authorised classifier status to Police‑conducted training, evidence certified by persons who lack a clear Police training record may be vulnerable to challenge in proceedings that depend on the authorised classifier concept in the Crimes Act. Parties should ensure that documentary proof of the training exists and is contemporaneous.

In short, the "gotchas" are procedural and evidentiary: narrow prescription of authorised classifiers, absence of objective training standards in the Regulations, cross‑reference dependence on other statutes, sunset timing, and lack of enforcement content. These are all set out or implied by the Regulations’ language (regs 5-7 and Endnote 1).

Compliance with these Regulations is largely a matter of aligning administrative practice with the narrow prescriptions set out in regs 5-7 and ensuring that interactions with the Crimes Act 1958 use the persons and bodies the Regulations nominate. The Regulations do not impose direct duties on private parties, but they affect the evidence, administrative arrangements and interagency contacts used in Crimes Act matters. Practical steps to comply, grounded in the Regulations themselves, are as follows.

For Victoria Police

• Establish, document and retain training programs: because reg 6 prescribes authorised classifier status only for Victoria Police members who "have undertaken training conducted by Victoria Police", Victoria Police should have a formal, documented training program covering the examination of random samples of seized material (the term tracked to s 51V(9) of the Crimes Act) and certification protocols for findings as to nature and content. The Regulations do not specify curriculum, but Police should design and maintain training records sufficient to demonstrate that particular members have completed the required training.

• Maintain a register or verified records of authorised classifiers: to enable prosecutors, courts and other agencies to determine whether a classifier meets the reg 6 criteria, Police should maintain an auditable roster or register showing which members have completed the qualifying training, with dates and certification details.

• Ensure internal policy aligns with the Crimes Act provisions: the Regulations operate for the purposes of the Crimes Act. Victoria Police should coordinate its training and certification practices with the procedural and evidentiary requirements of the Crimes Act provisions that reference an authorised classifier (noted in regs 6 and 7 as s 51A(1), s 51V(9), s 51S(2)(d)). That coordination may require legal review of the Crimes Act provisions to align Police documentation to statutory expectations.

For the Children’s e‑Safety Commissioner and Commonwealth agencies

• Prepare for cross‑jurisdictional engagement: reg 7 prescribes the Children’s e‑Safety Commissioner as the relevant industry regulatory authority for the purposes of s 51S(2)(d) of the Crimes Act 1958. The Commissioner’s office should be ready to receive enquiries, notifications or requests that arise from the Crimes Act context and should document any protocols for engagement with Victorian authorities.

• Keep appointment and title records accessible: because the Commissioner is identified by reference to s 50 of the Enhancing Online Safety for Children Act 2015 (Cth), the Commissioner’s appointment documentation should be readily available to demonstrate the office’s status in interactions with Victorian authorities.

For prosecutors, defence counsel and courts

• Verify certificate provenance against reg 6: when a case depends on classification or certification as an authorised classifier under the Crimes Act, practitioners must check that the person who provided the certificate is a Victoria Police member and that they have undertaken the Police‑conducted training. Request and rely on Police training records or other official confirmation. Reg 6 makes the training the qualifying criterion; absence of proof may expose the certification to challenge.

• Confirm the relevant industry authority for s 51S(2)(d) matters: where the Crimes Act contemplates engagement with a relevant industry regulatory authority under s 51S(2)(d), counsel and agencies should treat the Children’s e‑Safety Commissioner as the prescribed body per reg 7. That may affect service, notice, or consultation steps.

For private parties and industry participants

• Do not assume private experts are prescribed classifiers: organisations encountering requests or obligations under the Crimes Act should not assume that private sector or independent experts will be accepted as authorised classifiers. Reg 6 prescribes a closed class. If a matter requires an authorised classifier’s certification, coordinate with Victoria Police to obtain a Police‑issued certification.

• If interaction with a relevant industry regulator is required, direct contacts to the Commissioner: where a statutory process under the Crimes Act requires engagement with a relevant industry regulatory authority and s 51S(2)(d) applies, the prescribed body is the Commonwealth Children’s e‑Safety Commissioner (reg 7). Confirm the scope of the Commissioner’s role by reference to the Crimes Act provision at issue.

Administrative housekeeping

• Note the sunset: because the Regulations will sunset on 6 June 2027 (Endnote 1), agencies and practitioners should plan for continuity. If reliance on these specific prescriptions is ongoing, monitor whether the Regulations are re‑made or replaced before the sunset date.

• Cross‑refer to underpinning statutes: compliance requires awareness of the Crimes Act provisions that the Regulations support and the Victoria Police Act 2013 meaning imported by reg 5. Practitioners should read the Regulations in tandem with those statutes rather than relying on the Regulations alone.

Records and evidence strategy

• Keep contemporaneous certification records: because the Regulations’ principal operative effect is evidentiary , specifying who may certify the nature and content of seized samples , ensure that certification documents, training completion records and chain of custody documentation are robust and available for court scrutiny.

In practical terms compliance is administrative and documentary: ensure that classifications and regulatory contacts align with the named actors in regs 5-7, that Victoria Police has and evidences suitable training and records for authorised classifiers, and that any statutory engagements with a relevant industry regulator under the Crimes Act are routed to the Children’s e‑Safety Commissioner where s 51S(2)(d) applies. The Regulations themselves do not create procedural checklists beyond these definitional alignments, so effective compliance depends on coordination with the Crimes Act provisions and internal agency procedures.
