Crimes (Biological Weapons) Regulations 2019

The regulations use a small set of defined concepts to structure duties and powers. The defined terms in the instrument are:

• Act, meaning the Crimes (Biological Weapons) Act 1976 (s 6).
• Health Department, meaning the Department administered by the Minister administering the National Health Act 1953 (s 6).
• prohibited item, defined as “a substance or article in respect of which an offence referred to in section 10 of the Act has been, or is alleged to have been, committed” (s 6).

The central concept is “prohibited item”. Duties, prohibitions and permissions in Parts 2 (ss 7-9) attach to such items and to persons who acquire them on behalf of the Commonwealth, those responsible for storage of them, and persons charged under the Act in relation to them. The instrument does not expand the statutory definition of offences; instead it prescribes handling, labelling, disposal and analysis procedures for items already within the scope of the Act’s offences (s 4).

Another recurring concept is the Commonwealth Chief Medical Officer. The CMO is given procedural authority: to receive notifications (s 7(1)), to issue written storage directions (s 7(2)), to issue disposal directions (s 8(2)), to assess and permit nominees to analyse samples (s 9(2)), to specify time and place for analysis and to maintain control of samples while analysed (s 9(3)). The CMO’s functions and powers under the instrument may be delegated, in writing, to an SES employee or acting SES employee in the Health Department (s 10(1)); delegates must comply with written directions from the CMO (s 10(2)). The instrument references the Acts Interpretation Act 1901 provisions relating to delegations by way of note (s 10 note).

Procedural requirements are expressed in mandatory terms where the instrument intends to bind behaviour: “must” is used for notification (s 7(1)), compliance with storage directions (s 7(4)), labelling (s 7(5)), prohibition on disposal absent directions (s 8(1)), and the CMO’s obligations to permit and facilitate nominated analysis if satisfied (s 9(2)-(3)). The regulations are narrow in scope: they address storage, labelling, disposal and exposure to third‑party analysis of samples, rather than creating new substantive criminal offences or penalties within the text of the instrument itself.

The regulations create obligations and rights for a limited set of actors named or implied in the instrument. Primary affected parties are:

• Persons who acquire a prohibited item on behalf of the Commonwealth. Those persons must notify the Commonwealth Chief Medical Officer in writing as soon as practicable after acquisition (s 7(1)). The triggering phrase “on behalf of the Commonwealth” narrows the notification duty to acquisitions tied to Commonwealth activity; the instrument does not impose s 7(1) notification on private acquisitions in the text of the regulation.

• Persons responsible for the storage of a prohibited item. Once the CMO issues storage directions, the person responsible must comply (s 7(4)). The regulations do not prescribe who qualifies as “responsible for the storage”; the duty attaches to whoever occupies that role in practice, including Commonwealth employees, contractors or custodians.

• The Commonwealth Chief Medical Officer. The CMO is the decision‑maker for notifications, storage directions (s 7(2)), disposal directions (s 8(2)), and for permitting analysis by a nominee (s 9(2)-(3)). The CMO may delegate these functions to SES employees in the defined Health Department (s 10(1)).

• Persons charged with an offence referred to in s 10 of the Act in respect of a substance referred to in s 8(1)(a) of the Act. Those charged persons (the “offender” in s 9(1)) have a procedural right to nominate a person to analyse a sample and to request permission from the CMO (s 9(1)).

• Nominees proposed to analyse samples. A nominee must have training and experience such that the CMO is satisfied they are competent to analyse the sample; if so satisfied the CMO must permit analysis (s 9(2)-(3)). While permitted to conduct analysis, the nominee conducts the analysis subject to the CMO’s maintenance of control over the sample (s 9(3)(c)) and the specified time and place (s 9(3)(b)-(4)).

• SES employees or acting SES employees in the Health Department who may receive delegated functions. Delegates carry out CMO functions under written delegation and must comply with the CMO’s written directions when performing delegated functions (s 10(1)-(2)).

The regulations also affect organisational processes. Entities that manage Commonwealth acquisitions, storage facilities and evidence chains must establish notification, labelling, record‑keeping and storage controls to meet the written direction and labelling requirements (s 7(2)-(5)). Laboratories and analysts who may be nominated have an interest because the CMO assesses their competence and controls access and timing (s 9(2)-(4)). Finally, because disposal directions must be given having regard to public health and safety and to the effect on plants and animals (s 8(2)), bodies responsible for environmental and biosecurity outcomes are implicated in the content of disposal directions, even though the instrument does not prescribe consultation mechanisms.

The instrument sets out a concise set of mandatory duties and limited rights. Duties:

• Notification: If a person acquires a prohibited item on behalf of the Commonwealth, that person must notify the Commonwealth Chief Medical Officer, in writing, as soon as practicable (s 7(1)). The form and record of that written notification is not specified beyond being “in writing”.

• Compliance with storage directions: Once notified, the CMO must issue written storage directions as the CMO considers appropriate (s 7(2)). Those directions may specify place, temperature and humidity, and container type (s 7(3)(a)-(c)). A person responsible for storage must comply with any direction given (s 7(4)).

• Labelling: A person responsible for storage must ensure a label attached to the prohibited item or its container records: a description of the prohibited item when acquired on behalf of the Commonwealth; place, date and time of acquisition; the name of the person who acquired it; and particulars of any dealings with the item after acquisition (s 7(5)(a)-(d)). The label requirement extends to particulars of subsequent dealings, creating an ongoing record obligation.

• Prohibition on disposal without directions: A person must not dispose of a prohibited item except in accordance with any directions given under s 8(2) (s 8(1)). The CMO’s disposal directions must account for public health and safety and the effect of disposal on plants and animals (s 8(2)). The obligation is absolute in form: disposal is forbidden unless done pursuant to directions.

• Delegation compliance: Delegates exercising functions under s 10 must comply with any written directions of the CMO (s 10(2)). This imposes a duty on delegates to adhere to supervisory directions.

Rights and procedural entitlements:

• Right to nominate an analyst: An offender who has been charged with an offence referred to in s 10 of the Act in respect of a substance within the scope of s 8(1)(a) of the Act may nominate another person (nominee) to analyse a sample and request written permission from the CMO (s 9(1)(a)-(b)). The instrument thereby creates a procedural avenue for third‑party analysis on behalf of an accused.

• Mandatory permission if competence satisfied: If the CMO is satisfied that the nominee’s training and experience make them competent, the CMO must permit the nominee to analyse the sample, in writing (s 9(2)). The satisfaction test is expressed in the CMO’s subjective assessment of competence. There is no express time limit for the CMO to reach that satisfaction; the instrument requires only that the CMO act in accordance with s 9(2) where satisfied.

• Access and control during analysis: If permission is granted, the CMO must make a sample available, specify a reasonable time and place for analysis having regard to the sample’s nature and public health and safety, and must maintain control of the sample while it is analysed (s 9(3)-(4)). The regulations thus balance a defendant’s entitlement to independent analysis with the CMO’s control obligations related to public health and safety.

Express mandatory language,“must”,is used for the duties on persons and on the CMO in specific circumstances. The regulations do not, however, set out penalties for failure to comply within the instrument itself. Where the instrument refers to offences, it does so by reference to the Act (s 4, s 9), indicating that penalties for criminal behaviour remain a matter of the Act rather than the regulations. The practical effect is that the regulations supply procedures and administrative controls; they do not, on their face, create new criminal penalties.

The Regulations themselves do not specify criminal penalties or monetary fines for non‑compliance with the procedural obligations they impose. The instrument repeatedly uses mandatory language,“must”,to create duties (for example s 7(1), s 7(4), s 7(5), s 8(1)), but it does not contain express enforcement provisions or specify consequences for breach within the text.

Enforcement and legal consequences are therefore likely intended to be found in the parent statute rather than in the regulations. The instrument repeatedly references offences “referred to in section 10 of the Act” (see s 4, s 9(1)), and the purpose statement cites section 13 of the Act as the statutory hook for these regulations (s 4). That structure signals that substantive criminal liability is dealt with by the Act while these regulations prescribe procedures relevant to matters the Act covers. The instrument does not state that a failure to notify, label, store or refrain from unauthorised disposal automatically creates an offence under the instrument itself.

Administrative enforcement measures within the instrument are procedural: the Commonwealth Chief Medical Officer has the power to issue written directions on storage and disposal (ss 7(2), 8(2)), to permit or refuse a nominated analyst based on competence (s 9(2)), and to specify the time and place for analysis (s 9(3)-(4)). Those directions are binding on persons responsible for storage (s 7(4)) and on disposal (s 8(1) prohibits disposal absent directions). Where the CMO delegates functions under s 10, delegates must comply with the CMO’s written directions (s 10(2)). The instrument does not prescribe a specific administrative mechanism for enforcing compliance with the CMO’s directions (for example, inspection, seizure, licence revocation or administrative fines).

Because the instrument requires the CMO to “maintain control of the sample while the sample is analysed” (s 9(3)(c)), there is an administrative control designed to protect chain of custody and public health safeguards during permitted analysis. The disposal directions must be given having regard to “the requirements of public health and safety” and “the effect of the disposal on plants and animals” (s 8(2)), which signals the CMO may include conditions intended to mitigate public or environmental harm. The instrument does not specify monitoring or auditing powers to verify compliance with storage, labelling or disposal directions.

In short, the regulations impose mandatory duties and give the CMO discretionary power to set conditions and permit analysis, but they do not themselves articulate penalties or a standalone enforcement regime. Readers must treat the instrument as procedural rules that operate alongside the Act’s substantive provisions; any criminal penalties or specific enforcement measures are to be sought in the Act itself or in other statutes referenced by the Act.

The instrument explicitly situates itself as subordinate to and made under the Crimes (Biological Weapons) Act 1976 (s 3). The stated purpose in s 4 expressly ties the regulations to sections 10 and 13 of the Act, so the regulations are procedural complements to the Act’s substantive offences and the Act’s authorising power. References in the text to “an offence referred to in section 10 of the Act” and to “a substance referred to in paragraph 8(1)(a) of the Act” demonstrate that the regulations are not freestanding; their application presupposes the operation of the Act’s offence and charging frameworks.

The instrument also uses terms defined by reference to other statutes. “Health Department” is defined as the Department administered by the Minister administering the National Health Act 1953 (s 6). That definition places delegation options and the CMO’s administrative presence within the institutional framework of the Department that administers the National Health Act. The instrument does not purport to alter the Health Department’s statutory functions under the National Health Act; it simply identifies that Department for the purpose of delegations (s 10).

Delegation interactions are referenced in the instrument: the CMO may delegate functions in writing to an SES employee or acting SES employee in the Health Department (s 10(1)). The instrument includes a note pointing to sections 34AA to 34A of the Acts Interpretation Act 1901 as relating to delegations, applying because of subsection 13(1) of the Legislation Act 2003 (s 10 note). That legal note signals the standard interpretative framework for delegations under Commonwealth law applies to delegations made under these regulations.

Although the regulations require disposal directions to have regard to public health and safety and to effects on plants and animals (s 8(2)), the instrument does not name specific environmental, biosecurity or public health statutes with which disposal directions must be reconciled. Instead, it establishes a decision criterion for the CMO that will, in practice, necessitate consideration of other legal obligations and possibly consultation with relevant statutory bodies. The instrument creates procedural touchpoints where interaction with other laws and agencies is likely in implementation, but the instrument itself does not set out mandatory consultation or referral mechanisms to other statutory regimes.

Finally, the regulations create a mechanism for an accused person to obtain independent analysis subject to the CMO’s control (s 9). That procedure intersects with evidentiary and criminal procedure regimes in the Act or elsewhere; the instrument does not define evidentiary consequences, chain‑of‑custody rules beyond the CMO maintaining control while analysis occurs (s 9(3)(c)), nor does it prescribe how analysis results affect criminal proceedings. Thus, the instrument establishes procedural interfaces with other laws (the Act, departmental delegations, possible environmental and public health regimes), but leaves substantive cross‑statutory enforcement, evidentiary rules and penalties to the other instruments.

The Regulations, as presented in the instrument text, include a commencement table (s 2) and a Schedule effecting a repeal. The commencement table shows that the whole instrument commenced the day after registration, with an explicit date given: 30 March 2019 (s 2(1) and the Commencement information table entry). The text includes the standard note that the table relates only to the provisions as originally made and will not be amended in the instrument to reflect later amendments (s 2 note).

Schedule 1 contains a single repeal item: it repeals “The whole of the instrument” of the prior Crimes (Biological Weapons) Regulations (Schedule 1, item 1). That is a full repeal of the previous regulations, not a partial amendment, effected by the 2019 instrument. The instrument’s s 5 confirms that each instrument specified in a Schedule is amended or repealed as set out in the Schedule concerned, and any other item in a Schedule has effect according to its terms (s 5).

There are no other amendment entries, transitional provisions, savings clauses or modification clauses contained in the text provided. The instrument contains a general statement that any information in column 3 of the commencement table is not part of the instrument and may be edited in any published version (s 2(2)), which is an administrative publishing note rather than an amendment mechanism.

Therefore, as set out in this instrument, the relevant amendment history is limited: the 2019 Regulations commenced 30 March 2019 and, by Schedule 1, repealed the prior Crimes (Biological Weapons) Regulations in full. The instrument does not record subsequent amendments, variations, or repeals within its own text. Any later amendments would not appear in the original instrument text and are not recorded here.

The instrument text contains no references to judicial decisions, court challenges, or litigation. It does not cite cases, and there are no legislative notes indicating adjudication or judicial interpretation of its provisions. The instrument’s internal notes reference interpretative provisions for delegation in the Acts Interpretation Act 1901 (s 10 note), but that is a statutory interpretative cross‑reference and not a record of litigation.

Because the text provided is the instrument as made, without appended case law or adjudicative history, there is no litigation history contained within the instrument itself to report. Practitioners seeking litigation or judicial interpretation relevant to these regulations must therefore look outside the instrument to cases that may have applied or interpreted the parent Act or the prior regulations that were repealed; however, no such cases or judicial considerations are supplied within this instrument’s text.

In short, based solely on the instrument provided, there is no litigation history to summarise. The instrument establishes administrative procedures and duties but does not include references to judicial enforcement, challenges, or court rulings.

Working with this instrument presents a number of concrete practical pitfalls and points of uncertainty that derive from the text.

• Narrow trigger for notification: s 7(1) requires notification only when a person acquires a prohibited item on behalf of the Commonwealth. The obligation does not, in the text, extend to private acquisitions of prohibited items. Missing the “on behalf of the Commonwealth” qualifier can lead to incorrect application of the notification duty.

• Vagueness in timing: the notification duty in s 7(1) is qualified by “as soon as practicable”. That phrasing is inherently fact‑sensitive and does not supply a fixed timeframe. Practitioners should anticipate disputes about whether a particular delay was practicable and document reasons for any delay.

• Wide discretion of the Chief Medical Officer: the CMO must give “such directions … as the Officer considers appropriate in the circumstances” for storage (s 7(2)). The regulations list examples (place, temperature/humidity, container type) but give the decision maker broad discretion. That discretion extends to disposal directions (s 8(2)), which must be given having regard to public health and safety and effects on plants and animals. The instrument does not detail decision standards beyond those considerations.

• Mandatory compliance without specified sanctions: the instrument imposes “must” obligations but does not set out penalties or enforcement mechanisms. Where compliance is essential, the absence of explicit sanctions in the regulations can create uncertainty about immediate legal consequences for non‑compliance and may leave enforcement to the Act or other instruments.

• Ongoing labelling and record obligations: s 7(5)(d) requires labels to include “particulars of any dealings with the prohibited item after it was so acquired”, which implies continuing updates to labels or records. Practitioners must plan for ongoing record management rather than a one‑off label.

• Disposal dependency: s 8(1) prohibits disposal absent directions and s 8(2) requires the CMO to have regard to public health and plant and animal effects when giving disposal directions. This can create delays, logistical complexity and additional compliance costs where rapid disposal would otherwise be logistically simpler.

• Controlled third‑party analysis: s 9 permits a charged person to nominate an analyst, but the CMO must be satisfied of the nominee’s competence (s 9(2)) and retains control of the sample while it is analysed (s 9(3)(c)). The instrument therefore allows independent analysis in theory but limits actual control by the nominee or the accused. The CMO also sets time and place, constrained only by a “reasonable” standard having regard to the sample and public health and safety (s 9(3)-(4)).

• Delegation limited to SES employees in Health Department: s 10(1) permits delegation only to SES employees or acting SES employees in the Health Department. The absence of a power to delegate outside that pool narrows operational flexibility; where no suitable SES delegate is available, decisions fall to the CMO.

• Chain of custody and evidentiary risk: the CMO’s obligation to “maintain control of the sample while the sample is analysed” (s 9(3)(c)) is an administrative control that may affect evidentiary challenges. The instrument does not specify how control is documented or how analyses performed under CMO control will be treated in evidence, this remains a practical hazard for defence counsel and prosecutors.

• Repeal without transition: Schedule 1 repeals the whole of the prior instrument. The 2019 instrument contains no transitional provisions in the text provided. If practice, licences, or procedures established under the prior regulations required migration, that is not addressed here and may create implementation gaps.

• Data and privacy aspects of labelling: s 7(5)(c) requires the name of the person who acquired the prohibited item to be recorded on the label, and s 7(5)(d) requires particulars of dealings. These are personal data obligations that may engage internal privacy policies; the instrument does not address record retention or access rights.

Each of these “gotchas” arises directly from the wording of the instrument and its structure of duties, discretion and procedural safeguards. Practitioners should plan for documentation, chain‑of‑custody procedures, waiting for CMO directions, and ensuring nominees satisfy the CMO’s competence assessment.

The Regulations create a clear, if narrow, compliance checklist linked to the status of an item as a “prohibited item” and to the identity of the actor (acquirer on behalf of the Commonwealth; person responsible for storage; person charged with an offence). Practical compliance steps, tied to the statutory provisions, are as follows.

1. Determine applicability. Confirm whether the item is a “prohibited item” as defined,i.e. whether it is a substance or article in respect of which an offence referred to in s 10 of the Act has been, or is alleged to have been, committed (s 6). If the item falls outside that definition the Regulations do not apply.

2. If you acquire a prohibited item on behalf of the Commonwealth. Make a written notification to the Commonwealth Chief Medical Officer “as soon as practicable” after acquisition (s 7(1)). Keep a dated copy of the written notification and proof of transmission. Record the factual basis for timing if there is any delay beyond immediate notice.

3. Await and follow storage directions. After notification, expect written storage directions from the CMO (s 7(2)). These directions may address storage location, temperature and relative humidity, and container type (s 7(3)(a)-(c)). Implement the directions exactly and maintain evidence of compliance (environmental logs, access logs, container specifications). The person responsible for storage must comply (s 7(4)).

4. Prepare labelling and record systems. Attach a durable label to the prohibited item or its container that records: (a) description of the prohibited item as acquired; (b) place, date and time of acquisition; (c) the name of the person who acquired it; and (d) particulars of any dealings with the prohibited item after acquisition (s 7(5)(a)-(d)). Because particulars of dealings are required post‑acquisition, set up an ongoing transaction log and update the label or a linked record whenever dealings occur.

5. Do not dispose without written directions. Do not undertake disposal of a prohibited item unless and until disposal directions are provided in writing by the CMO under s 8(2). Disposal should be planned in coordination with the CMO, especially because directions must consider public health and safety and the effect on plants and animals (s 8(2)). Maintain documentation of any disposal directions given and evidence that disposal was carried out in conformity with those directions.

6. If charged and seeking independent analysis. If a person is charged with an offence referred to in s 10 of the Act in respect of a relevant substance, and wishes a nominated person to analyse a sample, the offender should nominate the person in writing and request the CMO’s permission under s 9(1)(a)-(b). Provide evidence of the nominee’s training and experience to satisfy the CMO’s competence inquiry (s 9(2)).

7. Coordinate with the CMO on analysis. If the CMO grants permission, expect the CMO to specify, in writing, a reasonable time and place for analysis taking into account the sample’s nature and public health and safety (s 9(3)(b), s 9(4)). Be prepared that the CMO will maintain control of the sample during analysis (s 9(3)(c)). Create a plan to document custody transfer, access, observation rights for the nominee, and results transmission in writing.

8. Prepare for delegations. Recognise that the CMO may delegate functions to an SES or acting SES employee in the Health Department (s 10(1)). Where dealing with a delegate, obtain and retain copies of any written directions from the CMO that the delegate is instructed to follow (s 10(2)). Ensure correspondence and directions are in writing to create an audit trail.

9. Record retention and privacy. Keep records of notifications, labels, storage environmental data, transactions with the prohibited item, disposal directions and actions, nomination applications and CMO responses, and any analyses performed. Because labels must include the name of the acquirer and particulars of dealings (s 7(5)(c)-(d)), align these records with applicable privacy practices and internal data retention policies.

10. Audit internal processes. Implement staff training and operational checklists to ensure timely written notifications, adherence to storage directions, maintenance and updating of labels, prohibition of unauthorised disposal, and correct procedure for nominating and coordinating independent analysis. Include a compliance step to confirm when a prohibited item ceases to be in scope (for example, disposal accepted by the CMO) and ensure labels/records are updated accordingly.

11. Document decision‑making and timing. Because “as soon as practicable” and “reasonable in the circumstances” are fact‑sensitive standards (ss 7(1) and 9(4)), document the factual basis for timing and any operational constraints. That documentation will be important if disputes arise about timeliness or the reasonableness of time and place for analysis.

12. Transitional awareness. Recognise that the 2019 Regulations repeal the prior instrument in full (Schedule 1). If operational guidance or processes originated under the repealed instrument, confirm whether those processes remain relevant and update them in accordance with the 2019 Regulations.

Following these steps will align handling of prohibited items with the obligations and rights set out in the Regulations. The core compliance tasks are prompt written communications with the CMO, strict adherence to written CMO directions, rigorous labelling and record‑keeping, and documented coordination when seeking or undertaking independent analysis.
