Crimes at Sea Act 2000

The Act’s operative vocabulary is concentrated in Schedule 1 and controls how criminal law reaches offshore areas. Core defined concepts are:

• Adjacent area and its partition. “Adjacent area” for each State is a geographically defined offshore area tied to schedules in the Commonwealth Offshore Petroleum and Greenhouse Gas Storage Act 2006 and the outer limits of the continental shelf (Sch 1 cl 14). The adjacent area is divided into an inner adjacent area (landward side of baseline up to 12 nautical miles from the baseline) and an outer adjacent area (the remainder of the adjacent area beyond 12 nautical miles) (Sch 1 cl 1(1) definitions; Sch 1 cl 2(1)-(2)). The Schedule also explains that the adjacent area does not include any area inside State or Territory limits and excludes the Joint Petroleum Development Area in certain jurisdictions (Sch 1 cl 14(5); cl 10).

• Baseline and territorial sea reference points. Baseline is defined with reference to the baseline of Australia’s territorial sea under the Seas and Submerged Lands Act 1973 (Sch 1 cl 13, cl 15). The Act includes an indicative map in Appendix 1 but expressly states the legislative provisions prevail over the map in case of inconsistency (Sch 1 cl 16).

• Substantive criminal law versus law of criminal investigation, procedure and evidence. “Substantive criminal law” covers offences, defences, confiscation, compensation and related matters (Sch 1 cl 1(1) definitions). The “law of criminal investigation, procedure and evidence” covers investigation, arrest, bail, laying charges, court procedures, sentencing, evidence and related matters (Sch 1 cl 1(1) definitions). The Schedule allocates substantive law application across inner and outer adjacent areas (Sch 1 cl 2) and allocates procedural law by reference to the actor or the forum (Sch 1 cl 3).

• Australian ship and foreign ship. “Australian ship” includes vessels registered in Australia, vessels operated or controlled from an Australian base but not registered elsewhere, and Defence Force ships (Sch 1 cl 1(1)). Any other ship is a “foreign ship.” This distinction feeds into the Commonwealth Attorney‑General consent regime for foreign‑flagged vessels (Sch 1 cl 7).

• Maritime offence and area of administrative responsibility. A maritime offence is an offence against a law that applies in the adjacent area for a State (Sch 1 cl 1(1)). “Area of administrative responsibility” for a State includes the State’s area, its inner adjacent area, and any other parts of the adjacent area where the State has responsibility under the intergovernmental agreement (Sch 1 cl 3(1)).

• Intergovernmental agreement as operative allocation instrument. The Schedule contemplates a written intergovernmental agreement between the Commonwealth Attorney‑General and participating State Ministers that specifies which parts of adjacent areas each government will administer and whether responsibility is concurrent (Sch 1 cl 5). The agreement must be published in the Gazette (s 6).

• Evidential presumption and procedural allocation. A court is to take as proved the allegation that an element of the offence occurred in the alleged adjacent area unless contrary proof is produced (Sch 1 cl 4). Procedureally, the law of the authority initiating an investigative act applies to that act; the law of the court in which a judicial proceeding commences applies to that proceeding (Sch 1 cl 3(2)(a)-(c)).

• Classification of offences for the scheme. The Act classifies offences by maximum penalty: up to two years summary; more than two but not more than five years misdemeanour; more than five years or indefinite term a crime (s 5).

• Limits and exclusions. The scheme does not purport to extend laws with inherent localising elements beyond their territorial logic (Sch 1 cl 2(3)(a)). The scheme also does not apply to laws excluded by regulation, and the Joint Petroleum Development Area is excluded (Sch 1 cl 9-10). The Acts Interpretation Act 1901 (Commonwealth) applies to the scheme (Sch 1 cl 11).

Understanding these concepts is essential because they determine (1) which substantive provision applies at sea, (2) which procedural rules govern investigatory acts and trials, and (3) which government has administrative responsibility. The text ties each outcome to an explicit clause: substantive law allocation (Sch 1 cl 2), procedural allocation (Sch 1 cl 3), intergovernmental agreement (Sch 1 cl 5), and exclusions (Sch 1 cl 9-10). Where the scheme intersects constitutional limits, the Schedule spells out that provisions that do not have effect within the State remain similarly limited in the outer adjacent area (Sch 1 cl 2(3)(b)).

The Act affects multiple, discrete groups and institutional actors, with different cost and decision‑making consequences.

• State governments and participating State Ministers. They must implement the cooperative scheme through State legislation (s 4) and negotiate and enter the intergovernmental agreement with the Commonwealth Attorney‑General (Sch 1 cl 5). A participating State Minister has a defined role under the intergovernmental agreement and can apply for a permanent stay in respect of charges brought contrary to the agreement (Sch 1 cl 6(2)). The State bears responsibility for applying its substantive criminal law in the inner adjacent area (Sch 1 cl 2(1)) and for policing and prosecutorial activity within the areas allocated to it under the intergovernmental agreement (Sch 1 cl 3(2)(b), Sch 1 cl 5).

• Commonwealth Attorney‑General and Commonwealth authorities. The Commonwealth Attorney‑General negotiates the intergovernmental agreement on the Commonwealth’s behalf (Sch 1 cl 5(1)), and is required to give written consent before certain prosecutions proceed where the accused is alleged to have offended on or from a foreign ship and the flag state has jurisdiction (Sch 1 cl 7(1)-(2)). Commonwealth agencies undertake investigations and prosecutions in the outer adjacent area or where responsibility is allocated to them (Sch 1 cl 2(2), Sch 1 cl 3(2)(a)).

• Police, prosecutors and courts. Operationally, police and prosecutors must apply the law of criminal investigation, procedure and evidence that corresponds to the authority conducting the act (Sch 1 cl 3(2)(a)-(b)). Courts must apply the procedural law of the jurisdiction in which the judicial proceeding is commenced where that is a State judicial proceeding, or Commonwealth law where it is a Commonwealth judicial proceeding (Sch 1 cl 3(2)(c)). The courts also have a statutory stay mechanism when charges are brought contrary to the intergovernmental agreement (Sch 1 cl 6(1)-(2)) and a duty to stay proceedings where the Commonwealth Attorney‑General refuses consent for foreign‑flag prosecutions (Sch 1 cl 7(4)).

• Ship operators and owners. Owners and operators of Australian ships and foreign ships are directly affected by the allocation of substantive law to adjacent areas and by the consent requirement for foreign‑flagged ships (Sch 1 cl 1(1) definitions; Sch 1 cl 7). Defence Force ships are treated as Australian ships (Sch 1 cl 1(1)).

• Individuals present in the adjacent areas. Persons alleged to have committed maritime offences in an adjacent area are subject to the State’s substantive law when in the inner adjacent area and to the State law applied by the Commonwealth in the outer adjacent area (Sch 1 cl 2). Procedural protections vary depending on whether a State or Commonwealth authority is conducting the investigation or whether the judicial proceeding is Commonwealth or State, as allocated in Sch 1 cl 3.

• Offshore industry participants. Operators in the offshore petroleum and greenhouse gas sectors must be aware that adjacent areas are defined using the scheduled areas in the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Sch 1 cl 14). However, the Joint Petroleum Development Area is excluded from the scheme (Sch 1 cl 10), which may affect enforcement and regulatory regimes in those waters.

Who pays or bears costs. The Act does not create a specific funding mechanism. Enforcement costs will be carried by the authority undertaking the work: State police and prosecutions for work in the inner adjacent area and, where responsibility is allocated to the Commonwealth, Commonwealth agencies for the outer adjacent area (Sch 1 cl 2, Sch 1 cl 5). Where the intergovernmental agreement allocates responsibility, it will be the practical determinant of which government bears ongoing operational costs. The Act requires publication of the intergovernmental agreement in the Gazette (s 6), signalling transparency but not funding arrangements.

Who decides. Key decisions include agreement on administrative responsibility (Commonwealth Attorney‑General and participating State Ministers, Sch 1 cl 5), prosecutorial decisions (State authorities, Commonwealth Attorney‑General for consent under Sch 1 cl 7), and courts’ discretionary decisions on stays where charges conflict with the intergovernmental agreement (Sch 1 cl 6(2)).

Behavioural effects. The Act creates incentives for intergovernmental coordination, sets a consent gate for foreign‑flag prosecutions, and shifts the procedural regime to the actor or the forum. It also alters evidential burdens by introducing a presumption about the place of an offence (Sch 1 cl 4), which changes how defendants and prosecutors must marshal evidence about location.

The Act imposes definable duties on governments, prosecutorial actors and procedural consequences that create rights for defendants and other actors.

Duties imposed on government and officials

• Give the cooperative scheme force of law where constitutionally permissible. The State must enact the scheme to the extent it lies within State legislative competence (s 4). This places an obligation on the State to implement Schedule 1 through State law.

• Negotiate and enter an intergovernmental agreement. The Commonwealth Attorney‑General and participating State Ministers may enter an intergovernmental agreement “providing for the division of responsibility” for maritime offences (Sch 1 cl 5(1)). If they do, the Minister must publish the intergovernmental agreement and any amendment in the Gazette (s 6).

• Apply substantive law as allocated. The State must apply its substantive criminal law in the inner adjacent area by force of State law (Sch 1 cl 2(1)). The Commonwealth gives effect to the State’s substantive law in the outer adjacent area by force of Commonwealth law (Sch 1 cl 2(2)).

• Make or accept certain regulatory instruments. The Governor can make regulations for the Act generally (s 7(1)) but not for the cooperative scheme (s 7(2)); the Schedule grants the Governor‑General power to make regulations for the scheme and requires agreement of a participating State Minister for regulations affecting the inner adjacent area (Sch 1 cl 12).

• Consent gate for prosecutions involving foreign‑registered ships. The Commonwealth Attorney‑General must give written consent before specified charges can proceed to hearing or committal where the ship is foreign‑registered and the flag state has jurisdiction (Sch 1 cl 7(1)-(2)). The Attorney‑General must take into account views expressed by the government of the flag state before granting consent (Sch 1 cl 7(2)).

Procedural duties for law enforcement and courts

• Apply procedural law according to actor or forum. Investigatory acts by Commonwealth authorities follow Commonwealth procedural law; investigatory acts by State authorities within their area of administrative responsibility follow State procedural law (Sch 1 cl 3(2)(a)-(b)). In judicial proceedings, the law of the Commonwealth applies in Commonwealth judicial proceedings; the law of the State applies in State judicial proceedings commenced in that State (Sch 1 cl 3(2)(c)). This requires police and prosecutors to follow the procedure appropriate to their authority and jurisdiction.

• Stay proceedings contrary to the intergovernmental agreement. If a charge is brought contrary to the intergovernmental agreement, the court must, on application by the Commonwealth Attorney‑General or a participating State Minister, permanently stay the proceedings (Sch 1 cl 6(2)). A refusal of the Commonwealth Attorney‑General to grant consent for a foreign‑flag prosecution likewise triggers a mandatory stay (Sch 1 cl 7(4)).

Rights created or preserved

• Evidential presumption about place of offence. In proceedings for a maritime offence, if an element of the offence is proved, an allegation that it occurred in an identified adjacent area is taken as proved unless disproved (Sch 1 cl 4). This shifts the evidential burden on the issue of location to the defendant to the extent a prima facie case is established.

• Protections from foreign‑state jurisdiction conflict. The consent requirement gives the Commonwealth Attorney‑General authority to prevent an Australian prosecution where the flag state has jurisdiction, while allowing arrest and preliminary steps to proceed pending the consent decision (Sch 1 cl 7(3)-(5)).

• Judicial non‑inquiry default. Unless an application is made under Sch 1 cl 6(2), a court will not be concerned to enquire into compliance with the intergovernmental agreement; that is, a defendant may not be able to rely on the agreement’s allocation as a freestanding jurisdictional defence without a successful stay application (Sch 1 cl 6(3)(b)).

• Jurisdiction retained by courts. A contravention of the intergovernmental agreement does not oust a court’s jurisdiction; jurisdiction remains even if proceedings are later stayed on the appropriate application (Sch 1 cl 6(3)(a)-(b)).

Operational duties and evidentiary rules

• Acceptance of Attorney‑General’s consent document. An apparently genuine document purporting to be written consent from the Commonwealth Attorney‑General is to be accepted as proof of consent in the absence of proof to the contrary (Sch 1 cl 7(5)). This is an evidentiary shortcut that reduces litigation over the existence of consent.

• Exclusions from administrative judicial review. The Administrative Decisions (Judicial Review) Act 1977 (Cwlth) does not apply to a decision taken under a State law that applies to investigatory acts and procedures by State authorities under Sch 1 cl 3(2)(b), narrowing merits review avenues for those decisions (Sch 1 cl 3(5)).

These duties and rights are allocated across actors and geographical zones and create concrete compliance and procedural consequences that must be followed by investigating agencies, prosecutors and courts. The Act itself does not create new criminal penalties; rather it provides the vehicle by which existing State criminal law reaches into adjacent areas and by which procedural regimes are selected and enforced.

The Act does not create a fresh penalty regime; it operates as a vehicle for the extension and application of substantive criminal laws and the pre‑existing penalty structures of the States into adjacent offshore areas. The enforcement regime is therefore hybrid and depends on the relevant substantive and procedural laws being applied under the cooperative scheme.

Penalties

• No novation of criminal penalties. The Act classifies offences for scheme purposes (s 5) but does not prescribe new sentences or fines itself. It relies on the substantive criminal law of a State, as in force, to supply the offence elements and penalties (Sch 1 cl 2(1)-(2)).

• Classification still matters. Classification by maximum penalty under s 5 matters for procedural and trial paths because many State procedural rules distinguish between summary and indictable offences. The Act provides a uniform classification metric for the purposes of the scheme to align procedural handling across jurisdictions and adjacent areas (s 5).

Enforcement mechanisms and who enforces

• Policing and prosecution by the authority with administrative responsibility. The law of criminal investigation, procedure and evidence of the Commonwealth applies to investigations, procedures and acts by Commonwealth authorities; State law applies to those acts by State authorities within their area of administrative responsibility (Sch 1 cl 3(2)(a)-(b)). The allocation of which authority takes responsibility for parts of adjacent areas is intended to be fixed by the intergovernmental agreement (Sch 1 cl 5).

• Arrest, preliminary steps and extradition unaffected by consent gate. Arrest of a suspected offender, laying of charges, proceedings for extradition, and remanding in custody or on bail may proceed even where Commonwealth Attorney‑General consent is required and has not yet been granted for prosecutions on foreign ships (Sch 1 cl 7(3)). That preserves operational enforcement capacity while reserving a judicial gate for formal proceedings.

• Mandatory stay where consent refused or agreement breached. If the Commonwealth Attorney‑General declines consent in a foreign-flag case, the court must permanently stay proceedings where those are the charges affected (Sch 1 cl 7(4)). Likewise, if charges are brought contrary to the intergovernmental agreement, the court must on application permanently stay proceedings (Sch 1 cl 6(2)).

• Evidential acceptance and presumptions. An apparently genuine consent document from the Commonwealth Attorney‑General will be accepted as proof of consent absent proof to the contrary (Sch 1 cl 7(5)). And the place-of-offence presumption in Sch 1 cl 4 relieves prosecutors of proving location in the absence of rebuttal, which can materially affect the ability to secure convictions where location is critical.

Limitations on review and constitutional constraints

• Exclusion of ADJR Act. The Administrative Decisions (Judicial Review) Act 1977 (Cwlth) does not apply to decisions under State law that apply to investigations, procedures and acts by State authorities in their area of administrative responsibility (Sch 1 cl 3(5)). This narrows avenues for Commonwealth judicial review of State investigative decisions taken under the scheme.

• Constitutional limits remain relevant. The Schedule expressly acknowledges that a provision of State law limited under s 109 of the Commonwealth Constitution within State area will be similarly limited in the outer adjacent area even if applied there under Commonwealth authority (Sch 1 cl 2(3)(b)). The Act gives as an example that a court could not convict by jury majority where that would be constitutionally impermissible (citing Cheatle v The Queen in Sch 1 cl 3(2) Example 1). That preserves constitutional safeguards and may constrain certain forms of procedural divergence.

• No new enforcement agencies established. The Act provides administrative allocation mechanisms rather than establishing new enforcement bodies. Operational enforcement is done by existing State and Commonwealth authorities as allocated by the intergovernmental agreement and the Schedule.

Practical enforcement consequences

• Potential for duplication or gaps. Because responsibility depends upon the intergovernmental agreement, failures in negotiating clear allocations may produce duplication of effort or gaps in enforcement. The Act provides the stay remedy for misallocations but not operational funding or resourcing arrangements.

• Evidence and proof paths simplified for some issues. The presumption about place (Sch 1 cl 4) and evidentiary acceptance of Attorney‑General consent (Sch 1 cl 7(5)) streamline certain factual and procedural proof points, reducing litigation cost and uncertainty in those narrow respects.

In short, the Act delegates penalties to the substantive State laws applied offshore and constructs an enforcement architecture that allocates investigatory and prosecutorial competence, sets evidentiary presumption rules, and provides stay mechanisms where jurisdictions or prosecutorial consent requirements are not complied with.

The Act is designed to be an integrating instrument that cross‑references and in several places depends on other Commonwealth and State statutes. The Schedule and body of the Act explicitly identify the most important interactions.

Key statutory interactions

• Off‑shore (Application of Laws) Act 1982 (WA). The Act amends this Act (s 9; Schedule 2). Schedule 2 inserts definitions (cooperative scheme, criminal laws) and revises sections 3 and 3A to expand the application of State criminal laws to adjacent areas (Sch 2 items 1-3). These amendments align the operation of the off‑shore application statute with the cooperative scheme.

• Crimes (Offences at Sea) Act 1979. That 1979 Act is repealed by s 8, but the repeal is saved for acts and omissions prior to the commencement day; the repealed Act continues to apply to pre‑commencement acts as if it had not been repealed (s 10(2)-(4)). The transitional provisions govern alleged offences spanning the commencement day.

• Acts Interpretation Act 1901 (Cwlth). The Schedule provides that the Acts Interpretation Act applies to the cooperative scheme “in the same way as to a Commonwealth Act” (Sch 1 cl 11). This affects how terms in the scheme are to be interpreted and how references to Commonwealth time, regulations and other interpretative machinery are handled.

• Judiciary Act 1903 (Cwlth). The Schedule notes that the Commonwealth law of criminal investigation, procedure and evidence includes State law on relevant subjects applied under the Judiciary Act 1903 (Sch 1 cl 1(2)). This bridges some procedural overlaps between Commonwealth and State courts when hearing maritime matters.

• Seas and Submerged Lands Act 1973 (Cwlth) and Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cwlth). These Acts are relevant to spatial definitions. The Schedule uses the baseline concept under the Seas and Submerged Lands Act 1973 and defines adjacent areas by reference to Schedule 1 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Sch 1 cl 13-15, cl 14). The practical boundary lines and scheduled offshore areas rely on those Commonwealth instruments.

• Petroleum (Timor Sea Treaty) Act 2003 (Cwlth). The Schedule borrows the definition of the Joint Petroleum Development Area from this Act and excludes the JPDA from the scheme where relevant (Sch 1 cl 1(1); cl 10).

• Administrative Decisions (Judicial Review) Act 1977 (Cwlth). The Schedule explicitly states that the ADJR Act does not apply to decisions taken under State law that applies to investigations and procedures by State authorities under Sch 1 cl 3(2)(b) (Sch 1 cl 3(5)). This narrows federal judicial review over those State decisions made in the course of applying State procedural law in the adjacent area.

Constitutional interactions

• Section 109 and other constitutional constraints. The Schedule recognises that if a State provision is inoperative within the State due to inconsistency with Commonwealth law it remains similarly limited in the outer adjacent area even if the State law is applied there by Commonwealth legislative competence (Sch 1 cl 2(3)(b)). The Schedule’s examples flag that constitutional constraints (including High Court authorities such as Cheatle v The Queen, referred to in Sch 1 cl 3(2) Example 1) limit the practical ability to apply some State procedural forms in proceedings that might otherwise be subject to Commonwealth constitutional constraints.

Regulatory interactions and delegation

• Regulations at two levels. The Act gives the State Governor power to make regulations necessary or convenient to give effect to the Act (s 7(1)), but s 7(2) prevents the State from making regulations for the cooperative scheme itself. Instead, the cooperative scheme contains its own regulation‑making power for the Commonwealth (Sch 1 cl 12), with the further constraint that regulations affecting the inner adjacent area require agreement of the relevant participating State Minister. This creates a split: State regulatory power is limited and scheme regulations are centralised under Commonwealth instrument-making power (Sch 1 cl 12; s 7(2)).

• Interaction with State criminal law. The scheme applies the State substantive law in both inner and outer adjacent areas (the latter by force of Commonwealth law), but expressly excludes substantive provisions “incapable of applying” in the adjacent area because of localising elements (Sch 1 cl 2(3)(a)). This preserves the internal logic of offences tied to specific land‑based facts or places.

Precedence and construction

• Scheme prevails over map and inconsistent laws. The Schedule provides that the body of the Act and the Schedule prevail over the indicative map in Appendix 1 if inconsistent (Sch 1 cl 16(2)). The Schedule also states that Sch 1 cl 3 operates to the exclusion of any Commonwealth or State law inconsistent with it (Sch 1 cl 3(3)) and that subsequent laws are to be construed subject to Sch 1 cl 3 unless they expressly override it (Sch 1 cl 3(4)).

Practical legal workstreams

• Cross‑reference checks required. Practitioners must cross‑check relevant State substantive provisions, State and Commonwealth procedural law, the intergovernmental agreement and spatial schedules of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 to identify which law applies in a particular fact pattern. Operationally, prosecuting or defending offshore matters will involve navigating the overlaps between State substantive offences and varied procedural rules allocated by Sch 1 cl 3.

In short, the Act is an overlay statute that sits in a dense web of Commonwealth and State legislation. It modifies the Off‑shore (Application of Laws) Act 1982, repeals an earlier Act, and depends on Commonwealth instruments to define spatial reach and to create regulations affecting the cooperative scheme, while embedding mechanisms to reconcile constitutional limits and jurisdictional boundaries.

The text includes a concise compilation table and notes of amendments that materially alter the Act since assent. Key milestones are:

• Original enactment and commencement. Crimes at Sea Act 2000 (Act No. 11 of 2000) received assent on 19 May 2000. Sections 1 and 2 (short title and commencement) were effective 19 May 2000; the remainder of the Act commenced on 31 March 2001 (see compilation table and s 2).

• Repeal and savings. The Act repealed the Crimes (Offences at Sea) Act 1979 by s 8. Section 10 provides transitional provisions: the repealed 1979 Act continues to apply to acts and omissions before the commencement day; amendments to the Off‑shore (Application of Laws) Act 1982 apply to acts and omissions on or after the commencement day (s 10(2)-(3)). Section 10(4) clarifies how to treat allegations spanning the commencement day in temporal terms.

• Petroleum and Energy Legislation Amendment Act 2010 (No. 42 of 2010). This later amending Act effected targeted changes to the Schedule and definitions. The compilation table records No. 42 of 2010, s 183, assented 28 October 2010, with commencement on 25 May 2011. The statute notes specify particular clauses amended: Sch 1 cl 1 was amended (No. 42 of 2010 s 183(2) and (3)), Sch 1 cl 14 was amended (No. 42 of 2010 s 183(5)-(9)), and Appendix 1 was amended (No. 42 of 2010 s 183(10)). These amendments likely reflect boundary, area or definitional updates tied to petroleum legislation reforms.

• Reprint. A reprint of the Act as at 11 November 2011 is recorded (Reprint 1), which incorporates the amendments listed above.

Notes on scope of amendments

• Schedule 2 amends the Off‑shore (Application of Laws) Act 1982 to insert the cooperative scheme definitions and adjust provisions applying State criminal laws to coastal waters and adjacent areas (Schedule 2 items 1-3). These changes took effect with the 2011 commencement of the No. 42 amendments.

• The Schedule’s internal notes indicate that some definitions were updated by No. 42 of 2010 (see the bracketed amendment notes following Sch 1 cl 1 and cl 14).

Transitional protections and temporal reach

• Section 10 is important for practitioners. It clarifies that the repealed 1979 Act continues to apply to acts and omissions before commencement day (s 10(2)), and that the amendments to the Off‑shore (Application of Laws) Act 1982 apply to acts and omissions on or after commencement day (s 10(3)). Section 10(4) resolves potential ambiguity when an alleged act spans dates before and after commencement, treating the act as occurring before the commencement day for the purposes of those transitional rules.

Amendment traceability

• The reprint and compilation table are the provided legislative history in the text. No other later amending Acts are recorded in the material supplied. All amendments referenced in the statutory text are cited to the relevant sections and to the compilation table.

For legal practice, the amendment history indicates that territorial or petroleum-related adjustments were made in 2010/2011, and that transitional rules were provided to preserve continuity of prosecutions and to avoid retroactive effect where the repealed Act previously governed conduct.

The source text supplies only one case reference and does not set out any decisions interpreting the Crimes at Sea Act 2000 itself. Therefore the litigation history available from the provided material is limited to the following:

• Cheatle v The Queen (1993) 177 CLR 541. The Act’s Schedule reproduces a cautionary example invoking Cheatle in Sch 1 cl 3(2) Example 1. The Example illustrates a constitutional constraint: a State court could not convict on the basis of a majority jury verdict if doing so would be contrary to the Commonwealth Constitution. The inclusion of the Cheatle example signals that the drafters anticipated constitutional limits on the procedures that could be applied in State courts to offences arising in the outer adjacent area, and that the scheme must accommodate High Court authorities on jury trial protections and other constitutional doctrines.

• No reported decisions applying the Act in the provided text. The Act’s Schedule contains procedural allocations and stay remedies (Sch 1 cl 6, cl 7), presumption rules (Sch 1 cl 4), and an exclusion of ADJR review (Sch 1 cl 3(5)), all of which create litigation vectors, but the supplied material does not report any cases litigating these provisions. The absence of reported decisions in the text means practitioners must look beyond this statute to court databases and legal reporting services to find any judicial interpretation or line of authorities applying the scheme.

Potential litigation focal points (derived from the text)

• Jurisdictional allocation disputes. Sch 1 cl 6 provides for permanent stays where charges are brought contrary to the intergovernmental agreement. That clause creates an avenue for litigation about whether a charge is contrary to the agreement, and whether a stay is appropriate. Sch 1 cl 6(3)(b) also limits courts’ inquiry into compliance with the agreement absent an application under Sch 1 cl 6(2), which could create disputes over justiciability and timing.

• Consent for foreign‑flag prosecutions. Sch 1 cl 7 requires Commonwealth Attorney‑General consent before proceedings may proceed to hearing or committal where the flag state has jurisdiction. Litigation could arise over the existence or validity of consent and the admissibility of an apparently genuine consent document (Sch 1 cl 7(5)). The text gives explicit effect to acceptance of such a document absent proof to the contrary, which itself could be litigated.

• Applicability of State procedural rules to proceedings in the outer adjacent area. Sch 1 cl 3(2)(c) allocates procedural law by reference to the actor and the forum, but acknowledges constitutional limits (Cheatle example). Litigation could arise where procedural characteristics of a State proceeding conflict with Commonwealth constitutional requirements.

Because the provided statute does not include a collection of reported litigation under this Act, practitioners must consult court records and legal reporting services for any authorities on interpretation, particularly regarding the intergovernmental agreement, consent mechanics, evidential presumptions and the interaction of State and Commonwealth procedural regimes. The Act itself, as reproduced, anticipates constitutional and intergovernmental frictions and sets out statutory mechanisms (stay, consent, evidence rules) that will likely be the subjects of litigation where disputes about jurisdiction and procedural competence arise.

The Act contains several technical features likely to surprise practitioners, agencies, prosecutors and offshore commercial actors if not carefully attended to. These are concrete legal mechanics rather than policy critiques.

1. Different procedural law depending on who acts and where the proceeding starts. Sch 1 cl 3(2) allocates procedural law by reference to who conducts the investigatory act (Commonwealth or State authority) and where the judicial proceeding is commenced (Commonwealth or State judicial proceeding). That produces complexity: the same factual incident can involve Commonwealth procedural law for some actions and State procedural law for others, depending on which authority acts or where proceedings are commenced. Practitioners must map the actor, the act, and the forum before assuming a single procedural regime applies.

2. Presumption about place of offence shifts evidential burden. Sch 1 cl 4 provides that if an element of an offence is proved then an allegation that it occurred in the adjacent area is taken as proved unless the contrary is shown. This eases the prosecution’s proof burden on location but requires defendants to produce contrary evidence to displace the presumption. Location often determines jurisdiction; therefore Sch 1 cl 4 materially affects pre-trial strategy. The presumption is rebuttable, not conclusive, but its practical effect can be to force earlier disclosure or more aggressive evidential work by defendants.

3. Consent gate for foreign‑flag prosecutions with operational continuity. Sch 1 cl 7 requires Commonwealth Attorney‑General consent before a charge involving a foreign‑flagged ship that the flag state could prosecute may proceed to hearing or committal. However, arrest and preliminary steps may proceed without consent (Sch 1 cl 7(3)). That combination allows immediate operational response but risks later procedural waste if consent is refused and a permanent stay follows (Sch 1 cl 7(4)). Prosecutors and operational commanders must therefore weigh the risk of investing resources before consent is obtained, noting the statutory acceptance of apparently genuine consent documents (Sch 1 cl 7(5)).

4. Court not ordinarily obliged to inquire into intergovernmental agreement compliance. Sch 1 cl 6(3)(b) says that if a charge is brought in a court the court will not, except on an application under Sch 1 cl 6(2), be concerned to enquire whether the intergovernmental agreement has been complied with. That constrains defensive strategies that seek to argue jurisdictional misallocation as a passive matter; active procedural steps to seek a stay under Sch 1 cl 6(2) are required.

5. ADJR Act excluded for State investigatory decisions. Sch 1 cl 3(5) excludes the Administrative Decisions (Judicial Review) Act 1977 (Cwlth) from applying to State decisions under the scheme. This narrows avenues for Commonwealth judicial review of State investigatory acts, which may lead to reliance on State judicial review remedies or other constitutional challenges.

6. State regulations are expressly limited. Section 7(2) says the Governor may not make regulations “for the purposes of the cooperative scheme”, while Sch 1 cl 12 gives the Governor‑General regulation powers for the scheme, and requires participating State Minister agreement for regulations affecting inner adjacent areas. Practically this means regulatory competence for the cooperative scheme is centralised at Commonwealth level with a State agreement constraint for inner areas. State drafters must not attempt to fill scheme regulatory gaps via State regulation‑making power.

7. Offences with inherent localising elements cannot be extended. Sch 1 cl 2(3)(a) preserves the internal logic of certain offences (for example, local road traffic offences) by excluding those that are inherently place‑specific from being applied in adjacent areas. Do not assume every State offence is extendable offshore.

8. Joint Petroleum Development Area exclusion. The JPDA is excluded from the scheme (Sch 1 cl 10). Offshore operators and prosecuting authorities must map whether operations are within the JPDA, because a different legal regime will apply there.

9. Transitional timing rules. Section 10 contains transitional rules preserving the application of the repealed Crimes (Offences at Sea) Act 1979 for acts before commencement day and treating alleged acts spanning the commencement day as having occurred before it for the purposes of the saving provision in some circumstances. Practitioners must consider temporal particulars when evaluating charges straddling the commencement date.

10. Evidentiary shortcut for consent documents. Sch 1 cl 7(5) creates an evidentiary rule accepting as proof, absent contrary evidence, an apparently genuine document purporting to be the Commonwealth Attorney‑General’s written consent. That shifts practical litigation dynamics and incentivises care in document custody and in establishing genuineness when consent is contested.

11. Constitutional constraints remain controlling. The Schedule explicitly states that the scheme does not override constitutional limits that already apply to State laws within their area (Sch 1 cl 2(3)(b)). Examples include restrictions on jury verdicts and other procedures that have been shaped by High Court authority. The scheme cannot be used to circumvent those limits.

Failure to appreciate any of these items will create operational, evidential or jurisdictional risk. The Act creates a patchwork where the operative law can vary depending on factual micro‑details: the actor, the forum, the ship’s flag, the exact location in the adjacent area and whether a prior intergovernmental agreement governs that specific location.

Compliance requires coordinated action across legal, operational and administrative fronts. The compliance tasks differ for governments, operational law enforcement agencies, prosecutors, courts and private‑sector offshore actors. Below is a practical checklist organised by actor, grounded in the statutory text.

For State governments and participating State Ministers

• Enact or declare the cooperative scheme as appropriate to ensure “force of law” where constitutionally possible (s 4). Ensure State legislation is consistent with Schedule 1 operational definitions.

• Negotiate and finalise the intergovernmental agreement with the Commonwealth Attorney‑General, specifying allocations of exclusive or concurrent responsibility across parts of the adjacent area (Sch 1 cl 5(1)-(2)). Detail administrative responsibilities, resourcing, information‑sharing and dispute resolution mechanisms.

• Publish the intergovernmental agreement and any amendments in the Gazette as required (s 6). Maintain public and interagency access to the agreement to reduce litigation risk under Sch 1 cl 6.

• Coordinate with the Commonwealth on any regulation‑making for the scheme (Sch 1 cl 12). Do not attempt to make State regulations for the cooperative scheme (s 7(2)).

For Commonwealth Attorney‑General and Commonwealth agencies

• Implement procedures for assessing, recording and communicating written consent under Sch 1 cl 7(1)-(5) for prosecutions involving foreign‑flagged ships where the flag state has jurisdiction. Document how the views of the flag state will be taken into account (Sch 1 cl 7(2)).

• Coordinate with participating State Ministers to finalise the intergovernmental agreement and to resolve any concurrent responsibility allocations (Sch 1 cl 5).

• Maintain records of decisions to grant or refuse consent that will stand up to evidentiary scrutiny if challenged; note the statutory rule accepting apparently genuine consent documents as proof absent contrary proof (Sch 1 cl 7(5)).

For police and prosecutorial authorities

• Before undertaking an investigative act, identify whether the authority is a Commonwealth or State body and ensure the procedures applied comply with the law of criminal investigation, procedure and evidence appropriate to that authority as set out in Sch 1 cl 3(2)(a)-(b).

• For prosecutions, determine whether the judicial proceeding is a Commonwealth or State judicial proceeding and ensure procedural compliance with the law applicable to that forum (Sch 1 cl 3(2)(c)).

• Where an alleged offence involves a foreign‑flagged ship and the flag state has jurisdiction, seek Commonwealth Attorney‑General consent before progressing to hearing or committal (Sch 1 cl 7(1)). Note that arrest and ancillary steps can proceed without consent (Sch 1 cl 7(3)) but weigh the operational risk of proceeding before consent is granted because refusal mandates a permanent stay (Sch 1 cl 7(4)).

• Use the presumption about place (Sch 1 cl 4) to structure charges and evidentiary notices, while preparing to meet potential defence rebuttals about location. Early evidence on geolocation, logs, AIS data and witness accounts should be gathered to pre‑empt rebuttal.

For courts and judicial officers

• On commencement of a proceeding, confirm whether it is a State or Commonwealth judicial proceeding and apply the corresponding procedural law (Sch 1 cl 3(2)(c)). Be alert to constitutional constraints that may limit the permissible procedural forms even if the scheme would otherwise allow them (Sch 1 cl 2(3)(b); Sch 1 cl 3(2) Example 1 citing Cheatle).

• If an application is made under Sch 1 cl 6(2) asserting the charge was brought contrary to the intergovernmental agreement, address the statutory mandatory stay requirement and the evidentiary record required for the application.

For defence practitioners

• Challenge the location presumption only with specific and admissible evidence: the presumption in Sch 1 cl 4 is rebuttable. Investigate and preserve evidence relevant to location immediately (ship logs, satellite/AIS data, witness testimony).

• In foreign‑flagged ship cases, scrutinise the existence and authenticity of any document purporting to be Commonwealth Attorney‑General consent (Sch 1 cl 7(5)), although recognise the statutory evidential weight given to such documents absent contrary proof.

• Consider jurisdictional and procedural advice early when an intergovernmental agreement allocation may affect which authority should have prosecuted. If proceedings appear contrary to the agreement, consider application for stay under Sch 1 cl 6(2) as the mechanism for challenge; passive objections will be insufficient (Sch 1 cl 6(3)(b)).

For offshore industry and ship operators

• Map operations relative to the adjacent area definitions and confirm whether activity sits in inner or outer adjacent areas for compliance planning (Sch 1 cl 14-15). Check whether operations are in the Joint Petroleum Development Area (Sch 1 cl 10), which is excluded.

• For foreign‑registered ships, be aware that the flag state might have jurisdiction and that a Commonwealth consent requirement exists for prosecutions that could implicate that jurisdiction (Sch 1 cl 7). If approached by investigators, preserve records and seek legal advice promptly.

General administrative and compliance tasks

• Maintain a definitive map and record of which parts of adjacent areas are allocated to which authority under the intergovernmental agreement; publish that map and allocation where appropriate (Sch 1 cl 16 and Sch 1 cl 5). Be mindful that Appendix 1 is indicative and the legislative text prevails (Sch 1 cl 16(2)).

• Train investigators and prosecutors on the split governance model so that procedural errors (e.g. using the wrong procedure for a given act) are avoided. Given the ADJR exclusion (Sch 1 cl 3(5)), procedural missteps may be more difficult to remediate by Commonwealth judicial review.

• Implement robust information‑sharing and handover protocols where responsibility is concurrent or changes between State and Commonwealth agencies, to prevent loss of evidence and to ensure continuity of prosecution.

• Reconcile State substantive law with constitutional limits before charging. The Schedule cautions that provisions of State law limited by constitutional inconsistency within the State will be similarly limited in the outer adjacent area (Sch 1 cl 2(3)(b)).

In practical terms, compliance is a multi‑disciplinary task: legal teams must be engaged at the outset of operational decisions; intergovernmental allocations must be clear and published; evidentiary and document retention practices must be tightened; and operational actors must understand the limited but significant role of the Commonwealth Attorney‑General in foreign‑flag matters. The Act provides the framework; successful compliance depends on institutional clarity, early legal input and precise operational protocols.
