#### 160 Drug test sample whether or not drug use suspected 160 Drug test sample whether or not drug use suspected > > (1) A correctional officer holding office or acting in a rank that is of or above the rank of Chief Correctional Officer may require an inmate to supply a drug test sample for testing or analysis and give directions as to how the sample is to be supplied. > > > (2) The directions may require the inmate to comply with directions given by a correctional officer as to how the sample is to be supplied. > > > (3) An inmate must not refuse or fail to comply with a direction under this clause. > > > > Note. > > > > Failure by an inmate to comply with this subclause is a correctional centre offence. > > > (4) An analysis of the sample must be carried out by an analyst. > > > (5) A sample may be required under this clause and tested or analysed for the presence of a drug even though the inmate concerned may not be reasonably suspected of having administered a drug to himself or herself or of being under the influence of a drug.
