#### 154 Matters to be considered concerning certain serious offenders 154 Matters to be considered concerning certain serious offenders > > (1) This section applies to a serious offender whose sentence for life is the subject of a determination under Schedule 1 to the [Crimes (Sentencing Procedure) Act 1999](/view/html/inforce/current/act-1999-092). > > > (2) The Parole Authority, in exercising its functions under this Part in relation to a serious offender to whom this section applies— > > > > > (a) must have regard to and give substantial weight to any relevant recommendations, observations and comments made by the sentencing court, and > > > > > (b) must give consideration to adopting or giving effect to any such recommendations, observations and comments and to the intention of the sentencing court when making them, and > > > > > (c) to the extent that it declines to adopt or give effect to any such recommendations, observations and comments, must state its reasons for doing so, > > > > and must, in particular, have regard to the need to preserve the safety of the community.
