68 Sexual intercourse—people not to be presumed incapable by reason of age (1) For this part, a person shall not, by reason only of his or her age, be presumed to be incapable of engaging in sexual intercourse with (2) Subsection (1) shall not be construed so as to affect the operation of any law relating to the age when a child can be found guilty of an (3) This section applies whether the offence or alleged offence was committed before or after the commencement of this section.
