333 Indictable offences heard and determined summarily
Proceedings to which this division applies with respect to an
indictable offence shall be heard and determined summarily if—
(a) the Magistrates Court is satisfied that the accused is unable,
because of mental impairment, to elect to have the case heard
(b) the prosecution agrees to the offence being heard and
determined summarily.
