252C Police action after arresting child under the age of
criminal responsibility
(1) If a police officer arrests a child under the age of criminal
responsibility (whether under a warrant or under section 252B), the
police officer must—
(a) do the minimum necessary to prevent or stop the conduct for
which the warrant was issued or the arrest was made; and
(b) take the child to—
(i) a parent of the child; or
(ii) someone else who has daily care responsibility, or
long-term care responsibility, for the child; or
(iii) if it is not practicable or appropriate to take the child to
someone mentioned in subparagraph (i) or (ii)—another
appropriate person or agency.
(2) Before deciding whether another person or agency is appropriate, the
police officer must consult with the director-general responsible for
the Children and Young People Act 2008.
