### 35 Obstruction of Public Trustee > > (1)  *\[Section 35 Subsection (1) amended by No. 20 of 1995, s. 5 and Sched. 3 \]*In this section ***Public Trustee*** includes the officers, servants and agents of the Public Trustee. > > > (2)  A person must not, without reasonable excuse, obstruct or hinder the Public Trustee in – > > > > > > (a) the exercise of the Public Trustee's powers under this Act; or > > > > > > > (b) the performance of the Public Trustee's duties in relation to property that the Public Trustee has taken custody and control of under a restraining order. > > > > Penalty:   – > > > > > > (a) in the case of a body corporate – a fine not exceeding 100 penalty units; or > > > > > > > (b) in any other case – a fine not exceeding 20 penalty units or imprisonment for a term not exceeding 2 years, or both.
