> > (1) A person may apply to the Supreme Court for an order to be made under [subsection (2)](#GS164@Gs2@EN) that restrained property, or forfeited property, be destroyed, if the person –
> >
> > > > (a) has responsibility for the control or management of the restrained property; or
> > >
> > > > (b) has responsibility for the control or management of the forfeited property for and on behalf of the State.

> > (2) On hearing an application under [subsection (1)](#GS164@Gs1@EN) , the Supreme Court may order that the property be destroyed if satisfied that it would not be in the public interest to preserve the property.
