Cremation Regulations 1954

Definitions and administrative hierarchy. The Regulations define a key person for permission processes, the “nearest surviving relative” in r 3 with an ordered, prioritised list that places a person living as spouse or de facto partner and aged 18 or over first, then the spouse, then adult children, parents, and adult siblings. That definition is used in application forms (Form 6) and determines who may make applications and who must be informed. The Regulations also repeatedly rely on the terms and powers of the Cremation Act 1929 and cross‑refer to other statutes and regulations for substitution or enforcement.

Licensing and validation. Licensing to use and conduct a crematorium is a two‑step administrative process in many cases. The Governor grants licences in the prescribed forms (Form 2 or Form 3, r 5), but where section 4(3) of the Act requires a certificate by the Chief Health Officer before the licence takes full effect, the licensee must apply for that certificate in Form 4 and pay the nominal fee in Schedule 2 item 2; the Chief Health Officer carries out an inspection and issues the certificate in Form 5 if satisfied (r 6-7). If the Chief Health Officer is not satisfied following inspection, the fee is refunded (r 6(3)).

Maintenance, inspection and remedial powers. Licensees must maintain crematoria, fittings and apparatus in good repair and in a clean and sanitary condition and staff them with sufficient attendants to meet those obligations (r 8). The Chief Health Officer, authorised persons and Inspectors of Police may inspect at any time; authorised inspectors must report breaches to the Chief Health Officer and the Chief Health Officer may issue written notices specifying works and timeframes that the licensee must comply with (r 9-10).

Permit to cremate and safety gating. Individuals seeking a permit to cremate must file Form 6 and pay the permit fee in Schedule 2 item 3. The application must be accompanied by a certificate in the forms prescribed: a medical practitioner’s certificate in Form 7, a Coroner’s certificate in Form 8, or the Coroners Regulations 1997 Form 4 (r 11-12). Form 7 collects clinical history, cause of death, information indicating whether the death involved violence, poison or other suspicious circumstances, whether a pacemaker or radio‑isotope therapy was used and whether the cremation would be safe; it therefore operationalises safety gating for cremation operations. For example Form 7 asks if the deceased had a cardiac pacemaker and whether it has been removed; it lists radioactive treatments and time limits relevant to cremation safety. Form 9 (the permit) includes the requirement that the permit is not valid until 24 hours have elapsed since death.

Medical referee role and procedural safeguards. Medical referees must be medical practitioners with at least five years’ practice (r 13). Regulation 14 imposes a range of conditions: they must ensure compliance with the Act (including sections 8, 8A and 8B) before permitting cremation (r 14(1)); make themselves reasonably available during specified hours and be entitled to a higher fee for urgent out‑of‑hours work (r 14(2)); forward permit copies to the Chief Health Officer (r 14(3)); notify applicants of their right to apply to the State Administrative Tribunal if a permit is refused and notify the Chief Health Officer of refusals and reasons (r 14(4)); use Form 9 for permits (r 14(5)); accept overseas substitute documents in certain circumstances (r 14(6)); preserve and annually transfer older documents to the Chief Health Officer (r 14(7)); and notify the Chief Health Officer if absent for more than 24 hours (r 14(8)).

Religious and other exceptions for cremation elsewhere. Part V allows cremation outside a crematorium for religious reasons in a limited way. Regulation 15 permits a medical referee to consent to cremation elsewhere for a deceased person described in the text as “of Asiatic race who belonged to a religious denomination, the tenets of which require the burning of the body elsewhere than in a crematorium” provided the place and arrangements are approved by the Chief Health Officer, subject to conditions the Chief Health Officer may impose. Regulation 16 adds that when such a cremation is in a cemetery the responsible person must comply with directions from the cemetery authority. Regulation 17 prohibits cremation elsewhere than at a crematorium except under the Part V permission or where the Chief Health Officer issues a direction under the Health (Miscellaneous Provisions) Act 1911 or the Public Health Act 2016.

Recordkeeping and notification. Licensees must keep the register of cremations in Form 11 with immediate entries (r 18), allow public inspection on payment of 10 cents (r 19), and notify the Chief Health Officer and the Registrar General within 24 hours after a cremation using Form 12 (r 20). Medical referees have obligations to preserve documents and transfer older records to the Chief Health Officer annually (r 14(7)). There is a Form 13 for certificates following a post mortem (r 20A).

Fees. Schedule 2 prescribes a nominal fee for a licence ($15.00, item 1), a small fee for the Chief Health Officer certificate validating the licence ($5.00, item 2), and higher fees for permits to cremate depending on timing: $85.80 for business hours and Saturday morning (item 3(a)), and $140.80 for out‑of‑hours permits (item 3(b)). The schedule records ongoing amendment activity (see compilation table).

Interconnection with other statutory processes. Multiple forms and regulations link to coronial and statutory declaration processes: coronial certificates and Coroners Regulations forms may substitute for medical certificates (r 12(b)-(c), Form 8); statutory declarations are required in some applications and are governed by the Oaths, Affidavits and Statutory Declarations Act 2005 (Form 6 statutory declaration). The regulations therefore integrate cremation authorisation with coronial, public‑health and evidentiary frameworks.

These main concepts show the Regulations operate as a ruleset governing public health oversight, safety gating, administrative authorisation and recordkeeping of crematoria and cremations, using templates and modest fees to standardise practice across the State.

The Regulations create obligations for a defined set of actors and affect particular private and public interests.

Primary affected parties

• Licensees of crematoria. The Regulations are primarily addressed to trustees and controlling authorities of cemeteries and incorporated associations that hold licences to use and conduct crematoria (Form 1, r 4). Licensees must apply for licences in the prescribed form and pay the Schedule 2 fee, obtain Chief Health Officer certification where required, maintain premises, allow inspections, keep the register (Form 11), and give notice of each cremation to the Chief Health Officer and Registrar General within 24 hours (r 4-7, 8-10, 18-20).
• Medical referees. These are practitioners appointed under section 8 of the Cremation Act 1929 and must meet the experience requirement of at least five years’ practice (r 13). They decide on individual permits to cremate, must ensure documents comply with the Act and sections 8, 8A and 8B (r 14(1)), preserve records and notify the Chief Health Officer of permits or refusals (r 14(3)-(4), (7)). They face procedural duties that constrain timing and documentation requirements and are entitled to different prescribed fees for out‑of‑hours work (r 14(2); Schedule 2 item 3).
• Chief Health Officer. The Chief Health Officer has central administrative, certification and enforcement responsibilities. They review licence applications before forwarding them to the Governor (r 4(2)), inspect facilities to validate licences (r 6), issue certificates validating licences (r 7), conduct inspections or authorise persons to inspect crematoria and registers (r 9), receive reports of breaches, and issue notices requiring remedial works with timeframes (r 10). The Chief Health Officer also approves places and arrangements for religious cremation outside crematoria and may issue directions under broader public health Acts allowing cremation elsewhere (r 15, r 17).
• Coroner and coronial system. Where the Coroner has formed an opinion, a Coroner’s certificate (Form 8) or the Coroners Regulations 1997 Form 4 can substitute for a medical practitioner’s certificate when applying for a permit to cremate (r 12(b)-(c)). The Coroner therefore participates in cases where investigations or inquests have occurred.
• Registrar General. The Registrar General is a recipient of timely notices of cremation (r 20). That ties cremation events into vital records systems.

Other affected parties

• Nearest surviving relatives and applicants. The Regulations define who qualifies as the “nearest surviving relative” (r 3) and the application Form 6 is to be completed by the person entitled to apply (or in some circumstances an administrator with a statutory declaration explaining their status). The order of priority and age thresholds can directly affect who may lawfully authorise a cremation.
• Medical practitioners who attend the deceased. Practitioners completing Form 7 must provide clinical history, cause of death, information about suspicious circumstances and safety matters such as pacemakers and radioactive treatments. They carry the obligation to certify correctness (Form 7 signature block) and the associated professional responsibility to provide accurate, timely information.
• Police and authorised inspectors. Inspectors of Police have explicit inspection rights over crematoria and registers (r 9(1)) and must report breaches to the Chief Health Officer (r 9(2)). Persons authorised in writing by the Chief Health Officer may inspect and must report breaches (r 9).
• Cemetery authorities. If cremation elsewhere is permitted in a cemetery, the person responsible must comply with directions from the cemetery authority (r 16). Cemetery authorities thereby retain a role in directing the conduct of non‑crematorium cremations on their land.
• The general public seeking inspection of registers. The register of cremations must be open for inspection during ordinary business hours on payment of 10 cents (r 19). This creates a public access right to certain cremation records.

Economic and administrative effects on these parties

• Financially, applicants pay the Schedule 2 fees: licence $15.00, Chief Health Officer validation certificate $5.00, permits $85.80 or $140.80 depending on timing (Schedule 2). Medical referees may be entitled to higher prescribed fees for out‑of‑hours work (r 14(2); Schedule 2 item 3(b)). The Regulations thus impose explicit transaction costs that apply to both institutional licence‑holders and individual applicants seeking permits.
• Time and compliance burden falls on licensees and medical referees who must preserve documents, yield to inspections, respond to remedial notices, and meet procedural timeframes; applicants must obtain supporting medical or coronial certificates and complete specified forms and statutory declarations where relevant.
• Administrative authority is concentrated with the Chief Health Officer, who controls certificate validation, approvals for non‑standard cremation places and remedial notices; the Governor formally grants licences albeit after Chief Health Officer review (r 4-7).
• Rights of review: r 14(4) requires medical referees to notify applicants of their right to apply to the State Administrative Tribunal for review of a refusal, embedding an administrative review pathway as a remedy for refused permits.

This set of affected parties and their duties shows how the Regulations distribute decision rights, cost burdens and recordkeeping obligations across public health officials, coronial actors, medical professionals, institutional licensees and family members or administrators of the deceased.

This section lists substantive duties imposed by the Regulations and the rights they create, with references to the specific provisions.

Duties of licence applicants and licensees

• Application form and fee. An application for a licence to use and conduct a crematorium must be made in writing in accordance with Schedule 1 Form 1, signed by the chairman of the body making the application, accompanied by the statutory declaration or other evidence required by section 4(2) of the Act, and the fee in Schedule 2 item 1 (r 4(1)). The Chief Health Officer must ensure the application is in order before forwarding to the Governor (r 4(2)). If the licence is not granted the fee is returned (r 4(3)).
• Validation certificate application. Where section 4(3) requires Chief Health Officer certification before a licence is valid, the named licensee must apply in Form 4 and pay the fee in Schedule 2 item 2 (r 6(1)). The Chief Health Officer inspects and either issues Form 5 or refunds the fee if not satisfied (r 6(2)-(3); r 7).
• Maintenance. Licensees must maintain crematoria, fittings, works and apparatus in good condition, repair and working order; keep premises clean, sanitary and orderly; and provide sufficient attendants to satisfy the Chief Health Officer that maintenance obligations are met (r 8).
• Inspections and remedial work. Licensees must permit inspection of the crematorium and register at any time by the Chief Health Officer or persons authorised by the Chief Health Officer, or any Inspector of Police (r 9(1)). Where non‑compliance is reported the Chief Health Officer may give written notices specifying works and timeframes and the licensee must comply (r 10).
• Register and notice obligations. Licensees must keep a register of cremations in Form 11 and enter particulars immediately after cremation (except disposal of ashes entries) and make the register available for inspection during ordinary business hours on payment of 10 cents (r 18-19). Within 24 hours after a cremation the licensee must give notice to the Chief Health Officer and the Registrar General using Form 12 (r 20).

Duties of applicants for permits to cremate

• Application format and supporting certificates. Applications for a permit must be made in Form 6 and accompanied by the fee specified in Schedule 2 item 3 and a certificate in Form 7 (medical practitioner), Form 8 (Coroner), or the Coroners Regulations Form 4 (r 11-12).
• Statutory declaration responsibilities. Form 6 contains a statutory declaration provision for administrators making applications in certain circumstances; the declarant is warned that it is an offence to make a declaration knowing it to be false under the Oaths, Affidavits and Statutory Declarations Act 2005 (Form 6).

Duties and rights of medical referees

• Eligibility. Medical referees must be medical practitioners with at least five years' practice (r 13).
• Pre‑issue checks. Before permitting cremation a medical referee must ensure all documents are completed in accordance with the Act and that requirements of ss 8, 8A and 8B of the Act have been complied with (r 14(1)).
• Availability and fees. Medical referees must provide reasonable facilities for applicants between 9 a.m. and 5 p.m. Monday to Friday and 9 a.m. to noon on Saturday and may charge the higher prescribed fee for urgent applications outside these times (r 14(2); Schedule 2 item 3).
• Notification and recordkeeping. After issuing a permit the referee must forward a marked copy to the Chief Health Officer (r 14(3)); if refusing a permit the referee must notify the applicant of the decision and their right to apply to the State Administrative Tribunal, and notify the Chief Health Officer of the refusal and reasons (r 14(4)); referees must preserve documents and deliver to the Chief Health Officer annually documents over two years old (r 14(7)); and must notify the Chief Health Officer if to be absent from their usual address for more than 24 hours (r 14(8)). Permits must be in Form 9 (r 14(5)).

Duties of Chief Health Officer and authorised inspectors

• Administrative screening. The Chief Health Officer must ensure an application for licence is in order prior to forwarding to the Governor (r 4(2)).
• Inspection and certification. The Chief Health Officer must inspect premises to decide whether to issue a certificate validating a licence (r 6(2)). The Chief Health Officer issues Form 5 when satisfied the works have been completed per approved plans (r 7).
• Inspection powers. The Chief Health Officer or persons authorised may inspect crematoria and registers (r 9). Inspectors must report breaches and the Chief Health Officer may give remedial notices that licensees must comply with (r 9(2); r 10).
• Approval for non‑standard cremations. The Chief Health Officer must approve places and arrangements for religious cremation outside crematoria and may attach conditions (r 15); the Chief Health Officer can issue directions under the Health (Miscellaneous Provisions) Act 1911 or the Public Health Act 2016 permitting cremation elsewhere (r 17).

Rights created

• Public inspection. The public has a right to inspect the cremation register during ordinary business hours on payment of 10 cents (r 19).
• Administrative review. Applicants refused permits must be told of their right to apply to the State Administrative Tribunal for review (r 14(4); Form 10).
• Refund of fees on refusal. If the Chief Health Officer does not issue a certificate required to validate a licence following inspection the fee paid is refunded (r 6(3)).
• Use of coronial documentation. Where the Coroner has formed an opinion or conducted a post mortem, Coroner’s certificates or coronial forms under the Coroners Regulations may substitute for medical practitioner certificates when applying for permits (r 12(b)-(c); Form 8).

Limitations and temporal conditions

• Permits not immediately effective. Form 9 specifies that a permit shall not be valid until 24 hours have elapsed from the time of death, imposing a minimum waiting period (Form 9).
• Specific safety disclosures. Form 7 imposes specific inquiries regarding pacemakers, radioactive treatments and other matters that affect safety of cremation; practitioners completing the form must certify the information (Form 7).

These duties and rights create an administrative ladder of compliance, inspection and recordkeeping with specific forms and low monetary fees set out in Schedule 2. The regulations focus on operational safety, administrative record integrity and public health oversight.

The Regulations themselves set out inspection, remedial and administrative enforcement mechanisms rather than a schedule of fines or criminal penalties within these Regulations. Enforcement is primarily exercised through inspection powers, remedial notices, regulatory validation processes and procedural reporting obligations. Key enforcement mechanisms in the text are these:

Inspection and reporting powers

• The Chief Health Officer, persons authorised in writing by the Chief Health Officer and Inspectors of Police may inspect a crematorium and its register at any time (r 9(1)). Any authorised person or Inspector of Police who inspects must report any observed breach of the Regulations to the Chief Health Officer forthwith (r 9(2)). The effect is immediate reporting of non‑compliance to the central health regulator.

Remedial notices and compliance orders

• On receipt of a breach report the Chief Health Officer may issue a written notice to the licensee specifying the works to be carried out and a time within which they must be completed; the licensee is required to comply with any such notice (r 10). The text does not specify a penalty for failure to comply with that notice in these Regulations; instead the mechanism is to require compliance through written direction by the Chief Health Officer.

Administrative validation and refusal consequences

• For licence validation, where a Chief Health Officer certificate is required for a licence to be effective, the Chief Health Officer conducts an inspection and either issues the certificate in Form 5 or, if not satisfied, refuses to give the certificate and refunds the fee to the licensee (r 6(2)-(3); r 7). The practical sanction of inadequate installation or non‑compliance is withholding of the validating certificate which prevents the licence from having effect.
• A medical referee who refuses to issue a permit must notify the applicant of the decision and advise them of the right to apply to the State Administrative Tribunal for a review; the referee must notify the Chief Health Officer of the refusal and the reasons therefor (r 14(4); Form 10). The State Administrative Tribunal is the specified review mechanism for permit refusals.

Criminal offences referenced indirectly

• The forms include warnings that making a false statutory declaration is an offence under the Oaths, Affidavits and Statutory Declarations Act 2005 (Form 6 statutory declaration text). Form 13 contains a prohibition: “No person who knows that under the terms of any policy of life assurance, will, settlement, or statute or otherwise howsoever he is entitled or will become entitled by reason or in consequence of the death of another person to any real or personal property shall give or sign any certificate concerning the death of such other person for any of the purposes of this Act.” That is a standalone prohibition in the form; the Regulations do not in these pages specify the penalty but the text signals a statutory restriction on persons with a pecuniary interest giving certificates. Other criminal sanctions, licensing penalties or misdemeanours may be in the principal Cremation Act 1929, or in the Acts referenced for wider public health powers; the Regulations do not themselves itemise an express penalty schedule beyond the procedural consequences.

Interaction with other enforcement powers

• Regulation 17 expressly allows the Chief Health Officer to issue directions pursuant to powers vested in him under the Health (Miscellaneous Provisions) Act 1911 or the Public Health Act 2016. Those Acts may contain broader enforcement powers, penalties and orders; the Regulations therefore point to a pathway for enforcement beyond the Regulations themselves when necessary.

Practical enforcement outcomes

• The practical enforcement levers in the Regulations are administrative: refusal to validate a new licence (r 6), written remedial notices requiring works (r 10), inspections (r 9), suspension of effective operation pending compliance, and notification requirements and reporting that enable oversight. For an aggrieved applicant refused a permit, the Regulations put a right of administrative review before the State Administrative Tribunal (r 14(4)). For false declarations in applications, relevant statutory criminal penalties under the Oaths and Statutory Declarations Act attach.

What the Regulations do not do within their own text

• The Regulations do not specify monetary fines or criminal penalties for breaches of the maintenance, inspection or register obligations themselves. They do not provide a standalone enforcement schedule of penalties in these pages. Instead, enforcement relies on statutory integration with the Cremation Act 1929 and other health legislation for actions such as issuing directions under broader public health statutes, and on administrative controls such as withholding validating certificates and providing for remedial notices.

In summary, enforcement under these Regulations is achieved by inspection powers, reporting duties, remedial notices from the Chief Health Officer, validation withholding, referral to broader public health powers, and by invoking external criminal provisions where false statutory declarations are made. The Regulations create administrative levers rather than a detailed penology within the Regulations themselves.

The Regulations are designed to sit under and alongside the Cremation Act 1929 and several other statutory instruments and Acts. The text itself contains multiple express cross‑references that indicate where duties, substitutions and enforcement powers are shared with other laws.

Primary statutory base

• Cremation Act 1929. The Regulations repeatedly reference sections of the Cremation Act 1929 as the enabling and substantive law for specific requirements. For example, r 4(1) refers to an application under section 4(1) of the Act for a licence to use and conduct a crematorium; r 6(1) references a Chief Health Officer certificate pursuant to section 4(3) of the Act; r 14(1) explicitly requires the medical referee to be satisfied that all the requirements of sections 8, 8A and 8B of the Act have been complied with before issuing a permit. The Regulations are subordinate instruments that operationalise and provide forms for compliance with those statutory requirements.

Health legislation and directions

• Health (Miscellaneous Provisions) Act 1911 and Public Health Act 2016. Regulation 17 allows cremation elsewhere than at a crematorium only where permission is granted under Part V or unless the Chief Health Officer issues a direction pursuant to powers vested in him under the Health (Miscellaneous Provisions) Act 1911 or the Public Health Act 2016. This identifies a legal interaction: the Chief Health Officer may exercise broader public health powers under those Acts to permit or regulate cremation practices in exceptional circumstances.

Coronial framework

• Coroners Regulations 1997. Regulation 12(c) permits the use of the Coroners Regulations 1997 Schedule 1 Form 4 as an evidentiary certificate to accompany an application to cremate. Form 8 is a Coroner’s certificate used under the Regulations. This means coronial determinations and forms may substitute for medical practitioner certificates in certain cases where the Coroner has already formed a view as to cause of death and safety of cremation.

Statutory declaration law

• Oaths, Affidavits and Statutory Declarations Act 2005. The statutory declaration in Form 6 is to be made under that Act; Form 6 expressly warns of the offence of making a false declaration. That links criminal and evidential rules under the Statutory Declarations Act to cremation applications and ensures standard evidentiary rules govern declarations in the application process.

Cemeteries and incorporation Acts (historical links)

• Cemeteries Act 1897 and Associations Incorporation Act 1895. The historical application Form 1 refers to applicants being trustees of a cemetery under the Cemeteries Act 1897 or an association incorporated under the Associations Incorporation Act 1895; both Acts are noted in the notes as repealed or superseded (Other notes table indicates the Cemeteries Act 1897 and the earlier Associations Act have been repealed). The Forms nonetheless reflect the usage historically used to identify typical licence applicants.

Registrar General and vital records

• Registrar General. Regulation 20 requires that the licensee give notice to the Chief Health Officer and the Registrar General within 24 hours after cremation in accordance with Form 12. The Registrar General is typically the custodian of vital statistics; the Regulations therefore integrate cremation events into vital records systems.

Public health and radiation safety

• Radioactive treatment disclosures. Form 7 requests specific disclosure about recent radioactive therapies and radioactive implants, and includes an instruction to contact Radiation Safety Officers/Physicists for required information where necessary. That indicates an interplay with radiation safety rules and institutional practices; the Regulations rely on practitioners to flag radioactive treatment issues that implicate separate radiation safety frameworks.

Administrative review mechanisms

• State Administrative Tribunal. Regulation 14(4) requires medical referees, when they refuse to give a permit, to advise applicants of the right to apply to the State Administrative Tribunal for a review of the decision. The Regulations thereby embed a statutory judicial/administrative review pathway for refusals under the broader administrative law framework in Western Australia.

Coronial and post‑mortem practices

• Form 13 provides for a certificate by a medical practitioner who has conducted a post mortem examination stating that the death resulted from natural causes; this interacts with coronial practice and may substitute for other evidence in permitting cremation.

Collectively, these interactions show that the Regulations operate as a procedural bridge between the Cremation Act 1929 and coronial, public health, radiation safety and statutory declaration frameworks, leaning on those regimes for evidentiary substitutes, enforcement powers and safety standards. Several provisions (notably r 17) expressly enable the Chief Health Officer to use powers from other health Acts to permit cremations outside the standard framework, indicating an intended co‑operation between the cremation regulatory regime and broader public health law.

The Regulations include a compilation table that records a long history of amendments and reprints from their inception in 1954 to the most recent changes noted. The compilation table is incorporated in the documents provided and lists the legislative instruments that have amended the Cremation Regulations 1954 over time. Key points from the compilation and amendment history included in the text are:

• Initial making and commencement. The Cremation Regulations 1954 were published on 20 August 1954 and came into operation on 6 September 1954 (r 2; compilation table).
• Early additions. Untitled regulations relating to these regulations were made 17 December 1954 (note appears to add forms such as Form 13 at that time); the compilation table records reprints and later amendments through 1959, 1965 decimal currency changes and a number of untitled regulations and amendment regulations in the 1970s and 1980s.
• 1984 amendments. The Regulations were amended by the Health Legislation Amendment Regulations 1984 (Gazette 29 Jun 1984) and the Cremation Amendment Regulations 1984 (Gazette 28 Dec 1984). Several r 4, r 5 and other amendments are noted to have occurred at that time in the marginal notes.
• 1990s and 2000s changes. Amendments continued in 1994, 1996, 1997, and a specific Cremation Amendment Regulations 2000 (commencing 1 July 2000). A reprint as at 1 Dec 2000 is recorded.
• Early 2000s to 2010s. A notable amendment in 2002 (Gazette 24 Sep 2002) inserted the “nearest surviving relative” definition (r 3). The Regulations were amended several times in the 2000s and 2010s including a 2004 amendment (Gazette 30 Dec 2004), Cremation Amendment Regulations 2008 (Gazette 4 Apr 2008), and several reprints through 2008 and 2014. The Form 6 application was added in 2008 (Form 6 inserted: Gazette 4 Apr 2008), and later amendments to Forms 7 and others occurred in 2012-2017.
• Integration with health regulatory reform. Amendments in January 2017 are linked to the Health Regulations Amendment (Public Health) Regulations 2016, and 2017 amendments further updated references and requirements (compilation table entries for 2016-2017).
• Recent amendments and fee updates. Amendments in 2019 (Cremation Amendment Regulations 2019) revised forms and fee context (Gazette 2 Jul 2019). Schedule 2 shows that subsequent amendment instruments contributed to its entries: SL 2021/46 r 4; SL 2023/68 r 4; SL 2024/92 r 4; SL 2025/81 r 4. Those successive Regulations indicate continuing updates to fees and possibly other administrative details up to 2025. The text of Schedule 2 carries a footnote showing that the Schedule was inserted on 2 Jul 2019 and later amended by the listed instruments, demonstrating periodic fee adjustments.
• Minor and technical changes. The compilation table contains numerous “untitled regulations” and amendment Regulations spanning from 1973 through to the modern era, reflecting both technical and policy changes to forms, fee amounts and cross‑references, for example adjusting the statutory context for the Chief Health Officer and public health Acts as legislation changed.

The Regulations’ amendment history therefore shows a gradual evolution of both form content and administrative processes, updates to cross‑referenced statutory machinery (for instance to align with new public health legislation), and periodic recalibration of prescribed fees. The presence of repeated amendments and reprints reflects an ongoing administrative maintenance process rather than a single consolidated rewrite. The compilation table is explicit about each amending instrument and commencement dates, including reprints at various dates listed in the table.

As a practical note, the Regulations’ Schedule 2 fee entries and many of the updated form references bear amendment annotations indicating attention to operational details over time. Users relying on fee levels or form content should consult the most recent version (the compilation table records up to SL 2025/81) to ensure current compliance, since fees and form numbering have been adjusted repeatedly and may continue to be updated.

The materials provided do not include any case law or judicial decisions arising under the Cremation Regulations 1954. The body of text and the compilation notes do not name judicial decisions nor do they list litigation arising from the Regulations. The only quasi‑adjudicative mechanism referenced within the Regulations is the administrative review pathway: when a medical referee refuses to issue a permit, regulation 14(4) requires the referee to notify the applicant of the right to apply to the State Administrative Tribunal for review of the decision. That is an internal administrative law pathway rather than a court judgment recorded in these materials.

Given the absence of cases or decisions in the provided document:

• There are no recorded judicial interpretations, appeals or reported cases cited in the Regulations themselves.
• There is no compilation table entry that lists litigation or litigation‑driven amendments; the compilation table focuses on amending instruments and commencement dates.

For practitioners seeking litigation history:

• The Regulations direct a statutory review route to the State Administrative Tribunal for refusals (r 14(4)). Any challenge or judicial review of a Tribunal decision would follow the usual administrative law pathways in Western Australia, but those proceedings and outcomes are not recorded in the Regulations provided.
• If judicial authority or precedent is required for interpreting specific provisions (for instance the scope of Chief Health Officer remedial powers, or the legal meaning of “nearest surviving relative”), counsel should search Western Australian Tribunal and court databases for decisions referencing the Cremation Act 1929 and the Cremation Regulations 1954. The Regulations themselves provide no case citations.

In sum, the legislative text provided contains no litigation history or reported cases. It identifies administrative review rights and cross‑references to tribunals and other legislative instruments, but it does not record any judicial pronouncements.

This section flags procedural, interpretive and operational traps that commonly arise from the text of the Regulations. Each point is grounded in the Regulations and Forms.

1. Nearest surviving relative ordering and age thresholds (r 3; Form 6). The Regulations define nearest surviving relative by an ordered list that puts a person “who, immediately before the death, was living as the spouse of the person; or a de facto partner of the person, and who is of or over the age of 18 years” first (r 3(a)). The list then includes “a person who, immediately before the death, was the spouse” (r 3(b)) as the next priority. The ordering and age thresholds may determine who lawfully makes the application; misunderstanding this ordering can cause an application to be made by a person without priority. Form 6 notes that the statutory declaration section is not to be completed by an administrator, so administrators must follow the declaration route and provide reasons when applying as administrator.

2. Permit not effective immediately after issuance (Form 9). Form 9 explicitly provides that “This permit shall not be valid until 24 hours have elapsed from the time of death.” Medical referees or crematorium operators who assume a permit authorises immediate cremation risk breaching the waiting period.

3. Safety disclosures and the pacemaker/radioactivity questions (Form 7). Form 7 expressly asks about pacemakers, defibrillators and a detailed list of radioactive treatments with specific lookback periods. Ignoring or incompletely answering these items can create a safety hazard at the crematorium. The form also instructs contacting the Radiation Safety Officer/Physicist at the treating institution when radioactive implants are involved. Practitioners should not use an incomplete Form 7.

4. Ceremonial or religious cremation outside crematoria limited and conditional (r 15-17). Part V permits cremation elsewhere only in narrow circumstances and requires Chief Health Officer approval for the place and arrangements and permits potential conditions. It also specifies the historical phrase “Asiatic race” in r 15 which limits the class; practitioners should not assume broad racial or religious exemptions exist beyond this text or beyond directions the Chief Health Officer may issue under other health Acts (r 17).

5. Validation step for licences may delay operation (r 6). Where a licence requires a Chief Health Officer certificate to have effect, the licensee must apply for and obtain that certificate within one year of the licence being granted (Form 1 undertakes to obtain the certificate within one year). If the Chief Health Officer, after inspection, is not satisfied the certificate will be refused and the licence will have no effect; the only statutory remedy specified is a refund of the fee. Applicants should not assume a Governor‑issued licence automatically permits operation without the CHO validation when section 4(3) applies.

6. Minimal fees may be misleading (Schedule 2). The licence fee is only $15.00 and the validation certificate $5.00; permit fees are higher ($85.80 or $140.80). The low licence fee may seem nominal but does not extinguish other compliance costs, including building works, ongoing maintenance, staff and inspection costs required under r 8 and potential remedial works required under r 10.

7. Record retention and transfer duties (r 14(7)). Medical referees must carefully preserve all documents received and deliver to the Chief Health Officer once per year any documents over two years old. Medical referees should have secure record systems and a schedule for transfer; failing to forward older documents may create compliance issues with the Chief Health Officer.

8. Inspectors of Police have inspection rights (r 9). The involvement of police in inspection powers may be overlooked by licence holders focused only on public health inspections. Inspectors of Police are explicitly authorised to inspect crematoria and registers and must report breaches.

9. Register inspection cost is token but public (r 19). The register must be open for inspection on payment of 10 cents. Licensees must be prepared to provide public access during ordinary business hours. Failure to maintain an accurate Form 11 register or refusal to permit inspection may be treated as a breach.

10. Medical referees must notify applicants of review rights and provide reasons to the Chief Health Officer for refusal (r 14(4)). While the medical referee need not advise the applicant of the reasons for refusing a permit, the referee must notify the Chief Health Officer of their decision and the reasons. There is nuance in what the applicant is told: they must be told they can apply to the State Administrative Tribunal, but the referee need not give reasons to the applicant.

11. Prohibition on conflicted certifiers (Form 13 note). Form 13 contains a prohibition preventing persons with a pecuniary interest under insurance, wills or other instruments from giving or signing certificates concerning deaths for the Act’s purposes. Certifiers should check conflicts before signing.

12. Cross‑statute references require checking up‑to‑date law. The Regulations rely on other Acts such as the Public Health Act 2016 and coronial regulations. Practitioners must verify current versions of those statutes and regulations before advising clients because enforcement and permit permissions may differ depending on those Acts’ provisions and contemporary interpretations.

These “gotchas” are operational rather than doctrinal; they arise from timing, documentary, safety and procedural requirements embedded in the forms and regulations and can lead to administrative refusal, delayed cremation, or safety incidents if not followed.

This checklist is a practical, section‑based pathway for licence applicants, licence‑holders, medical referees, and applicants for permits to cremate. It references the Regulations and Forms to provide concrete action steps.

For a body seeking a licence to use and conduct a crematorium

1. Prepare and complete Schedule 1 Form 1 (r 4(1); Form 1). Ensure the form is signed by the chairman of the body making the application and accompanied by the statutory declaration or other evidence required by section 4(2) of the Cremation Act 1929.
2. Pay the licence fee in Schedule 2 item 1 ($15.00 as at the latest Schedule 2) and include the payment with the application (r 4(1); Schedule 2).
3. Submit the application to the Chief Health Officer, who will check it is in order before forwarding to the Governor (r 4(2)). Expect to engage with the Chief Health Officer for any clarifications on plans and specifications indicated in the application.
4. If the licence requires validation under section 4(3) of the Act, apply for the Chief Health Officer certificate using Schedule 1 Form 4 and pay the fee in Schedule 2 item 2 ($5.00) (r 6(1); Form 4; Schedule 2).
5. Prepare the crematorium premises, fittings and apparatus per any approved plans and the Chief Health Officer’s standards; expect inspection (r 6(2); r 7; Form 5). Do not operate until the validating certificate is given if section 4(3) requires it.
6. Implement and maintain operational procedures to comply with r 8: maintain good repair, cleanliness and provide sufficient attendants; keep records and prepare for inspections (r 8).

For licence‑holders once operational

1. Keep the register of cremations in Schedule 1 Form 11 and make entries in relation to every cremation immediately after it is carried out (r 18; Form 11).
2. Make the register available to any person during ordinary business hours on payment of 10 cents (r 19). Implement a procedure to process register inspection requests and collect the fee.
3. Within 24 hours of any cremation, send the certificate of cremation in Schedule 1 Form 12 to the Chief Health Officer and the Registrar General (r 20; Form 12). Ensure staff know the 24‑hour deadline.
4. Permit inspection of the crematorium and register by the Chief Health Officer, authorised persons, or Inspectors of Police at any time (r 9(1)). Maintain contact details for the Chief Health Officer and keep up to date any authorisations or notifications.
5. If the Chief Health Officer issues a written notice requiring remedial works, comply within the specified timeframe (r 10). Have a process to receive, document and action any remedial notice.

For medical practitioners acting as medical referees

1. Confirm eligibility: ensure at least five years’ practice before appointment as a medical referee (r 13).
2. Before issuing a permit, ensure all documentation is complete in accordance with the Act and that sections 8, 8A and 8B of the Cremation Act 1929 have been complied with (r 14(1)). Use Schedule 1 Form 9 for permits (r 14(5); Form 9).
3. Provide reasonable facilities for applicants during business hours; if attending to urgent applications outside those hours, follow the fee structure for out‑of‑hours permits (r 14(2); Schedule 2 item 3).
4. After issuing a permit forward a copy marked with permit number and date to the Chief Health Officer forthwith (r 14(3)). Keep secure copies for record retention.
5. If refusing a permit, give notice to the applicant (Form 10) and advise of the right to apply to the State Administrative Tribunal for review; notify the Chief Health Officer of the refusal and reasons (r 14(4); Form 10).
6. Carefully preserve all documents received in the discharge of your duties and deliver to the Chief Health Officer once per year any documents over two years old (r 14(7)). Maintain secure storage and an annual transfer procedure.
7. Notify the Chief Health Officer if you will be absent from your usual address for more than 24 hours (r 14(8)).

For applicants seeking a permit to cremate

1. Complete Schedule 1 Form 6 (r 11; Form 6). Identify whether you are the nearest surviving relative, an administrator, or another applicant; obtain and attach a statutory declaration if required by Form 6.
2. Obtain and attach the supporting certificate: either Schedule 1 Form 7 completed by the medical practitioner who attended the deceased, or Schedule 1 Form 8 completed by the Coroner, or the Coroners Regulations 1997 Schedule 1 Form 4 where applicable (r 12; Form 7; Form 8). Ensure completeness and accuracy on pacemaker and radioactive treatment questions on Form 7.
3. Pay the permit fee in Schedule 2 item 3: $85.80 for business hours or $140.80 for out‑of‑hours permits, subject to the current Schedule 2 (r 12; Schedule 2).
4. Submit the application to the medical referee. If the medical referee refuses to give a permit you must be notified of your right to apply to the State Administrative Tribunal (r 14(4); Form 10).
5. Note that a permit in Form 9 will not be valid until 24 hours have elapsed since the time of death (Form 9).

For religious or non‑standard cremation locations

1. If the deceased belongs to a denomination whose tenets require burning outside a crematorium and falls within the description in r 15, make application in accordance with Part III and request the medical referee’s consent; arrange for the Chief Health Officer to approve the place and arrangements and be prepared for conditions to be attached (r 15).
2. If cremation is to occur in a cemetery, follow directions of the cemetery authority (r 16).
3. If no Part V permission is available, seek a direction from the Chief Health Officer under the Health (Miscellaneous Provisions) Act 1911 or the Public Health Act 2016 permitting cremation elsewhere (r 17).

Recordkeeping and audit readiness

1. Maintain Form 11 registers and all permit files, certificates and statutory declarations in secure, retrievable form. Implement an annual transfer of documents over two years old to the Chief Health Officer as required of medical referees (r 14(7)).
2. Ensure availability for inspection by authorised persons and Inspectors of Police and maintain copies of correspondence with the Chief Health Officer, including any remedial notices (r 9-10).

Cross‑check external statutory requirements

1. Verify current coroner, public health and statutory declaration provisions and forms referenced in the Regulations as these interact with permit and approval processes (r 12(c); r 17; Form 6 statutory declaration).
2. Ensure any radiation safety issues identified on Form 7 are managed in consultation with Radiation Safety Officers/Physicists and that crematorium staff are trained for handling devices such as pacemakers or radioactive implants.

By following this process map and referencing the specific forms and regulations, operators, referees and applicants can map obligations to tasks and build internal systems for compliance with the Cremation Regulations 1954.
