What it does
This Act creates a statutory duty on the Minister to prepare and table, at fixed intervals, a public report called the Creative Statement to Parliament (the Statement) about the creative industries in New South Wales. The Statement must be prepared for each three year period and tabled in each House of Parliament no later than three years after the last Statement was tabled (s 5(1)-(2)). The Minister must ensure the Statement is published on a NSW Government website within seven days after tabling (s 5(3)). Where a House refers the Statement to a parliamentary committee within seven days, the committee to which it is referred must report to that House (s 5(4)-(5)).
The Act prescribes mandatory minimum content for the Statement. The Statement must report on the status, health and progress of the creative industries and on progress in implementing the Government’s policies and plans relating to those industries (s 6(1)). Substantive listing of required metrics appears at s 6(2): an economic-impact summary including estimates of the industries’ contribution to the economy, the number of jobs supported, and the forms of employment and other working arrangements and employment characteristics; a summary of government activities and investment to support the creative industries; an assessment of sustainability and growth; and a report about progress in implementing relevant government policies and plans (s 6(2)(a)-(d)). The Act also lists optional matters the Minister may include, such as summaries of partnerships, reporting on Government support for First Nations creative industries, and summaries of challenges and opportunities (s 6(3)).
The Act defines core terms used in those duties and contents. “Creative industries” is defined expansively to include the arts and culture sector, First Nations culture sector, cultural institutions, architecture, design and fashion, built and physical heritage, arts and culture education, creativity in food and beverage, creative innovation in technology, and any other sector prescribed by regulation (s 3). “Health, of the creative industries” is defined as sustainably positive economic, environmental, ethical and operational conditions that support long‑term viability for continuing social benefit (s 3). The Minister’s duty first becomes operative according to the Act’s commencement on assent (s 2), and the Schedule requires the first Statement to be tabled within 18 months of commencement (Schedule 1, cl 1).
