COURT SECURITY REGULATIONS 1998

The Regulations turn on three main drafting concepts: prescription, cross-reference, and temporal limitation. First, prescription. Regulation 2 operates by prescribing specified courts and tribunals for the purposes of particular subparagraphs of the statutory definition of "court" in s 4 of the parent Act. The term "prescribed" is a technical device: it identifies that, for legal effect, the listed bodies are to be treated as courts under the Act in the contexts identified by paragraphs (h) and (j) of s 4 (r 2(1)-(4)). The Regulations do not themselves define "court"; they designate which external bodies are to be treated as such, thereby expanding or clarifying the Act’s reach by reference to other legislative instruments (for example, Supreme Court Act 1979, Criminal Code, Electoral Act 2004, and a number of tribunal-establishing Acts) (r 2).

Second, cross-reference. Each prescription is anchored to the statutory source that establishes the body in question: the Court of Appeal is identified by reference to s 51 of the Supreme Court Act 1979, the Court of Disputed Returns by s 232 of the Electoral Act 2004, and so on (r 2(1)-(2)). That cross-referencing accomplishes two tasks: it links the prescription to the enabling provision for the body, and it reduces ambiguity about which institutional entity is intended where similar or overlapping names might exist. The Regulations therefore use other Acts as definitional anchors.

Third, temporal limitation and activity-specific coverage. Two of the prescriptions are limited to particular activities. A coroner or deputy coroner is prescribed only "while conducting an inquest under the Coroners Act 1993" (r 2(3)). The ICAC is prescribed only "while conducting an examination under the Independent Commissioner Against Corruption Act 2017" (r 2(4)). Those formulations create a temporal or activity-based condition: the person or office is included in the Act’s "court" definition only during the conduct of the specified proceeding. The Regulations make no express statement about coroners or the ICAC outside those activities.

A further drafting feature is selective enumeration within r 2(2). The regulation lists specific tribunal entries by lettered subparagraphs (c), (d), (f), (g). The text as provided does not include entries for every alphabetical letter. The provision, read literally, prescribes the particular tribunals shown; it does not, in itself, prescribe unlisted tribunals. The Regulations provide a concise, enumerative list, not a broad formula.

Finally, the instrument is formalised by a short citation provision (r 1) and by the endnotes that record the original notification and subsequent amendment instruments and dates. The endnotes identify multiple amending Acts and subordinate legislation affecting r 2 (see the List of Amendments and List of Legislation in the endnotes). That history, recorded in the instrument, is part of the text and relevant when tracking the Regulations’ current scope.

The Regulations identify institutional actors whose relationship to the Court Security Act 1998 is clarifed by prescription. The directly listed subjects are: the Court of Appeal of the Northern Territory (r 2(1)(a)); the Court of Criminal Appeal (r 2(1)(b)); the Court of Disputed Returns (r 2(1)(c)); the Firearms Appeal Tribunal (r 2(2)(c)); the Land and Valuation Review Tribunal (r 2(2)(d)); the Motor Accidents (Compensation) Appeal Tribunal (r 2(2)(f)); the Northern Territory Civil and Administrative Tribunal (NTCAT) (r 2(2)(g)); coroners and deputy coroners while conducting inquests (r 2(3)); and the Independent Commissioner Against Corruption while conducting an examination (r 2(4)). Those courts and tribunals, when the relevant paragraph of s 4 is engaged, become "courts" for the purposes of the Act.

Indirectly affected actors include entities and persons whose obligations or rights under the Court Security Act 1998 attach to the category "court" as defined in s 4. The Regulations do not articulate those obligations themselves. However, by designating additional institutions as falling within the Act’s definitional reach for paragraphs (h) and (j), the Regulations bring those institutions into the regime created by the Act to the extent the Act’s operative provisions depend on that definition. That can affect multiple groups:

• Judicial officers, tribunal members, coroners and ICAC officers, to the extent the Act confers functions, protections, or security-related powers on "courts" (r 2).
• Court and tribunal administrators responsible for facilities, entry management, and engagement with security providers, because the Act’s security regime will apply to the prescribed bodies when the definition is engaged (r 2).
• Parties, litigants, witnesses, media representatives, and members of the public who attend proceedings at the prescribed courts and tribunals, because the Act’s security measures (however framed in the Act) will, by virtue of the prescription, be able to apply to those proceedings (r 2).
• Private security providers, contractors and suppliers who supply services to the prescribed bodies, because the addition of institutions to the Act’s scope can create demand for security arrangements regulated by the Act (r 2).
• Government departments and agencies that fund or manage the listed courts and tribunals, since compliance (financial and operational) with the Act’s requirements will fall to the bodies or funding agencies responsible for the courts and tribunals named (r 2).

Two particular features narrow the class of affected persons. First, the coroner and ICAC prescriptions are conditional on a specific activity: "while conducting an inquest" (r 2(3)) and "while conducting an examination" (r 2(4)). That temporal limitation means that outside those activities coroners and ICAC are not prescribed by these Regulations. Second, the Regulations apply only to those institutions expressly named; they do not by their terms sweep in unlisted tribunals or courts.

The endnotes, which list successive amending Acts and commencement dates, are relevant to administrators and legal advisers because they show that the list of prescribed bodies has been adjusted over time (see List of Legislation and List of Amendments in the endnotes). Anyone advising an affected entity should note that the instrument’s current text reflects those recorded amendments (r 2; endnotes).

The Regulations themselves do not create new duties or rights in isolation. Their legal function is definitional: they identify which institutions are to be treated as "courts" for the purposes of particular subparagraphs of the statutory definition in s 4 of the Court Security Act 1998 (r 2). Therefore any duties, powers, rights or offences remain situated in the parent Act. The Regulations affect duties and rights only by changing the set of institutions to which the Act’s provisions refer.

From the text it is possible to state the following structural points about duties and rights as they arise from the Regulations:

• Delegated scope-setting. By prescribing named courts and tribunals, the Regulations extend (or clarify) the Act’s operational scope. Any duty in the Act that is framed as owed by, or enforceable against, a "court" as defined will apply to the listed institutions when the relevant paragraph is engaged (r 2). The Regulations do not themselves specify what that duty is; they operate as the mechanism that connects particular institutions to the Act’s operative provisions.

• Conditional applicability in activity-specific prescriptions. For coroners and the ICAC, the Regulations create an activity-tied inclusion. That creates a duty boundary: duties that arise under the Act in respect of a "court" will attach to a coroner only when he or she is "conducting an inquest under the Coroners Act 1993" (r 2(3)), and to the ICAC only when "conducting an examination under the Independent Commissioner Against Corruption Act 2017" (r 2(4)). That structure confines the reach of any Act-imposed duties or powers to defined activities.

• Rights and protections that are defined by the Act will likewise follow the prescription. If the Act confers rights on parties attending court proceedings or protections on judicial officers or staff, those will be available or applicable at the institutions listed here to the extent the Act ties them to the definition of "court." The Regulations thus indirectly determine who benefits from statutory rights or protections tied to the Act’s definition.

• Administrative and operational obligations implicate court and tribunal administrators. Where duties in the Court Security Act 1998 require administrators to implement physical security measures, manage access, engage security personnel, or report incidents to an enforcing authority, those obligations will apply to the administrators of the listed courts and tribunals to the extent the Act frames such duties by reference to the category "court." The Regulations therefore shift operational responsibility to the managing bodies for the prescribed institutions.

Because the Regulations do not include the text of the parent Act, a reader must consult the Court Security Act 1998 to determine the precise content and allocation of duties and rights that flow from inclusion in the Act’s definition. The Regulations tell the reader which institutions will be captured by the Act’s regime in the specified contexts, but not what the regime requires or permits. That separation of instruments is central to how the legal obligations and entitlements are allocated.

The Regulations do not create offences, penalties or an enforcement framework themselves. They are a mechanism for defining the scope of the Court Security Act 1998 by naming institutions that fall within the Act’s definition of "court" for particular paragraphs of s 4 (r 2). Any criminal or civil penalties, and the identity of enforcement bodies, must therefore be found in the Court Security Act 1998 rather than in these Regulations.

Two enforcement-relevant consequences follow from that drafting approach:

• Extension of enforcement reach. Where the Act prescribes penalties or enforcement processes that apply to a "court" or to conduct occurring in or around a "court," the Regulations, by expanding the set of institutions captured, extend the circumstances and locations where those penalties or enforcement mechanisms may operate. For example, if the Act contains offences relating to unauthorised access, prohibited items, interference, or non-compliance with security officers at a "court," those offences will be capable of being enforced at the institutions listed in r 2 to the extent the Act attaches enforcement to the statutory definition of "court."

• Activity-limited enforcement at coronial and ICAC proceedings. Because r 2(3) and r 2(4) predicate prescription on activity , "while conducting an inquest" and "while conducting an examination" , any Act-based enforcement powers or penalties tied to the "court" label will apply to coroners and the ICAC only during those activities. Outside those activities, enforcement powers that rely on prescription will not be engaged by virtue of the Regulations.

The Regulations themselves do not identify the enforcing agency, penalty scales, procedural safeguards or appeals processes. Those elements are part of the parent statute and any associated regulations or administrative instruments. The endnotes show that the Regulations have been the subject of multiple amendment instruments and related Acts over time (see List of Legislation and List of Amendments). That amendment history is relevant to enforcement in practice because the scope of where and when enforcement can be applied may have changed as the list of prescribed bodies changed.

Practitioners should therefore treat the Regulations as a scope-determining instrument that conditions where statutory enforcement powers in the Court Security Act 1998 can lawfully operate, and should consult the Act for the applicable offences, penalty provisions and enforcement mechanisms. The Regulations themselves supply no penalty provisions to apply.

The Regulations are explicitly cross-referential. Each prescription in r 2 is tied to the statutory source that establishes the relevant court or tribunal. The instrument therefore operates at the intersection of the Court Security Act 1998 and the Acts that create or describe the prescribed bodies. The Regulations cite several complementary Acts by section number and name, linking the identity of the prescribed institution in r 2 to its establishing statute. Those citations appear as follows:

• Supreme Court Act 1979, s 51, for the Court of Appeal (r 2(1)(a)).
• Criminal Code, s 407, for the Court of Criminal Appeal (r 2(1)(b)).
• Electoral Act 2004, s 232, for the Court of Disputed Returns (r 2(1)(c)).
• Firearms Act 1997, s 50, for the Firearms Appeal Tribunal (r 2(2)(c)).
• Valuation of Land Act 1963, s 21, for the Land and Valuation Review Tribunal (r 2(2)(d)).
• Motor Accidents (Compensation) Act 1979, s 28, for the Motor Accidents (Compensation) Appeal Tribunal (r 2(2)(f)).
• Northern Territory Civil and Administrative Tribunal Act 2014, s 7, for NTCAT (r 2(2)(g)).
• Coroners Act 1993, for the inquest function tied to coroners (r 2(3)).
• Independent Commissioner Against Corruption Act 2017, for ICAC examinations (r 2(4)).

That mapping has two implications. First, it resolves identity questions. Where multiple institutional names might overlap, the prescription is anchored to the precise statutory section that created the body, reducing ambiguity about which entity is captured. Second, it creates a cross-instrument dependency. Changes in the existence, jurisdiction, or statutory identity of the prescribed body in its establishing Act may affect how the Court Security Act 1998 applies via these Regulations. The endnotes show a record of consequential amendments and related Acts that have been relevant to the Regulations over time (List of Legislation and List of Amendments in the endnotes). That historical record indicates that inter-legislative interaction has been an operating consideration for the instrument.

The Regulations also interact with the temporal and functional regimes of other Acts by referencing activity-specific functions. A coroner or deputy coroner is prescribed only while conducting an inquest under the Coroners Act 1993 (r 2(3)). ICAC is prescribed only while conducting an examination under the Independent Commissioner Against Corruption Act 2017 (r 2(4)). Those cross-references create a nexus between the procedural or investigative activities in other Acts and the security regime under the Court Security Act 1998. That means a proceeding under one Act (for example, a coronial inquest) can trigger the operation of a security regime established under another Act, provided the institutions and activities align with the prescriptions in r 2.

Finally, the endnotes list numerous amending Acts and relevant legislation. Those entries show that the Regulations have been consequentially altered in response to new or amended statutes (for example, the Electoral (Consequential Amendments) Act 2004 and the Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023). Users should therefore treat the Regulations as one node in a network of legislative instruments; changes to related statutes can influence the Regulations’ practical effect.

The instrument includes endnotes that record its original notification, commencement and subsequent amendments. The Regulations were notified on 1 July 1998 and commenced on that date (Court Security Regulations (SL No. 16, 1998), Notified 1 July 1998; Commenced 1 July 1998). The List of Legislation and List of Amendments in the endnotes record multiple consequential and formal amendments across more than two decades.

Notable entries from the endnotes include:

• Electoral (Consequential Amendments) Act 2004 (Act No. 12, 2004). Assent 1 March 2004; commenced 15 March 2004 (r 2 amended by Act No. 12, 2004, s 7). The Court of Disputed Returns reference at r 2(1)(c) appears in that context.
• Antisocial Behaviour (Miscellaneous Amendments) Act 2006 (Act No. 2, 2006). Assent 8 March 2006; commenced 14 June 2006 (r 2 amended by Act No. 2, 2006, s 26).
• Care and Protection of Children Act 2007 (Act No. 37, 2007). Assent 12 December 2007; various commencement timings for parts of that Act are recorded; the endnotes list r 2 as amended by Act No. 37, 2007, s 342.
• Local Government (Consequential Amendments) Act (Act No. 28, 2008). Assent 19 November 2008; commenced 1 July 2008 (r 2 amended by Act No. 28, 2008, s 4).
• Alcohol Reform (Substance Misuse Assessment and Referral for Treatment Court) Act 2011 (Act No. 19, 2011). Assent 20 May 2011; commenced 1 July 2011 (r 2 amended by Act No. 19, 2011, s 46).
• Alcohol Mandatory Treatment Act 2013 (Act No. 17, 2013). Assent 28 June 2013; commenced 1 July 2013 (r 2 amended by Act No. 17, 2013, s 153).
• Court Security Amendment Regulations 2014 (No. 34, 2014). Notified and commenced 19 November 2014 (No. 34, 2014, r 3).
• Licensing (Repeals and Consequential Amendments) Act 2014 (Act No. 44, 2014). Assent 5 December 2014; commenced 1 January 2015 (r 2 amended by Act No. 44, 2014, s 145).
• Local Government Legislation Amendment Act 2015 (Act No. 8, 2015). Assent 23 April 2015; commenced partly on 17 February 2016 and otherwise 23 April 2015 (r 2 amended by Act No. 8, 2015, s 84).
• Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023 (Act No. 24, 2023). Assent 21 September 2023; commenced 27 November 2023 (Gaz G24, 23 November 2023, p 2). The endnotes list Act No. 24, 2023, s 147 as an amendment affecting r 2.
• Independent Commissioner Against Corruption Amendment Act 2023 (Act No. 29, 2023). Assent 13 November 2023; commencement provisions differ by section: s 45 commenced 2 January 2024; other parts have earlier dates (r 2 amended by Act No. 29, 2023, s 54).

The endnotes also record general amendments of a formal nature effected by the Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018), which are stated to have altered rr 1 and 2 in a non-substantive, formal way (see section 3 of the endnotes).

The List of Amendments entry at the end of the instrument summarises a set of amending instruments that have altered r 2 over time (r 2 amd Act No. 12, 2004, s 7; Act No. 2, 2006, s 26; Act No. 37, 2007, s 342; Act No. 28, 2008, s 4; Act No. 19, 2011, s 46; Act No. 17, 2013, s 153; No. 34, 2014, r 3; Act No. 44, 2014, s 145; Act No. 8, 2015, s 84; Act No. 29, 2023, s 54; Act No. 24, 2023, 147).

Taken together, the amendment history recorded in the endnotes shows that the Regulations have been updated repeatedly to align the Act’s definitional scope with changes elsewhere in the Northern Territory statute book, and that those changes have been effected by a mix of primary Acts and subordinate instruments. The instrument’s endnotes are therefore the authoritative source within the Regulations for tracking how and when r 2 acquired its current content.

The text of the Regulations as provided contains no case citations, no references to judicial interpretation, and no records of litigation about the Regulations themselves. The instrument’s endnotes list the primary and amending legislation, and note formal amendments, but do not record any judicial decisions, reported disputes, or litigation history relevant to the interpretation or operation of the Regulations.

From a practical perspective, that absence in the text means two things for advisers and practitioners:

• There is no litigation history recorded within the Regulations themselves that would inform statutory construction or operational practice. Any such history would need to be sought in external sources, such as case law databases or judicial reports. The Regulations’ text makes no claim to summarise or record litigation.

• Where interpretive questions arise about the scope or meaning of these prescriptions , for example whether a particular body falls within a cited establishing Act’s section, or whether an activity is within the temporal limitation "while conducting an inquest" , those questions would need to be resolved by reference to primary statutes and, if necessary, judicial interpretation outside the Regulations. The Regulations identify institutions by reference to their establishing statutes; interpretive issues are therefore likely to engage statutory construction principles applied to the cited Acts and to any relevant case law.

Because the Regulations themselves do not tip into enforcement, penalty-setting, or procedural detail, contentious litigation specific to these Regulations is less likely unless a dispute turns on whether an entity is covered by the prescription. But the instrument does not record any such disputes. Practitioners should treat this absence as an instruction to search external judicial sources for any case law that might bear on the interaction between the Court Security Act 1998, these Regulations, and the establishing statutes cited in r 2.

Several drafting and operational features in the Regulations are potential sources of confusion or practical risk if overlooked. These are drawn strictly from the instrument’s text and endnotes.

1. Activity-limited prescriptions. The coroner/deputy coroner and the ICAC are prescribed only while conducting specified activities (r 2(3)-(4)). That wording creates a temporal trigger that may be missed in practice. Advice and operational planning must therefore distinguish between courthouse activities that fall within the prescribed activity and those that do not. For coroners and ICAC personnel the Act’s security regime will apply only during the stated activities.

2. Narrow, enumerative list. Regulation 2 names specific courts and tribunals. It does not purport to be exhaustive of all courts or tribunals in the Northern Territory; nor does it include an open-ended category. Where an entity is not listed, the Regulations do not confer the status of "court" for the purposes of paragraphs (h) or (j) of s 4. Do not assume that similar-sounding bodies or newly established tribunals are captured unless they are expressly prescribed or the parent Act provides alternate coverage.

3. Cross-references to other Acts. Each prescription is tied to a statutory provision in another Act (r 2). That linkage means that changes to the establishing Acts (for example, renumbering, repeal, or jurisdictional change) may affect the clarity of the prescription. The endnotes indicate amendments across multiple years and Acts. If an establishing Act is amended, confirm whether the reference in r 2 remains valid or whether a consequential amendment was required or made.

4. Missing lettering in r 2(2). The tribunal list in r 2(2) is given by subparagraph letters (c), (d), (f), (g). The instrument as provided does not include subparagraphs (a), (b), (e) or others. That could reflect an earlier drafting structure, deletions, or selective prescription. Practitioners should not infer the existence of omitted entries; instead, rely on the current text.

5. No operational detail in the Regulations. The Regulations do not set out security procedures, offence elements, powers of security officers, or compliance mechanisms. All such operational details are in the parent Act. Failing to consult the Court Security Act 1998 to identify concrete obligations and procedural rights would be a practical error.

6. Amendment history matters. The endnotes list multiple amending Acts and commencement dates. Some amendments are linked to other large-scale reforms (for example the conferral of jurisdiction on NTCAT). Failure to account for the timing of amendments may create mismatch between current practice and the statute book.

7. Administrative responsibility is not specified here. The Regulations identify which entities are treated as "courts" but do not designate which government department or office bears operational responsibility for implementing security measures at those places. That allocation will rely on the parent Act or on administrative arrangements elsewhere.

8. Enforcement and penalties are external. Because no penalty regime is included in the Regulations, parties and administrators must identify enforcement mechanisms in the Court Security Act 1998. Best practice requires confirming whether those mechanisms differ by the category of court or tribunal.

9. Reliance on the definition in s 4. The Regulations operate only "for the purposes of paragraph (h) [or (j)] of the definition of court in section 4 of the Act" (r 2). The exact legal consequences depend on how the parent Act uses paragraphs (h) and (j). Do not assume identical effect for paragraphs (h) and (j); the Regulations treat them separately.

10. Territorial and functional overlap. Some prescribed bodies are appellate courts; others are specialist tribunals or investigative bodies. The Act’s application to each may therefore produce different practical results depending on the nature of proceedings, venue arrangements and participant profiles.

Treat each of these as a concrete, source-grounded hazard. None of them requires speculative external facts; each follows from the Regulations’ structure and wording as provided.

The Regulations themselves do not set out operational compliance steps because they are scope-defining. Compliance therefore has two stages: (1) determine whether the institution, person or activity is prescribed; and (2) align practice with the obligations and procedures set out in the Court Security Act 1998 and any related instruments. The Regulations supply the answer to stage (1) for the paragraphs they reference; the Act supplies stage (2). Practical compliance steps grounded in the instrument are as follows.

1. Identify whether the body or activity is prescribed. Check r 2. If you are an administrator, official, judicial officer, coroner, ICAC officer, or contractor, verify whether your court or tribunal is listed (r 2(1)-(2)). If you are a coroner or an ICAC official, confirm whether the relevant activity (an inquest or an examination) is being conducted; the prescription applies only "while conducting" those specified activities (r 2(3)-(4)).

2. Map the prescribed status to the obligations in the Court Security Act 1998. The Regulations do not restate duties. Once an entity is identified under r 2, review the Court Security Act 1998 to determine what duties, powers, prohibited conduct, enforcement mechanisms and procedural safeguards apply to a "court" as defined in s 4 and as engaged by paragraphs (h) and (j). The Regulations tell you the scope trigger; the Act tells you what follows from that trigger.

3. Confirm current status in light of amendments. Use the endnotes’ List of Legislation and List of Amendments to track whether the prescription changed and when it took effect. For example, the inclusion of NTCAT is linked to the Statute Law Amendment (NTCAT Conferral of Jurisdiction) Act 2023 and other listed amendments (endnotes). Make sure your compliance plan reflects the Regulations as currently in force, including any commencement dates recorded in the endnotes.

4. Align operational arrangements. If the Act requires security measures at "courts," arrange for those measures at the physical locations and proceedings of the prescribed courts and tribunals. That may include entry screening, regulated exclusion of items, appointment or training of security officers, signage, and liaison with police or other enforcement bodies. Responsibility for funding and implementing such arrangements is not stated in the Regulations; determine whether it falls to the court/tribunal administration, a parent department, or another agency under the parent Act or administrative arrangements.

5. Manage transient and site-specific application. For coronial inquests and ICAC examinations, ensure that plans specify when the prescription is engaged and when it lapses. That will require coordination between coronial or ICAC offices and court security administrators so that security measures are in place only for the prescribed activities.

6. Contract and procurement considerations. Where private security providers or contractors are engaged, ensure contractual terms require compliance with the Court Security Act 1998 as it applies to the prescribed institution. Include clauses that account for activity-based triggers for coronial and ICAC proceedings.

7. Record-keeping and training. Maintain records demonstrating when the prescription was engaged and what security measures were in place. Train staff and contractors on the scope-determination rule in r 2 so they can correctly identify when the Act’s security regime applies.

8. Legal advisory steps. When in doubt about whether a particular body or proceeding is captured, seek legal advice and consult the establishing statute cited in r 2 for identity confirmation. For example, if a body claims to be the Land and Valuation Review Tribunal, confirm that it is the tribunal established by s 21 of the Valuation of Land Act 1963 as identified in r 2(2)(d).

9. Monitor related legislative change. Use the endnotes as a guide to the types of amending Acts that have historically altered the Regulations. Monitor amending legislation for the Supreme Court Act, Criminal Code, Electoral Act, tribunal-establishing Acts, the Coroners Act and the ICAC Act because changes in those Acts can affect whether and how the prescription operates.

10. Do not assume extra-regulatory duties. The Regulations do not themselves impose fines or create enforcement processes. Compliance work should therefore be anchored to the Court Security Act 1998 and any subsidiary instruments that set out penalties, enforcement responsibilities, and processes for complaints or appeals.

These steps are the practical workplan implied by the Regulations’ text. They assume no content external to the instrument except that the Court Security Act 1998 contains operative duties and enforcement mechanisms tied to the statutory definition of "court." The Regulations supply the scope trigger; compliance requires mapping that trigger to the parent Act and to administrative practice.
