Court Security Act 1980

The Act rests on a handful of core statutory concepts and mechanisms. Each concept is defined or deployed in the Act’s operative provisions.

Authorised officer: The Act’s central enforcement agent, defined to include police officers, police custody officers, protective services officers, and persons appointed under s 2A. Appointment requires the decision maker to be satisfied the person is competent, of good repute, and has agreed in writing to the functions (s 2(1) defn; s 2A(1)-(4)). Authorised officers must carry and display identity cards issued under s 2B, wear them while on duty and produce them on request (s 2B(1)-(3)).

Court premises: A deliberately broad territorial definition in s 2(1) covers premises occupied in connection with court operations, adjacent precincts, car parks, footpaths and laneways between or abutting court premises, and any other place where a court is constituted and performing functions for the time being. This produces a large operational footprint for authorised officers’ powers (s 2(1) defn of court premises).

Prohibited item: Defined to include firearms (as in the Firearms Act 1996), explosive substances (as in the Crimes Act 1958), offensive weapons, and “an item that is likely to affect adversely the security, good order or management of the court premises” (s 2(1) defn). That last catch-all embeds a fact-sensitive, forward-looking standard that is not limited to specific classes of items.

Search and seizure: Authorised officers may require frisk searches, scanning searches and surrender of items believed on reasonable grounds to be prohibited (s 3(3)). They may seize and retain such items (s 3(6)) and may use “reasonable force” to conduct searches, enforce directions, remove persons, seize items, and ensure safety while escorting persons (s 3(4)). The Act contains procedural constraints: conduct must not subject a person to greater indignity than reasonably necessary (s 3(4A)); firearms, explosives or offensive weapons that would contravene other laws must be given to police within 24 hours (s 3(8)(a)); other surrendered items not collected within 28 days may be destroyed or sold with proceeds retained (s 3(8)(b)).

Direction-making and compliance: Authorised officers may give reasonable directions for maintaining or restoring security, good order or management, may escort persons, and may direct others to stop making a recording, permit viewing of a recording on a device, or delete a recording where they reasonably suspect it is not permitted (s 3(2A)). The Act makes compliance with directions a criminal penalty (10 penalty units) unless the activity is permitted by law (s 3(2B)-(2C)). Persons must also comply with search requirements under s 3(3) (s 3(10)).

Contracting model with accountability: Court Services Victoria can contract for the provision of court security services on behalf of the Crown under s 2C subject to the Financial Management Act 1994. Contracts must contain compliance clauses with this Act and other instruments, performance objectives, fee arrangements, periodic reporting, indemnities, and designate principal officers for FOI and Ombudsman purposes (s 2C-2D). The FOI Act applies to contractors as if they were an agency (s 2E), which increases the regulatory overlay for private providers.

Recording, publication and transmission prohibitions: The Act creates a tripartite control over reproducing court proceedings: making recordings (s 4A), publishing recordings (s 4B), and transmitting or giving recordings to others (s 4C). Each provision sets out who is permitted to record, publish or transmit. Permitted classes include Court Services Victoria staff acting in engagement (s 4A(2), 4C(2)); audio-only recordings by news media representatives or legal practitioners for specified purposes, subject to court directions (s 4A(3), 4C(3)); and express written permission by a judicial officer or prescribed classes (s 4A(4), 4B(2), 4C(4)). The Act cross-refers to the Open Courts Act 2013 and other statutes in a Note to s 3(2A)(d).

Health and pandemic considerations: The definition of “security, good order or management of the court premises” in s 2(2) was expanded in 2023 to explicitly include the health of persons at court premises in relation to a pandemic declaration, the following of any relevant pandemic order (s 2(2)(d)-(e)), and following relevant directions made by an authorised officer under Parts 8A or 10 of the Public Health and Wellbeing Act 2008 (s 2(2)(f)). These insertions allow authorised officers to issue directions related to health and public-health orders at court premises.

Police presence duty: The Act requires the Chief Commissioner of Police to direct an adequate number of police officers to keep order at sittings of the Supreme Court and County Court in their criminal jurisdiction, and to direct additional officers at the request of the presiding judge (s 3A). This sets an operational coordination point between courts and Victoria Police.

Regulatory and court-rule flexibility: The Governor in Council may make regulations for matters necessary to secure public order and safety in courts (s 6). Regulations may be tailored by time, place or class of court (s 6(2)). Powers to make rules of court in relation to the procedure of a court extend to rules for the purposes of this Act (s 7). The Act therefore contemplates a mix of statutory, regulatory and court-rule instruments to operationalise its concepts.

Savings and interaction with contempt powers: The Act expressly states that its powers are in addition to and do not derogate from any other powers possessed by courts, judges or persons in relation to conduct of proceedings, and that it does not affect contempt powers (s 5). That positions the Act as an administrative overlay, not a substitution for judicial disciplinary or contempt authority.

Taken together, these concepts allocate operational authority to authorised officers, create procurement and accountability pathways for outsourced security services, set criminal boundaries around prohibited items and audiovisual recording, and provide regulatory levers for courts and the Executive to tailor application by court, time and circumstance.

The Act’s reach covers a set of clear stakeholder groups and imposes distinct duties, constraints and implications on each.

Members of the public attending or seeking to enter court premises: The Act authorises the demand of name, address, reason for attendance and proof of identity (s 3(1)), and empowers authorised officers to require searches, scanning and surrender of prohibited items (s 3(3)). Persons who refuse to comply with lawful demands, give false information, or fail to comply with a direction risk criminal penalties measured in penalty units (s 3(2), (2B), (10)). Persons who carry firearms, explosives or offensive weapons without lawful excuse face an indictable offence with potential imprisonment (s 4). Practical effect: visitors, litigants, witnesses, counsel, jurors and members of the public lose certain privacy and physical autonomy at court entrances and face criminal exposure for non-compliance.

Judicial officers and the courts: Judicial officers retain residual authority to regulate proceedings and to give express written permission for recordings, publishing or transmission of recordings (s 4A(4), s 4B(2), s 4C(4)). The Act preserves and does not displace court powers including contempt (s 5). Courts also may issue directions which limit media and recording activities, and authorised officers must act subject to any limitations or restrictions provided by the rules (s 3(1), 3(2A)).

Authorised officers and police: Authorised officers are the operational agents empowered to enforce the Act (s 2(1) defn; s 2A). Police officers retain specific roles: Victorian police staff are included as authorised officers by definition and the Chief Commissioner has an independent duty to ensure police presence at certain criminal sittings (s 2(1) defn; s 3A). Police thus form the backbone of enforcement at criminal court sittings and are the statutory recipient for firearms/explosives/offensive weapons seized that would constitute an offence under other laws (s 3(8)(a)).

Court Services Victoria and contracting parties: Court Services Victoria may enter into court security agreements on behalf of the Crown and specify contractors to provide security services to a range of courts and prescribed tribunals, subject to the Financial Management Act 1994 (s 2C). Contractors must comply with the Act and other relevant instruments, meet performance standards, submit periodic reports, provide indemnities, and nominate principal officers for FOI and Ombudsman purposes (s 2D). The Freedom of Information Act 1982 applies to contractors in their capacity as providers under the Act as if they were an agency (s 2E). Consequently, private security providers can be obliged to act under public-sector-style transparency and accountability regimes.

News media organisations and legal practitioners: The Act places limits on making and publishing recordings of proceedings. It permits audio recordings for media representatives for preparing media reports and for Australian legal practitioners or other prescribed persons for legal representation, subject to any direction of a court (s 4A(3)). Publication and transmission are likewise regulated, and publishing or transmitting recordings absent judicial permission or legal authorisation can attract penalty units (s 4B, s 4C). Media organisations, broadcasters and legal firms must therefore adapt operational practices around how they record, share and publish content originating in courtrooms.

Persons in custody and detained individuals: The definition of security includes safety and welfare of persons in custody at court premises (s 2(2)(b)), and authorised officers have powers to use reasonable force and to escort persons (s 3(4), (2A)(b)). The Act therefore affects custodial management and interactions between custodial staff and authorised officers.

Employees and agents of Court Services Victoria and contractors: Court Services staff and authorised contractor employees may make recordings in the course of engagement or contract for court-related purposes such as preparation of official transcripts or as authorised under the Open Courts Act 2013 (s 4A(2); s 4C(2) example). Contractors are subject to FOI and Ombudsman oversight under contract terms and s 2E, which affects their record-keeping, disclosure obligations and administrative compliance costs.

Regulatory agencies and oversight bodies: The Act explicitly brings contractors within the scope of the Freedom of Information Act 1982 (s 2E) and designates a principal officer for Ombudsman Act 1973 purposes (s 2D(f)-(g)). That obliges oversight agencies to consider contractors as quasi-agencies for specified transparency and complaint functions.

Legislative and administrative actors: The Governor in Council may make regulations for public order and safety in courts, and courts retain rule-making power for procedural matters under the Act (s 6, 7). This affects those responsible for drafting rules, operational policies and infrastructure arrangements for courts.

In short, the Act affects a wide set of participants: the public entering courts, litigants, media and legal professionals, police and appointed authorised officers, private contractors and Court Services Victoria, and oversight agencies that receive FOI and Ombudsman responsibilities. The net effect is to place a layer of operational control and accountability over behaviour and physical access at court premises, while preserving judicial powers and enabling outsourced provision of security subject to public-sector-style oversight.

The Act distributes duties and limited rights across participants; many are operational and compliance-focused.

Duties of authorised officers:

• Must be appointed in accordance with s 2A and issued identity cards by the Chief Executive Officer of Court Services Victoria or the relevant court chief executive/clerk (s 2A; s 2B(1)-(2)).
• May exercise powers only subject to limitations or restrictions provided by the rules; their operational duties include demanding identity details (s 3(1)), giving directions to preserve security (s 3(2A)), conducting searches and requiring surrender of prohibited items (s 3(3)), using reasonable force where necessary (s 3(4)), seizing and retaining prohibited items (s 3(6)), and advising persons that non-compliance may be an offence (s 3(11)).
• Must not subject a person undergoing search to greater indignity than reasonably necessary (s 3(4A)). This creates a duty to constrain search conduct to what is proportionate for purpose.

Duties of persons on court premises:

• Must comply with lawful demands for name/address/reason for attendance and evidence of identity (s 3(1)). Failure, false information, or false identity evidence is an offence punishable by up to 10 penalty units (s 3(2)).
• Must comply with directions given under s 3(2A) unless the direction concerns recording/transmission/publication that is permitted by law (s 3(2B)-(2C)); contravention attracts a 10 penalty unit penalty (s 3(2B)).
• Must submit to frisk or scanning searches and surrender prohibited items when required (s 3(3)); s 3(10) imposes a 10 penalty unit penalty for non-compliance with subsection (3).
• Must comply with directions to stop making a recording or to permit viewing or deletion where an authorised officer reasonably suspects the recording/transmission/publication is not permitted (s 3(2A)(d)). Failure to comply may attract penalties under s 3(2B), and recording/publishing/transmission offences have distinct penalties under ss 4A-4C.

Duties of Court Services Victoria and contracting parties:

• Court Services Victoria may enter into agreements for court security provision subject to the Financial Management Act 1994 (s 2C). Agreements must secure contractor compliance with the Act and any other statutory instruments, set objectives and performance standards, fix fees, require periodic reporting, provide an indemnity to the Crown and Minister, designate offices for FOI and Ombudsman purposes, and include any prescribed matters (s 2D).
• A contractor under an agreement is subject to the Freedom of Information Act 1982 as if the contractor were an agency, with the designated principal officer as the principal officer for FOI, and the Minister as the responsible Minister (s 2E). This imposes FOI handling duties and Ombudsman accountability on contractors.

Duties and rights of media and legal representatives:

• Media representatives and Australian legal practitioners may, subject to any direction of a court, make audio recordings of proceedings for media reporting or legal representation respectively (s 4A(3)). Transmission of such audio recordings to internal staff or assisting persons is permitted subject to court direction (s 4C(3)). Publishing of recordings requires express written permission from a judicial officer or other permitted statutory pathways (s 4B).
• A person who publishes a recording and becomes aware that it is not permitted must take all reasonable steps to remove it (s 4B(3)). This imposes an active takedown obligation on publishers once they know a recording is not permitted.

Police duties and rights:

• The Chief Commissioner of Police must direct sufficient police officers to be present to keep order at sittings of the Supreme Court and County Court in their criminal jurisdictions, and may direct additional officers at the request of the presiding judge (s 3A). Police must receive firearms, explosives and offensive weapons seized that would otherwise constitute offences under other Acts within 24 hours (s 3(8)(a)).

Rights preserved for courts and judicial officers:

• Courts retain all existing powers in relation to the conduct of proceedings and the regulation of persons in court premises; the Act is explicit that its powers are in addition and do not derogate from court powers including contempt (s 5(1)-(2)).
• Judicial officers may give express written permission for recording, publishing or transmitting proceedings (s 4A(4), s 4B(2), s 4C(4)). That creates a gatekeeping role for judicial discretion over media access to recorded material.

Rights and protections for persons subject to searches:

• While authorised officers may use reasonable force and require searches, s 3(4A) limits subjecting a person to greater indignity than reasonably necessary. The Act also embeds the standard of “reasonable grounds” for believing an item is prohibited on seizure and surrender powers (s 3(3), (6)), which links enforcement to an objective-reasonableness test in the statute.

Administrative duties related to property:

• Seized or surrendered prohibited items other than firearms/explosives/offensive weapons which render possession an offence must be retained until requested or for 28 days, whichever first occurs (s 3(7)). If not collected within 28 days and not a firearm/explosive/offensive weapon that must be given to police, the chief executive officer or clerk may destroy or sell the item and retain the proceeds (s 3(8)(b)).

Regulatory duties:

• The Governor in Council may make regulations for matters necessary to secure public order and safety in courts, and the regulations may be tailored by court class, time or circumstances (s 6(1)-(2)). Courts’ rule-making powers extend to rules required by the Act (s 7).

Collectively, the Act imposes operational duties on authorised officers and contractors, compliance duties on people entering court premises and on media and legal actors in relation to recordings, and accountability duties on contractors under FOI and Ombudsman oversight. It preserves judicial decision-making authority for permitting recordings and publishing, while calibrating enforcement through “reasonable grounds”, prohibition definitions and procedural constraints such as dignity limits on searches.

Penalties in the Act are a mix of custodial indictable offences and monetary penalties measured in penalty units, and enforcement is allocated primarily to authorised officers with a structural role for police and courts.

Monetary penalties:

• False information or false identity evidence when required under s 3(1) is an offence with liability up to 10 penalty units (s 3(2)).
• Failure to comply with a direction under s 3(2A) is an offence with penalty 10 penalty units (s 3(2B)).
• Failure to comply with a requirement under s 3(3) (search requirements) attracts a 10 penalty unit penalty (s 3(10)).
• Not wearing the identity card or producing it when requested is treated as an offence against subsection s 2B(3) with a penalty indicated in the note as 5 penalty units.
• Recording, publishing or transmitting court proceedings intentionally contrary to the statutory permissions carries a 20 penalty unit penalty for each of the prohibitions under s 4A, s 4B and s 4C respectively.

Custodial and indictable offences:

• Carrying or having in possession on court premises a firearm, explosive substance or offensive weapon without lawful excuse is an indictable offence punishable by up to seven years imprisonment (s 4). The Act cross-references relevant offences in the Crimes Act 1958, Control of Weapons Act 1990 and the Firearms Act 1996 in its handling of seized items and in definitional cross-references (s 3(8)(a); s 2(1) defns).

Enforcement mechanisms:

• Authorised officers are empowered to demand identity details, require searches and surrender of items, seize and retain items, refuse entry or remove persons, and use reasonable force where necessary (s 3(1), (3), (4), (5), (6), (9)). These statutory powers enable on-the-spot compliance and immediate removal of perceived risks to court security.
• Authorised officers must advise persons that non-compliance may constitute an offence before or immediately after giving a direction or making a demand or requirement (s 3(11)). This procedural obligation supports enforcement by placing individuals on notice of criminal exposure.
• Where authorised officers find items they reasonably believe to be prohibited, they may seize and retain them, with distinct procedures depending on the item: firearms, explosives or offensive weapons that would constitute an offence under other Acts must be given to a police officer within 24 hours (s 3(8)(a)). Other items not collected within 28 days may be destroyed or sold and proceeds retained (s 3(8)(b)). That sets limits on property disposals and creates administrative duties for courts to process seized items.
• The Chief Commissioner of Police has a statutory duty to have sufficient police present to keep order during certain criminal sittings (s 3A). This embeds a policing resource allocation responsibility that links statutory compliance to operational policing.

Interaction with other statutory regimes and sanctions:

• The Act’s note and text cross-reference other statutes that regulate reporting, publication and recording of proceedings, including the Open Courts Act 2013, Judicial Proceedings Reports Act 1958, Family Violence Protection Act 2008 and Supreme Court Act 1986 (note to s 3(2A)(d)). This requires enforcement officers and would-be publishers to consider overlapping restrictions. The Act explicitly states that its powers are in addition to other powers conferred on courts and judges, and does not affect court contempt powers (s 5). Hence enforcement involves both administrative/criminal measures under this Act and residual judicial powers.

Standard of proof and reasonableness constraints:

• Several enforcement powers are bounded by statutory reasonableness tests. For example, seizure and requirement to surrender apply where an authorised officer “believes on reasonable grounds” an item is a prohibited item (s 3(3)(c), (6)). Directions to stop or delete recordings require the authorised officer to “reasonably suspect” that a recording/transmission/publication is not permitted by law (s 3(2A)(d)). Search conduct must avoid greater indignity than reasonably necessary (s 3(4A)). These standards build in an objective assessment that could be relevant to prosecution or judicial review of enforcement actions.

Due process and limited administrative remedy:

• The Act provides administrative processes for seized items (28-day retention, option to request return) and mandates handing of certain seized items to police (s 3(7)-(8)). For contractors, FOI and Ombudsman provisions (s 2D, 2E) create public accountability channels. The Act, however, does not itself prescribe detailed internal review processes for decisions to refuse entry, seize items or direct deletion; affected persons would rely on criminal defence processes, judicial oversight (for court-ordered permissions) and external oversight bodies for contractors subject to FOI and Ombudsman Act.

Practical enforcement implications:

• Authorised officers have broad, immediate enforcement tools at court premises including coercive measures such as removal and use of reasonable force. The penalties attached to non-compliance are modest relative to custodial exposure for weapons offences, but recording and publication prohibitions carry substantive monetary penalties that are likely to affect media and digital publishers. The combination of on-the-spot enforcement and statutory penalties creates an operational environment where authorised officers must make rapid, discretionary decisions that nevertheless must be tethered to “reasonable grounds” and the Act’s procedural instructions.

The Act explicitly cross-references several other statutory regimes and preserves other court powers. Those cross-references create overlapping compliance obligations and potential points of coordination or conflict.

Crimes Act 1958 and Firearms Act 1996; Control of Weapons Act 1990: Definitions and handling of firearms and explosive substances are cross-referenced. The Act defines “firearm” to have the same meaning as in the Firearms Act 1996 and “explosive substance” as in Division 8 of Part I of the Crimes Act 1958 (s 2(1) defns). Seized items that would constitute offences under these Acts must be given to a police officer within 24 hours (s 3(8)(a)). The interplay places the Court Security Act as an operational enforcement instrument that defers to the criminal-regulatory schemes governing weapons for prosecution and police handling.

Open Courts Act 2013, Judicial Proceedings Reports Act 1958, Family Violence Protection Act 2008 and Supreme Court Act 1986: The Act’s note to s 3(2A)(d) draws attention to the multiple statutory regimes that limit recording, publication and transmission of proceedings. The Open Courts Act 2013 in particular provides statutory guidance on openness and permissible reporting; s 4A-4C of the Court Security Act were designed to sit alongside those regimes (s 4A(2) examples refer to section 8B of the Open Courts Act 2013). This creates a multi-layered legal environment in which court permissions, specialist reporting restrictions, and court-order-based publishing restrictions interact.

Public Health and Wellbeing Act 2008: Amendments in 2023 added pandemic-related considerations into the Act’s definition of “security, good order or management of the court premises” (s 2(2)(d)-(f)). The Act now expressly allows following relevant pandemic orders and directions made by an authorised officer under Parts 8A or 10 of the Public Health and Wellbeing Act at court premises. This aligns court security powers with public-health powers and makes public-health orders a legitimate basis for authorised-officer directions (for example mask-wearing, distancing) at courts.

Freedom of Information Act 1982 and Ombudsman Act 1973: The Act requires court-security agreements to specify the office-holder who will be the principal officer for FOI and Ombudsman purposes (s 2D(f)-(g)). It also applies the FOI Act to contractors acting under court security agreements as if they were agencies, with the contractor’s nominee as principal officer and the Minister as responsible Minister (s 2E). That converts private contractors into FOI-accountable entities for the purpose of their court-security function, adding a transparency overlay and potentially subjecting sensitive operational records to FOI requests.

Financial Management Act 1994: Court Services Victoria and specified court officers may enter into court security agreements on behalf of the Crown subject to the Financial Management Act (s 2C). That requirement channels procurement and financial accountability for contracted security services through the Financial Management Act institutional structures.

Victoria Police Act 2013: The definitions of police officer, police custody officer and protective services officer refer to meanings in the Victoria Police Act 2013 (s 2(1) defns). The Chief Commissioner’s duty to have sufficient police present at criminal sittings sets an operational interaction between courts and Victoria Police (s 3A).

Control of procedural and contempt powers: Section 5 explicitly states that the Act’s powers are additional to existing court powers and do not affect contempt or similar court powers. This preserves the hierarchy where judicial orders and contempt powers remain available in parallel to the administrative powers under the Act (s 5(1)-(2)).

Regulatory and rule-making overlay: The Governor in Council can make regulations for matters necessary to secure public order and safety in the courts, and regulations may be tailored by court/class and circumstances (s 6(1)-(2)). Courts’ rules-making powers extend to rules for the purposes of the Act (s 7). This means the Act functions in practice together with regulations and court rules that fill in procedural detail and may vary by court.

Implications of these interactions:

• Contractors providing court security operate in a hybrid public-private regulatory space: procurement rules under the Financial Management Act and accountability under FOI and Ombudsman frameworks apply, while operational enforcement at court premises must align with criminal law and public-health orders.
• Recording and publication conduct must be assessed not only under the Act’s prohibitions but also under other statutory reporting regimes and court orders. An authorised officer’s direction to stop or delete a recording is valid only insofar as the recording is not permitted “by or under this Act or any other law” (s 3(2C)). That clause requires authorised officers to be aware of exemptions and permitted activities under other statutes.
• Police remain the statutory backstop for weapons that attract criminal liability, and the Chief Commissioner has responsibility for police resourcing at high-security criminal sittings. Courts and police therefore share operational responsibilities, especially in criminal jurisdiction settings.

In sum, the Act is designed to sit in a web of existing statutory regimes and institutional responsibilities, shaping operational practice at court premises while presupposing coordination with criminal law, FOI/Ombudsman oversight, procurement rules, police resourcing and public-health orders.

The Act has been amended repeatedly since its assent in 1980. The Act’s endnotes and table of amendments list the amending instruments and identify the specific provisions or insertion points. The notable amendment phases evident in the text are:

Late 1980s and 1990s: Early amendments updated definitions and adapted to wider reforms in court administration and weapons regulation. The Prescribed Weapons Act 1989 contributed to definitional changes (see Table of Amendments). The Courts and Tribunals (General Amendment) Act 1996 (No. 64/1996) was a major amending instrument that inserted sections relating to authorised officers, contractors, contract terms and search powers (ss 19-21, as reflected in s 2A, s 2C, s 2D and s 3 recodifications). The Firearms Act 1996 also provided cross-referenced definitions.

2004-2009: The Monetary Units Act 2004 (No. 10/2004) harmonised monetary penalties (s 3(2) amendment). Coroners and magistrate-court-related amendments adjusted the definition of “clerk” (Magistrates' Court (Consequential Amendments) Act 1989; Coroners Act 2008). The Criminal Procedure Amendment 2009 (No. 68/2009) inserted s 3A requiring police presence at certain criminal sittings.

2012-2016: The Integrity and Accountability Legislation Amendment Act 2012 and subsequent Court Services and courts-related Legislative Amendments continued to refine administrative duties and oversight, including formalising Court Services Victoria’s role. The Justice Legislation Further Amendment Act 2016 made court-specific procedural changes.

2014 suite of changes: The Courts Legislation Miscellaneous Amendments Act 2014 (No. 62/2014) introduced several definitional and structural changes. The 2014 amendments inserted the modern offences dealing with recordings and publication (ss 4A-4C) as indicated by the table: s 4A, 4B, 4C were inserted by No. 62/2014 s 77. That package also modernised terminology (for example "judicial officer" and "news media organisation" definitions).

2015-2017: The Justice Legislation Amendment (Police Custody Officers) Act 2015 adjusted definitions to include police custody officers and protective services officers (No. 59/2015). The Justice Legislation Amendment (Court Security, Juries and Other Matters) Act 2017 (No. 38/2017) made a series of further changes, including substitution of the authorised officer definition, enactment of appointment procedures in s 2A, identity card requirements in s 2B, the contracting regime in s 2C, and related contractual obligations in s 2D-2E. The 2017 amending provisions specifically came into effect on 11 October 2017 for sections 44-50 and section 80 on 30 August 2017 as recorded in the Table of Amendments.

2020-2021 COVID-era changes: The COVID-19 Omnibus (Emergency Measures) Act 2020 and its amendment in October 2020 adjusted some emergency measures; the Justice Legislation Amendment (System Enhancements and Other Matters) Act 2021 added further operational tweaks, including those reflected in s 3(9) changes recorded as commencing in 2021.

2021-2023 public health and recording amendments: The Public Health and Wellbeing Amendment (Pandemic Management) Act 2021 (No. 53/2021) and later Justice Legislation Amendment Act 2023 (No. 26/2023) inserted pandemic-relevant definitions and expanded s 2(2) to include pandemic declaration, pandemic order and following relevant directions made under Parts 8A or 10 of the Public Health and Wellbeing Act (s 2(2)(d)-(f)). The 2023 Justice Legislation Amendment Act also amended the recording, publishing and transmission provisions (s 4A-4C) to clarify scope and to add an express statutory allowance for publication on behalf of a court under the Open Courts Act 2013 for particular purposes (s 4B(2A)). The 2023 act came into effect on 11 October 2023 for multiple sections (s 3-6, 9-11).

Other consequential and transitional amendments: The endnotes include multiple Acts that amended definitional and structural elements over time, including the Legal Profession Uniform Law Application Act 2014, Victoria Police Amendment Act 2014 and others that reflect the evolving institutional landscape for courts and policing.

Transitional provisions: Section 8 contains transitional arrangements tied to the 2017 Justice Legislation Amendment, providing continuity for existing authorised officers and existing court security agreements so they remain in force for their term unless terminated earlier as of the 2017 changes.

What the amendment chronology shows in statutory mechanics terms:

• The Act has been progressively modernised to reflect outsourcing of security functions, the rise of media and electronic recordings, and public-health emergency considerations.
• The insertion of FOI and Ombudsman obligations for contractors (s 2D-2E) followed the move to contracting and evidences a deliberate policy to subject private providers to public accountability.
• Recording, publication and transmission provisions added in 2014 and refined through 2023 reflect an ongoing legislative calibration between open courts, media access and controlled courtroom security and privacy interests.

For legal practice and operational planning, the amendment history signals the need to monitor subordinate instruments (regulations and rules of court) and the decisions of Court Services Victoria and courts that give effect to contractual procurement, authorised-officer appointment, identity practices and court-specific recording permissions.

The statute text and the accompanying endnotes provided contain no reported cases or judicial decisions interpreting the Court Security Act 1980. The printed Act includes notes that reference other statutes which themselves have litigation histories, but the body of the Act as provided does not name any judicial authorities or list any case law.

Practical implications:

• With no cases named in the source materials, there is no statutoryly-contained judicial gloss in this version of the Act for courts or practitioners to cite. Any interpretation of key statutory standards such as “reasonable grounds”, “likely to affect adversely the security, good order or management of the court premises” or the scope of the recording/publishing prohibitions will depend on common interpretive principles and any later or external case law not recorded in the Act’s printed text.
• Operational actors, authorised officers, contractors and court administrators, must therefore rely on the Act’s text, regulations, rules of court and administrative guidance when applying the Act. Where enforcement decisions are contested, judicial review or criminal process could generate case law, but that is outside the Act’s printed endnotes.
• The absence of cited litigation in the source cautions that there might be unsettled questions in application (for example, the interplay between authorised-officer directions to delete material and protections for journalistic sources, or how “reasonable grounds” will be measured in practice) that have not been authoritatively resolved within the Act’s printed annotations.

For practitioners seeking authoritative interpretation, the lack of statute-contained case citations indicates the need to search judicial databases and legal reporting services for subsequent litigation or administrative decisions that interpret the Act’s operative provisions.

The Act contains particular provisions and drafting features that create operational traps, compliance friction points and areas where discretion is concentrated. These are practical "gotchas" for practitioners, contractors, court staff and media.

Broad territorial scope for powers: “Court premises” is defined very broadly to include precincts, immediate environs, adjacent car parks, footpaths and laneways between or abutting court premises and any place where a court is constituted for the time being (s 2(1) defn). That means authorised-officer powers reach beyond building entrances to nearby public spaces. Parties and operators must treat seemingly public areas adjacent to courts as within the Act’s operational footprint.

Vague catch-all for “prohibited item”: The definition of prohibited item includes “an item that is likely to affect adversely the security, good order or management of the court premises” (s 2(1) defn). This is fact-sensitive and gives authorised officers significant discretion to treat unusual or novel items as prohibited. Contractors and authorised officers should document criteria and training for assessments to avoid arbitrary or inconsistent enforcement challenges.

Overlap between authorised-officer directions and other legal permissions: Authorised officers can direct a person to stop recording, permit viewing of recordings on devices, or delete recordings where they reasonably suspect the recording/transmission/publication is not permitted by law (s 3(2A)(d)). However, s 3(2C) says a person does not contravene the compliance obligation if the recording, transmission or publication is permitted by or under this Act or any other law. That creates a compliance tension: persons asserting that their recording is legally permitted (for example, under a judicial permission or statutory exemption) must be prepared to show the legal basis, or risk arrestable non-compliance with a direction and a potential 10-penalty-unit fine (s 3(2B)). This is particularly salient for journalists and legal practitioners who rely on audio-only exceptions under s 4A(3) but may be challenged by authorised officers.

Immediate deletion directions and evidential loss: Authorised officers can direct deletion of a recording (s 3(2A)(d)(iii)). If an authorised officer orders deletion but the person believes the recording is permitted, immediate deletion can result in irrevocable loss of evidence. The Act does not set out a process for preserving contested recordings while dispute is resolved. The s 4B(3) takedown obligation applies after publication if a person becomes aware recording is not permitted, but there is no express statutory protection for those who refuse to delete on reasonable legal grounds and then face enforcement action.

Contracting plus FOI/Ombudsman overlay: Court Services Victoria can outsource security subject to the Financial Management Act (s 2C), and contractors are treated as FOI agencies for their provision of court security (s 2E). That imposes public-sector transparency and Ombudsman complaint risks on private contractors, which can increase compliance costs and expose operational records. Contractors must nominate principal officers under the contract for FOI and Ombudsman purposes (s 2D(f)-(g)). Private security firms used to purely private contractual confidentiality may not be structurally adapted to FOI and Ombudsman scrutiny without changes to procedures and resourcing.

Disposition of seized items: Non-weapon surrendered items may be destroyed or sold after 28 days if not collected (s 3(8)(b)). Contractors and court administrators must have processes for inventory, notice to owners, lawful sale or destruction, and accounting for proceeds, failure risks claims for conversion or administrative irregularity.

Identity-card obligations and modest enforcement: Authorised officers must wear identity cards while on duty and produce them on request; the penalty for non-observance is relatively small (5 penalty units indicated in the note to s 2B(3)). Operationally, small penalties may not suffice to deter misuse of authority, so contract oversight and internal discipline mechanisms will be important.

Recording rules apply separately to making, publishing and transmitting: The Act differentiates making (s 4A), publishing (s 4B) and transmitting (s 4C) a recording. Conduct may be lawful under one provision and unlawful under another. For example, a media representative may be permitted to make an audio recording for reporting under s 4A(3)(a) but publishing the recording still requires judicial permission under s 4B unless another statutory permission applies. Misreading these distinctions can lead to inadvertent contraventions.

Criminal versus administrative penalties and urgency of decisions: The Act creates both criminal penalties (for weapons offences and false identity) and administrative removals by authorised officers. The potential criminal exposure for non-compliance with directions (10 penalty units) or for carrying weapons (up to seven years imprisonment) means that split-second decisions by authorised officers may have significant consequences for individuals. This increases the importance of training, procedural safeguards for entry refusals, and clear signage.

Pandemic-related direction scope: The 2023 amendments incorporate pandemic orders and directions under the Public Health and Wellbeing Act into the concept of security at court premises (s 2(2)(d)-(f)). This gives authorised officers a basis to impose public-health-related directions. Operators and visitors must be aware that public-health rules can be enforced as part of court security, and that the Act’s enforcement tools apply to pandemic compliance at court sites.

No statutory internal review mechanism for removal or seizure: The Act provides retention windows and disposal rules for seized items (s 3(7)-(8)), but it does not prescribe an internal administrative review process for refusals of entry, directions to delete recordings, or contested seizures. Affected persons may need to rely on judicial processes, criminal defence, or FOI/Ombudsman complaints for contractors, this gap can delay remedies.

Taken together, these features create multiple operational and legal hazards that require careful policies: clear signage and visitor information, staff and contractor training on the scope and limits of powers, preserving recordings when legal bases are disputed, FOI-ready record-keeping for contractors, and robust chain-of-custody for seized items.

Compliance with the Court Security Act 1980 requires a combination of written policies, staff training, contracting diligence, signage, record-keeping and coordination with police and courts. The following practical checklist maps statutory obligations to concrete steps.

Governance and contracting

• If you are Court Services Victoria or a chief executive officer/clerk with contracting authority, ensure procurement for court security services follows the Financial Management Act 1994 and includes mandatory contract clauses under s 2D: compliance with the Act and other instruments; objectives and performance standards; fees and costs; periodic reporting obligations; indemnity to the Crown and Minister; nomination of a principal officer for FOI; nomination of a principal officer for Ombudsman; and any prescribed matters (s 2C-2D).
• Ensure the contract specifies FOI and Ombudsman contact points and that the contractor has FOI procedures, document retention and disclosure workflows compatible with public-sector FOI request handling (s 2D(f), (g); s 2E).

Appointment and identity of authorised officers

• Follow s 2A in appointments: the relevant decision maker (CEO of Court Services Victoria or local chief executive/clerk) must be satisfied of competence, good repute (character, honesty, integrity) and that the appointee has agreed in writing to exercise functions conferred (s 2A(3)-(4)). Keep written appointment records and declarations.
• Issue identity cards conforming to s 2B(2): photograph, authorised officer signature, and issuer’s signature. Require authorised officers to display the card visibly while on duty and to produce it on request (s 2B(3)). Maintain a register of ID cards issued and a process to report lost/stolen cards.

Operational policies for access control and searches

• Draft and publish (where practicable) clear signage and entry notices specifying that authorised officers may ask for name, address, reason for attendance and identity evidence (s 3(1)), may require searches (frisk and scanning) and surrender of prohibited items (s 3(3)), and may direct visitors to comply with security requirements (s 3(2A)). Signage reduces disputes and provides notice required by s 3(11) to tell a person they may commit an offence by non-compliance.
• Define operational procedures for frisk searches and scanning searches consistent with s 3(3), and embed the statutory limit in s 3(4A) requiring searches not to subject persons to greater indignity than reasonably necessary. Train authorised officers in proportionality, dignity, and documentation of grounds for searches.
• Create standard operating procedures (SOPs) for the handling of surrendered or seized items: record the item, notify the person, provide a receipt or notice, retain the item for 28 days where applicable, and provide processes for returning items on request within the 28-day window (s 3(7)). For firearms, explosives or offensive weapons that would be offences under other Acts, ensure immediate transfer to police within 24 hours (s 3(8)(a)). For items not collected in 28 days, establish lawful disposal or sale practices and accounting for proceeds (s 3(8)(b)).

Recording, publication and transmission protocols

• Publish a clear policy on recording and publishing court proceedings. Communicate the Act’s distinctions: making recordings (s 4A), publishing recordings (s 4B), transmitting or giving recordings (s 4C). Explain permitted categories (Court Services personnel acting in the course of engagement s 4A(2); media and legal practitioners permitted to make audio recordings subject to court direction s 4A(3); written judicial permission s 4A(4)/s 4B(2)/s 4C(4)).
• For media liaison, set up a predictable process for applying for express written permission from a judicial officer where publication is intended. Keep templates of permission requests and of judicial permission forms to expedite applications and to preserve legal bases for recordings.
• For legal practitioners, ensure briefing staff know that audio recordings for legal representation are permissible in principle under s 4A(3)(b), but remain subject to any direction of the court. Advise counsel that sharing such recordings internally must respect s 4C(3) conditions.
• Implement device-inspection SOPs: when an authorised officer requests to view a recording on a device pursuant to s 3(2A)(d)(ii), the authorised officer must be reasonable and consistent with s 3(2C). Ensure authorised officers have clear guidance on when they may direct deletion and how to document the basis for any deletion order to enable later review.

Training and procedural safeguards

• Train authorised officers to articulate “reasonable grounds” and “reasonable suspicion” when invoking search or deletion powers and to record contemporaneous reasons for searches, seizures and directions to delete recordings (s 3(3), (6), 3(2A)(d)). Good record-keeping will be essential should enforcement actions be challenged.
• Include training on the procedural obligation to advise persons that non-compliance may constitute an offence (s 3(11)). This step is required before or immediately after giving the direction, demand or requirement.

FOI, privacy and Ombudsman readiness

• Contractors must set up FOI handling teams, records management systems and privacy safeguards to comply with the FOI Act as applied by s 2E. Nominate the principal officer required by s 2D(f) to act as FOI contact and the Ombudsman contact specified in s 2D(g). Ensure staff understand what records are public and what may be exempt under FOI and other confidentiality laws.

Coordination with police and judicial offices

• Maintain close operational coordination with Victoria Police, especially since the Chief Commissioner has duties under s 3A to provide police presence at criminal sittings and since firearms/explosives/offensive weapons that are criminal should be delivered to police within 24 hours (s 3A; s 3(8)(a)). Establish escalation pathways and service-level agreements for transfer of seized items and for call-out of police for security incidents in court precincts.
• Liaise with registries and judicial chambers to manage applications for express written permission to record/publish, and keep copies of permissions for defence against potential publishing offences.

Record-keeping and audit trails

• Maintain logs of all searches, seizures, directions to delete or stop recordings, escorts and refusals of entry. Logs should include time, officer identity, grounds for action, the person affected, witness details, item inventories, and chain-of-custody records for seized items. These logs support accountability, FOI responses and Ombudsman investigations.

Signage and public information

• Post public-facing notices at entries and on court websites summarising the Act’s operational requirements: that searches may be required, prohibited items are banned, certain recordings are restricted, and that authorised officers may give directions. Clear notice reduces disputes and supports enforcement.

Contingency and legal review

• Create a legal-review pathway for contested scenarios: disputed deletion directions, claims that a recording is permitted under other law, or seizure challenges. Rapid legal advice can avoid irreversible deletions or improper disposals.
• For contractors, ensure insurance covers indemnity obligations in s 2D(e) and that contract terms allocate risk for FOI and Ombudsman liabilities, and for damages stemming from improper use of force or wrongful seizure.

Pandemic and public-health compliance

• Incorporate pandemic-order compliance into entry protocols in line with s 2(2)(d)-(f). Ensure authorised-officer training covers directions that implement public-health orders and how these interact with other security directions.

Regulatory and court-rule updates

• Monitor regulations under s 6 and rules of court under s 7 that modify or detail limitations, including those that differ by court, time or place (s 6(2)). Update SOPs when regulations or court rules change.

By implementing the measures above, documented procurement compliance, rigorous appointment and identity processes, clear SOPs for searches and seizure, protocols for recordings and publishing, FOI/Ombudsman readiness, record-keeping and police coordination, courts, contractors and practitioners will better align operational practice with the obligations and constraints established by the Act.
