6812 Application of div 6.10.8 to letter of request The provisions of this division about the examination of a person under an examination order apply, with any necessary changes, to a proceeding for the taking of evidence of a person under a letter of request issued under an examination order— (a) as if the court or tribunal taking the evidence were an examiner appointed under this division; but (b) subject to— (i) the terms of the letter of request; and (ii) if the court or tribunal is a court or tribunal of a foreign country—any convention dealing with the examination of witnesses to which Australia and the foreign country are parties.
