6766 Disposal of exhibits
(a) the registrar has given notice to someone under rule 6763 (4) (b)
in relation to an exhibit; and
(b) at the end of 3 months after the day the notice is given, the
exhibit has not been collected from the registry.
Note For the disposal of a document or thing produced on subpoena by a party
that is not an exhibit, see r 6608 (Removal, return, inspection etc of
subpoenaed documents and things).
(2) The registrar may destroy or otherwise dispose of the exhibit in the
way the registrar considers appropriate.
(3) The registrar may apply to the court at any time for an order about the
return, destruction or other disposal of an exhibit.
(4) If the registrar returns, destroys or otherwise disposes of an exhibit
under rule 6763 (Duty of parties to claim exhibits) or this rule, the
registrar must ensure a note is placed on the court file specifying the
exhibit and details of the person to whom it was returned or the way
in which it was destroyed or otherwise disposed of.
(5) This rule applies subject to any direction of the court under rule 6608.
