6753 Coincidence evidence notice A notice of intention to adduce coincidence evidence under the Evidence Act, section 98 must be in accordance with the form approved under the Court Procedures Act 2004, section 8 for section 98. Note The Evidence Act, s 100 (2) provides that the court may, on the application of a party, direct that the coincidence rule is not to apply to particular coincidence evidence despite the party’s failure to give notice under s 98.
