6752 Tendency evidence notice
A notice of intention to adduce tendency evidence under the Evidence
Act, section 97 must be in accordance with the form approved under
the Court Procedures Act 2004, section 8 for section 97.
Note The Evidence Act, s 100 (1) provides that the court may, on the
application of a party, direct that the tendency rule is not to apply to
particular tendency evidence despite the party’s failure to give notice
under s 97.
