6010 Application in proceeding—absence of party
The court may hear and decide an application in a proceeding in the
absence of a party to the proceeding if—
(a) service of the application on the absent party is not required
under these rules or by an order of the court; or
(b) the application has been served on the absent party in
accordance with these rules; or
(c) these rules provide that the application may be heard in the
absence of the party.
