5773 Reference appeals to Court of Appeal—notice of intention to respond by interested party (1) An interested party may file in the court a notice of intention to respond in accordance with division 2.3.1 (Notice of intention to (b) the party were a defendant; and (c) the applicant were the plaintiff; and (2) If an interested party is not represented in the appeal, counsel instructed by the applicant under the Supreme Court Act 1933, section 37S (5) represents the party and must file the notice of intention to respond as mentioned in subrule (1).
