5405 Appeals to Court of Appeal—time for filing notice of
appeal and case summary
(1) The notice of appeal and case summary must be filed in the court—
(a) if leave to appeal has been given—
(i) not later than 7 days after the day leave to appeal is given,
or not later than any further time allowed by the Court of
Appeal on application filed in the court before the end of
the 7-day period; or
(ii) if the Court of Appeal sets a time for the filing when giving
leave to appeal—not later than the time set, or not later than
any further time allowed by the Court of Appeal on
application filed in the court before the end of the time set;
or
(b) in any other case—not later than 28 days after the day the order
appealed from was made, or not later than any further time the
Supreme Court allows on application filed in the court before
the end of the 28-day period.
Note Div 5.4.3 (Appeals to Court of Appeal—leave to appeal out of time from
final judgments) applies to an application for further time.
(2) However, the Court of Appeal may, at any time and for special
reasons, give leave to file a notice of appeal and case summary.
