5192 Appeals to Supreme Court—matter happening in court or
tribunal appealed from
(1) In an appeal or application to the Supreme Court under this part, if a
question arises about something that happened or may have happened
in the court or tribunal that made the order appealed from (or sought
to be appealed from), the Supreme Court may have regard to the
material it considers appropriate.
(2) Without limiting subrule (1), the Supreme Court may—
(a) call for a report from the court or tribunal; and
(b) if the contents of the report have been made available to the
parties to the appeal—act on the report.
