5086 Appeals to Supreme Court—notice of intention to
respond to application for leave to appeal out of time
(1) A respondent to the application for leave to appeal out of time must
file in the Supreme Court a notice of intention to respond in
accordance with division 2.3.1 (Notice of intention to respond and
defence—general) as if—
(2) To remove any doubt, if the application for leave to appeal is a single
application mentioned in rule 5082 (3) (Appeals to Supreme Court—
application for leave to appeal out of time), the respondent need only
file a single notice of intention to respond.
