4051 Criminal proceedings—defence response to prosecutor’s
opening address
If an accused person, or the person’s counsel, makes an opening
response to the prosecutor’s opening address in a trial, the response—
(a) must identify the acts, facts, matters and circumstances with
which issue is taken in the prosecutor’s opening address and the
basis on which issue is taken; and
(b) must not state facts that cannot be supported by evidence to be
presented, or that has been presented, at the trial.
