3963 Arbitration—award not greater than submission or
(a) an employer to an arbitration has submitted to an award, or paid
an amount into court, and given notice under rule 3955,
rule 3956 or rule 3957; and
(b) the award on arbitration is not more than the amount submitted
to or paid.
(2) The employer is not liable to pay the costs of a party in whose favour
the submission or payment is made that were incurred by the party
after the party received notice about the submission or payment.
(3) The court may—
(a) order that any costs incurred by the employer after giving notice
under rule 3955, rule 3956 or rule 3957 be paid by any party
who has not accepted the amount submitted to or paid; and
(b) order that the costs be set off against any costs payable to the
party or be deducted from any amount awarded to the party.
(4) The court may also—
(a) order that any costs incurred by a party who accepted the amount
submitted to or paid after receiving the notice be paid by any
other party who has not accepted the amount; and
(b) order that the costs be set off against any costs payable to the
party or be deducted from any amount awarded to the party.
