3962 Arbitration—no prompt acceptance of submission or
(1) This rule applies if a party given a notice under rule 3955, rule 3956
or rule 3957 does not accept the amount of compensation mentioned
in the notice within a reasonable time after receiving the notice.
(2) The party may accept the amount at any time before the arbitration
starts.
(3) However, if the party accepts the amount, the party is liable to pay
the costs the court is satisfied were reasonably incurred by the
employer after the day the employer filed the notice or made the
payment into court.

(4) The court may order that the costs payable by a party under
subrule (3) be set off against any costs payable to the party, or be
deducted from any amount awarded to the party.
