3959 Arbitration—acceptance of payment for deceased worker
(1) This rule applies if an employer files a notice under rule 3956
(Arbitration—admission of liability to claim for deceased worker) in
relation to a claim made by a dependant, or the personal
representative, of a deceased worker.
(2) The applicant dependant or personal representative may accept the
amount of compensation in satisfaction of the claim by giving written
notice of the acceptance to the employer, registrar and any other
(3) If a respondent other than the employer is willing to accept the
amount of compensation in satisfaction of the claim, the respondent
may accept the amount of compensation in the same way as the
applicant dependant or personal representative.
(4) Notice under subrule (2) must be given within a reasonable time
before the day set for the arbitration, taking into consideration the
time the employer filed the notice under rule 3956.
