3352 Application—pt 3.6
This part applies only to the Supreme Court when exercising its
jurisdiction as the Court of Disputed Elections.
Note The Electoral Act, s 252 (1) (Court of Disputed Elections) provides that
the Supreme Court has jurisdiction to hear and decide—
(a) applications disputing the validity of elections; and
(b) questions referred to the Supreme Court by resolution of the
Assembly relating to the eligibility of people who have been
declared elected to be members of the Assembly or vacancies in
the membership of the Assembly.
That Act, s 252 (2) provides that, when exercising jurisdiction under
s 252 (1), the Supreme Court is to be known as the Court of Disputed
Elections.
