3257 Commercial arbitration—offers of compromise
(1) A party to an arbitration agreement may at any time, by written notice,
make an offer to another party to the agreement to compromise any
claim to which the agreement applies, either in whole or in part, on
stated terms.
(2) Part 2.10 (Offers of compromise) applies, with necessary changes, in
relation to the offer as if—
(a) the arbitration were a proceeding; and
(b) the respondent were a defendant who has made or received an
offer of compromise in the proceeding; and
(c) the claimant were the plaintiff who has made or received an offer
of compromise in the proceeding; and
(d) the other parties to the agreement were other parties to the
