1165 Notice of discontinuance or withdrawal (1) A discontinuance or withdrawal for which the court’s leave is not required may be made by filing a notice of discontinuance or withdrawal and serving a stamped copy of the notice on the other active parties to the proceeding. Note 1 See approved form 2.37 (Notice of discontinuance or withdrawal) AF2006-282. Note 2 A party may withdraw an admission made in a pleading only with the court’s leave (see r 492 (Admissions—withdrawal)). (2) A discontinuance or withdrawal for which the court’s leave is required is made by the order giving leave and a notice of discontinuance or withdrawal is not required.
