County Court (Oath and Affirmation of Office) Regulations 2024

The Regulations work around three tightly defined concepts: prescription of form, prescription of manner, and authorisation under the parent Act. The authorising provision is regulation 2, which records that the Regulations are made under section 79A of the County Court Act 1958. The operative prescription appears in regulation 5, which explicitly ties the Regulations to section 17PA(1) of the County Court Act 1958 by stating "For the purposes of section 17PA(1) of the County Court Act 1958, (a) the prescribed form is set out in Schedule 1; and (b) the prescribed manner is that the oath or affirmation of office must be administered by the Chief Judge or another judge."

"Prescribed form" The Schedule provides two textual routes. The oath version begins "I, [full name], swear by Almighty God [or the person may name a god recognised by the person's religion] that as a judicial registrar of the County Court in the State of Victoria, I will at all times and in all things discharge the duties of my office according to law and to the best of my knowledge and ability without fear, favour, affection or ill-will." The affirmation is a secular equivalent, beginning "I, [full name], solemnly and sincerely declare and affirm that as a judicial registrar ... I will at all times ... discharge the duties ... without fear, favour, affection or ill-will." The common core element across both texts is a commitment to discharge duties "according to law" and "to the best of my knowledge and ability" and a promise of impartiality expressed by the clause "without fear, favour, affection or ill-will" (Schedule 1).

"Prescribed manner" The Regulations eliminate discretion about who may administer the oath or affirmation by mandating that it must be administered by the Chief Judge or another judge. There is no express alternative or delegation provision within the Regulations themselves; the only named administrators are the Chief Judge and judges (reg 5(b)).

Revocation and temporal effect The Regulations revoke the 2014 instruments (reg 4) and commence on 13 October 2024 (reg 3). The Endnotes record the date of making, and the sunset 10 years after making under the Subordinate Legislation Act 1994. The Interpretation of Legislation Act 1984 material in the Endnotes is incorporated as background for structural matters such as headings forming part of the Statutory Rule, punctuation forming part of the Statutory Rule and the location of legislative items.

Relationship to the parent Act The Regulations are expressly made under s 79A of the County Court Act 1958 (reg 2) and they operate for the purposes of s 17PA(1) (reg 5). The Regulations do not restate or alter other provisions of the County Court Act 1958, nor do they add duties beyond the oath/affirmation text and the administrative requirement as to who must administer it.

Directly affected persons The primary and immediate subjects of the Regulations are persons appointed as judicial registrars of the County Court. The Schedule expressly references "as a judicial registrar of the County Court in the State of Victoria" as the capacity in which the oath or affirmation is taken. The instrument therefore applies to anyone appointed to that office who is required by section 17PA(1) of the County Court Act 1958 to take an oath or affirmation of office. The Regulations do not themselves define "judicial registrar"; any statutory meaning will sit in the County Court Act 1958 or other enabling instruments.

Decision-makers The Regulations assign the role of administering the oath or affirmation to the Chief Judge or another judge (reg 5(b)). Practically, that places the Chief Judge and other County Court judges in the decision loop for timing and administration. The text gives the Chief Judge the explicit role of administrator and, by naming "another judge", permits judges other than the Chief Judge to perform the act. The instrument does not specify whether acting judges, visiting judges or magistrates may fulfil the role, nor does it provide a mechanism for further delegation.

Administrative actors The County Court registry and registry staff will be involved in arranging the administration, maintaining records and ensuring documentary compliance with the form set out in Schedule 1. The Regulations do not prescribe record-keeping, but the administrative reality of giving the oath or affirmation and documenting that it occurred will fall on court administrators.

Indirectly affected persons Parties and practitioners who interact with judicial registrars may be indirectly affected by the formalisation of the oath/affirmation. The Schedule sets an express promise to act "according to law" and "without fear, favour, affection or ill-will" (Schedule 1). That textual commitment is intended to signal impartiality and fidelity to law. While the Regulations do not create new remedies or procedural consequences for litigants, the formal wording may be relied upon in submissions or assertions about the role and obligations of judicial registrars, because the language defines the commitment those officers have sworn or affirmed.

Other instruments and sunset The Endnotes show the Regulations were made on 17 September 2024 and came into operation on 13 October 2024 (Endnotes, "General information"). They will sunset on 17 September 2034 under the Subordinate Legislation Act 1994, which means that persons and offices affected should treat the Regulations as time-bound unless re-made or saved under the Act noted.

Who does not appear to be affected The Regulations do not address judicial officers other than judicial registrars. The text is confined to "judicial registrars of the County Court" and does not purport to prescribe oaths for judges, magistrates or other court officers. The instrument therefore leaves in place whatever separate processes apply to those other categories, unless those processes are addressed elsewhere in the County Court Act 1958 or other subordinate instruments.

Duty to take prescribed oath or affirmation The Regulations operate to prescribe both the form and the manner of the oath or affirmation that judicial registrars must take for the purposes of section 17PA(1) of the County Court Act 1958 (reg 5). This produces a duty, post-appointment, on the person occupying the office to undertake one of the two prescribed texts as their oath or affirmation of office. The Regulations do not specify timing relative to appointment, nor do they specify any consequences within the Regulations themselves for failing to take the oath or affirmation; those matters will be governed by the parent statute, that is section 17PA(1) and other provisions of the County Court Act 1958.

Content obligations embedded in the text The Schedule contains the substantive commitments the office-holder must make when taking the oath or affirmation. Both texts commit the judicial registrar to discharge the duties of the office "according to law" and "to the best of my knowledge and ability" and to do so "without fear, favour, affection or ill-will" (Schedule 1). Those phrases import standards of legality, competence and impartiality into the formal record of the appointment. Practically, that means the oath or affirmation itself expresses expectations about conduct; whether and how those words are used as the basis for discipline, removal, or other consequences will depend on the parent Act and any disciplinary framework applicable to judicial registrars.

Choice of religious or secular form The instrument provides both an oath and an affirmation, allowing the appointee to choose between a religiously framed oath, which includes the optional religiously specific naming of a god, and a secular affirmation. The religious oath text includes "[or the person may name a god recognised by the person's religion]" (Schedule 1). That textual choice creates a right of selection for the appointee between the two modes, subject to the requirement that one of the prescribed texts must be used.

Administration by judiciary The duty to have the oath or affirmation administered by the Chief Judge or another judge (reg 5(b)) creates an administrative obligation on the court to arrange such administration and on the Chief Judge or a judge to perform the prescribed act. The Regulations do not provide alternative administrators, nor do they set procedural formality beyond who administers and what wording is used.

Revocation of previous instrument The revocation in regulation 4 removes the County Court (Oath and Affirmation of Office) Regulations 2014. That change transfers any reliance on the 2014 text to the new Schedule 1 wording for future appointments and for any purposes for which the 2014 Regulations were previously relied upon. The Regulations do not expressly state transitional arrangements, such as whether persons who took the previous oath must re-swear under the new wording. Any such consequence must be sought in the parent Act or other instruments, as the Regulations themselves are silent on that point.

Rights and remedies The Regulations do not create an express right of challenge, appeal, or remedy tied to non-compliance with the prescribed form or manner. Any legal consequences of deviation will depend on the County Court Act 1958 and any applicable rules of court or administrative procedure. The text is confined to prescribing the wording and the manner of administration.

No penalties are set out in the Regulations themselves. The instrument contains no provision imposing fines, imprisonment or specific disciplinary measures for breach of the prescribed form or manner. Regulation 5 prescribes the form and manner for the purposes of section 17PA(1) of the County Court Act 1958, but the Regulations do not on their face attach sanctions to failure to follow the prescription. Enforcement mechanisms, if any, are therefore external to the Regulations and must be sourced in the parent Act or other applicable statutory or procedural frameworks.

Who enforces The Regulations name the Chief Judge and other judges as the persons who must administer the oath or affirmation (reg 5(b)). In practical terms, authority and responsibility for compliance will sit with the County Court leadership and administration. Any enforcement action in relation to the office-holder's performance or conduct is likely to derive from judicial governance frameworks in the County Court Act 1958 or other instruments, not from these Regulations themselves. The Regulations do not create an inspectorate, complaint mechanism, or direct enforcement body.

Proof of compliance The Regulations do not prescribe documentary proof or formal registration of the taking of the oath or affirmation. Standard administrative practice would be to keep a record that the oath or affirmation was administered and to retain the text signed or otherwise documented, but the Regulations do not mandate the form of that record. If proof of compliance were necessary for legal or employment purposes, the institution responsible for appointments, and the County Court registry, would be the practical locations to look for contemporaneous records.

Sunset and ongoing enforceability The Endnotes record that the Regulations will sunset 10 years after making, on 17 September 2034 (Endnotes, "General information"). Sunset under the Subordinate Legislation Act 1994 means that, absent re-enactment, the Regulations will cease to have effect on that date. Enforcement or reliance on the Regulations after sunset will therefore be precluded. Any enforcement activity or decision-making which depends on these Regulations should account for that temporal limit.

Interaction with the parent Act for enforcement The Regulations state they are made under section 79A and operate for the purposes of section 17PA(1) of the County Court Act 1958 (regs 2 and 5). If section 17PA(1) contains enforcement, removal or disqualification mechanisms tied to the taking of an oath or affirmation, then those mechanisms would be the source of any penalties for non-compliance; the Regulations themselves do not duplicate or create penalties.

Authorisation and purpose The Regulations are explicitly made under section 79A of the County Court Act 1958 (reg 2), and they operate "for the purposes of section 17PA(1) of the County Court Act 1958" (reg 5). The Regulations therefore sit as subordinate legislation to the County Court Act 1958 and must be read in that statutory context. The Regulations do not attempt to alter other substantive provisions of the County Court Act 1958; their function is to prescribe procedural detail for a statutory requirement present in the parent Act.

Revocation of previous subordinate instrument The Regulations revoke the County Court (Oath and Affirmation of Office) Regulations 2014 (reg 4). That means the 2014 instrument is removed from the statutory landscape for the matters covered by these Regulations. Any references in other instruments to the revoked 2014 Regulations will need to be read as referencing these Regulations where appropriate, bearing in mind differences in wording and administration.

Effect of the Interpretation of Legislation Act 1984 material The Endnotes reproduce interpretive material that arises from the Interpretation of Legislation Act 1984, including the treatment of headings, examples, diagrams, notes and punctuation as forming part of a statutory rule made on or after 1 January 2001 (Endnotes, "Interpretation"). That material affects how the Regulations are read and how ancillary material printed with the Regulations is treated. Practitioners should treat headings and the punctuation in the Schedule as being part of the legal text of the Regulations, because the Endnotes incorporate those interpretive rules.

Sunset regime and the Subordinate Legislation Act 1994 The Endnotes state the Regulations will sunset 10 years after the day of making under section 5 of the Subordinate Legislation Act 1994 (Endnotes, "General information"). The presence of a statutory sunset under the Subordinate Legislation Act places these Regulations in the broader subordinate legislation lifecycle governed by that Act. Practitioners relying on these Regulations for long-term planning should be mindful that the instrument will cease to operate on the sunset date unless re-made or extended under the relevant statutory procedures.

No cross-references to other statutory oath models within the Regulations The Regulations are self-contained with respect to the wording of the oath and affirmation and do not cross-reference oaths for other offices or other statutes. They do not, for example, adopt a general public sector oath or refer to the Oaths Act or to other model oaths. Any relationship between the wording here and other legislative oaths must be established by comparing texts in those other statutes; the Regulations themselves do not make that comparison or create uniformity beyond the County Court judicial registrar office.

Silence on transition and historic oaths The Regulations revoke the 2014 instrument but are silent on whether persons who previously took the 2014 oath need to re-take the new prescribed form. That silence means transitional treatment depends on the parent Act, any savings provisions, or administrative policy. The Regulations do not themselves create transitional provisions that would interact with, for example, employment law, continuation in office, or judicial review consequences.

Making and commencement The Endnotes record that these Regulations were made on 17 September 2024 by the Governor in Council under section 79A of the County Court Act 1958 and came into operation on 13 October 2024 (Endnotes, "General information"; regs 2 and 3). That provides a clear timeline for legal effect: made 17 September 2024, operative 13 October 2024.

Revocation of previous instrument Regulation 4 revokes the County Court (Oath and Affirmation of Office) Regulations 2014. The 2014 instrument is therefore replaced in whole by the 2024 Regulations for the matters covered. The Explanatory Details at item 1 also record the prior instrument reference S.R. No. 157/2014 (Endnotes, "Explanatory details").

No subsequent amendments recorded The Endnotes include a Table of Amendments section which records that "There are no amendments made to the County Court (Oath and Affirmation of Office) Regulations 2024 by statutory rules, subordinate instruments and Acts" (Endnotes, "Table of Amendments"). That indicates the instrument has not been amended since it was made and that the version as at 13 October 2024 stands as the only version to date.

Sunset schedule The Endnotes specify that the Regulations will sunset 10 years after the day of making on 17 September 2034 in accordance with section 5 of the Subordinate Legislation Act 1994 (Endnotes, "General information"). That is a temporal limitation on the continued operation of these Regulations absent re-enactment or saving provisions in the enabling legislation.

Interpretation Act style and structural changes The Endnotes reproduce provisions from the Interpretation of Legislation Act 1984 that affect how the Regulations are to be read, for example that headings, punctuation, and examples form part of a Statutory Rule made on or after 1 January 2001 (Endnotes, "Interpretation"). These are not amendments to these Regulations but statutory interpretive rules that have effect on the Regulations' textual construction.

No amendments history beyond revocation The only change recorded relative to the prior rules is the revocation in regulation 4. The 2014 Regulations are revoked and replaced. The instrument does not include a history of incremental amendments, savings provisions, or transitional arrangements beyond the revocation and the sunset. Any future amendments would need to be made under the authorising provision stated in regulation 2, that is s 79A of the County Court Act 1958.

Administrative provenance The Endnotes make clear who made the Regulations, that is the Governor in Council, and under which statutory head of power (reg 2; Endnotes, "General information"). That provenance is relevant if one is tracing inter-instrumental changes or examining whether further amendments are likely to be made by the same procedure.

The Regulations, as supplied, contain no recorded litigation history. The Endnotes and the body of the Regulations do not cite any case law, decisions or judicial interpretation relating to the 2024 Regulations. The Table of Amendments likewise records no subordinate instruments, statutory rules or Acts that have amended these Regulations since they were made (Endnotes, "Table of Amendments").

What the source records The only legal-history items included in the instrument are procedural: the making date (17 September 2024), the commencement date (13 October 2024) and the revocation of the 2014 instrument (reg 4). The Endnotes also include interpretive material from the Interpretation of Legislation Act 1984 and the note that the Regulations will sunset in 2034. None of that material records judicial testing of the Regulations in litigation.

Practical consequences of absence of litigation history The lack of litigation history in the instrument indicates there are no reported judicial rulings included in the Rules' printed materials up to the version date. For users seeking binding judicial interpretation of the phraseology such as "without fear, favour, affection or ill-will" or the scope of who qualifies as a person authorised to administer the oath, there is no guidance in this instrument. Any disputes about interpretation or consequences of failing to follow the prescribed manner will need to be brought to the courts and, until decided, remain matters of statutory construction and administrative practice rather than settled case law.

Where litigation might arise, based on the text Litigation could potentially engage issues such as whether the administration requirement in reg 5(b) permits remote administration, whether an administrator other than a judge may be authorised by necessity, or whether deviation from the prescribed form has legal consequences for the validity of an appointment under section 17PA(1). The Regulations themselves do not address these contingencies; any judicial resolution would have to rely on the County Court Act 1958, common law principles and the court's interpretive practice. None of those possibilities are recorded as having been litigated in the materials supplied.

Records and evidence in litigation In any future litigation concerning the taking or validity of an oath or affirmation under these Regulations, the primary evidence will be the text in Schedule 1 and any administrative record demonstrating that the Chief Judge or another judge administered the oath or affirmation. The Regulations do not prescribe the form of such evidence, but the Schedule provides the mandatory wording that a court would compare against any contested record.

Mandatory administrator wording is narrow The Regulations require that the oath or affirmation "must be administered by the Chief Judge or another judge" (reg 5(b)). That provision is specific and leaves no express space for delegation to non-judicial officials, registry officers, commissioners for oaths, magistrates, or via technological proxies, unless such delegation is authorised elsewhere in statute or by established court practice. The Regulations do not clarify whether "another judge" includes acting, temporary, visiting or part-time judges, nor do they address remote administration. The narrow wording can create practical friction if the Chief Judge or an available judge cannot be present at the time of appointment.

No timing or procedural detail The Regulations do not prescribe when the oath or affirmation must be taken relative to appointment, when the administration must be recorded, or where it must occur. Those are gaps that practising lawyers and administrators must fill using the parent Act, court practice notes, or administrative policy. The silence means there is potential for administrative uncertainty about whether an appointee who begins performing functions before taking the prescribed form is validly holding office.

Revocation without transitional instruction The 2014 Regulations are revoked (reg 4) and there are no transitional provisions in the 2024 Regulations. The instrument does not state whether persons who took the 2014 oath need to re-swear under the new wording, whether instruments signed under the 2014 text retain their legal effect as to earlier acts, or whether the revocation alters any past record. That can lead to ambiguity when dealing with legacy appointments or when questions arise as to whether earlier proceedings before a judicial registrar are affected.

Choice of wording has limited flexibility The Schedule fixes precise wording, including the phrase "without fear, favour, affection or ill-will" (Schedule 1). The text allows an appointee to choose between oath and affirmation and to name a god in the religious oath, but the rest of the wording is mandatory. If an appointee wishes to vary the pledge language for religious, philosophical, or capacity reasons, the Regulations offer no mechanism for authorised modification. Any permitted variation must therefore be sourced elsewhere in law or policy.

No penalties or enforcement mechanisms in the Regulations The absence of enforcement or penalty provisions in the Regulations means those seeking to rely on the prescribed form as a ground for challenge must locate enforcement mechanisms in the County Court Act 1958 or other rules. That can complicate attempts to secure remedies where non-compliance is alleged, because the Regulations do not themselves supply procedural tools.

Sunset timing may affect long-term planning The Regulations will sunset on 17 September 2034, ten years after making, per the Endnotes. Parties planning institutional or human-resource arrangements over the long term should note the sunset date. If re-enactment is not assured, the legal requirement to use these precise forms will lapse, potentially creating a succession of different prescribed texts over time.

Interpretation Act effects on textual elements The Endnotes indicate that headings and punctuation form part of the statutory rule under the Interpretation of Legislation Act 1984 (Endnotes, "Interpretation"). Practitioners should therefore treat the brackets and parenthetical options in the Schedule, and the exact punctuation, as part of the legal text rather than mere drafting flourishes.

Possible reliance on the wording in litigation or submissions The oath and affirmation include the promise to act "according to law" and "without fear, favour, affection or ill-will" (Schedule 1). Those phrases may be invoked in arguments about a judicial registrar's impartiality or duty. Because the Regulations provide no guidance on how those commitments interact with other obligations or disciplinary rules, reliance on them in contesting conduct will require careful cross-referencing to the County Court Act 1958 and any existing standards of judicial conduct.

Checklist for administration and appointment 1) Confirm statutory basis and timing: ensure the requirement to take an oath or affirmation arises under section 17PA(1) of the County Court Act 1958 and schedule the administration in accordance with the court's appointment timeline. The Regulations came into operation on 13 October 2024 (reg 3), so ensure the relevant appointment date is treated consistently with that commencement. 2) Choose text: provide the appointee with the exact prescribed wording in Schedule 1 and allow the appointee to select either the oath or the affirmation. If the oath is chosen and the appointee wishes to name a god recognised by their religion, include that naming phrase precisely as provided in the Schedule. 3) Arrange administrator: secure the Chief Judge or another judge to administer the oath or affirmation, noting that the Regulations specify those persons only (reg 5(b)). 4) Record the act: although the Regulations do not mandate a specific form of record, keep a formal record that the prescribed text was administered by the Chief Judge or another judge on the relevant date. That record should include the full name inserted into the text, the chosen form (oath or affirmation), the date, and the name of the administering judge.

Practical steps for registries and administrators Registries should prepare a standard form containing both Schedule 1 texts to insert the appointee's full name. The parenthetical religious option in the oath text should be handled literally, allowing the appointee to supply the named god if they choose that route (Schedule 1). Registry staff should coordinate schedules with the Chief Judge or available judge and provide clear advice to appointees on the two modes, to avoid last-minute uncertainty. Retain contemporaneous notes or a signed witness statement by the administering judge or by registry staff to evidence that the requirement under reg 5(b) has been satisfied.

Accommodating accessibility and conscience issues The Regulations permit both an oath and an affirmation, which enables accommodation of non-religious conscience objections by offering the secular affirmation alternative. The religious oath also allows an appointee to name a god recognised by their religion. If an appointee has a disability or linguistic need, the administering judge and registry should ensure the appointee is provided appropriate assistance to understand and make the declaration in the prescribed text. Any modification in wording to accommodate disability should be approached carefully and, if necessary, considered against the parent Act to determine whether modified wording is acceptable.

Addressing timing ambiguity Because the Regulations do not specify when the oath or affirmation must be taken relative to starting duties, best practice is to take the prescribed form before the person commences substantive judicial registrar functions, or at the earliest feasible time thereafter, with a contemporaneous administrative record. If performing functions prior to taking the oath is unavoidable, note those circumstances in registry records and seek any necessary legal or administrative advice to confirm the legality of acts performed in the interim.

Transitional matters following revocation The 2014 Regulations are revoked (reg 4), but the 2024 Regulations do not contain express transitional provisions. Where there is doubt about appointees who swore under the 2014 rules, seek administrative guidance from the County Court leadership on whether any re-taking of the oath is required for ongoing validity, and retain documentation of advice received. Any decision to require re-taking should be grounded in the County Court Act 1958 or an authorised administrative policy.

Record retention and evidence If disputes later arise about whether the prescribed form was taken and administered properly, the most reliable evidence will be a contemporaneous record kept by the registry. The Regulations themselves do not prescribe the form of evidence, so retain signed certificates, witness statements from the administering judge, or a registry entry showing the full text used and the date. Given the Endnotes' direction that headings and punctuation form part of the Statutory Rule (Interpretation material), ensure that any recorded copy of the oath or affirmation reproduces the Schedule's wording and punctuation accurately.

Plan for the sunset The Regulations will sunset on 17 September 2034 unless re-made or otherwise saved under the Subordinate Legislation Act 1994 (Endnotes, "General information"). Institutions should plan to review the statutory instruments affecting oath and affirmation practices ahead of that date if continuity is required. Record-keeping of which text was used for each appointee will aid smooth transition if different or successor regulations are made.

When in doubt, consult the parent Act The Regulations operate "for the purposes of section 17PA(1) of the County Court Act 1958" (reg 5). If any compliance question arises about timing, consequences of failing to take the oath, qualification for office, removal or disciplinary consequences, refer to section 17PA(1) and other provisions of the County Court Act 1958 and seek legal advice. The Regulations are narrow in scope and do not address those enforcement and substantive-office questions themselves.
