County Court (Fees) Regulations 2018

Definitions and banding: The Regulations build around a small set of definitional building blocks (reg 5). A concession fee payer is someone who holds a current Commonwealth health care card within the meaning of the Social Security Act 1991 at the time a fee is payable. A standard fee payer is primarily defined as a natural person (other than a statutory office holder) or certain not‑for‑profit organisations, entities with turnover under $200 000 in the prior financial year, or an executor/administrator of a deceased estate. A corporate fee payer is any entity that is not a standard fee payer or concession fee payer. Those bucket definitions determine which column in Schedule 1 applies (reg 7(2)-(4)).

Fee units and calculation: Schedule 1 quotes fees predominantly in fee units rather than dollar values. The explanatory details and Endnotes make the conversion rule explicit: the number of fee units is multiplied by the fee unit value set under the Monetary Units Act 2004 and published by the Treasurer (Endnotes, Fee Units). The Regulations therefore create a two-step calculation: identify the item and the applicable column, multiply the stated fee units by the current fee unit value, and round to the nearest 10 cents.

Structure of fee items: Schedule 1 is organised into named blocks: commencement fees (items 1-5), case management fees (items 6-8), fees for other applications (items 9-18), hearing fees (items 19-24) and administrative fees (items 25-30). Fees range from per-document or per-event charges (commencement, filings) to per-day hearing rates. A handful of items are expressed in dollars instead of fee units, for example photocopying at 60 cents per page (item 30).

Who pays and when: The default rule is that fees are payable by the party or entity at whose request the document is filed or service rendered (reg 8(1)). Where a fee arises from an order on the court’s own motion, the party which commenced the proceeding pays unless the court orders otherwise (reg 8(2)). For hearings and setting down, the Regulations specify that the party seeking the hearing bears the fee (regs 11(1) and 12(1)), and they prescribe concrete deadlines for payment (regs 11(2), 12(3)-(4), 13(2)).

Multiple parties and single-fee rule: If multiple parties join in a filing or request, only a single fee is payable and the applicable rate is determined by a priority rule: if any requesting party is a corporate fee payer, the corporate fee applies; otherwise if any is a standard fee payer the standard fee applies (reg 9). The Examples attached to reg 9 make clear that the highest applicable band among those making the request controls the fee payable.

Waiver, reduction, refund and proof: Waiver is available in specified circumstances , pro bono representation under specified schemes, legal aid, imprisonment, and under‑18 status , and is automatic where the condition exists at the time the fee is payable (reg 14(1)). Items 25, 26 and 30 have an exception: they are not waived unless waiver is granted in accordance with s 79A(6) of the Act (reg 14(2)). A court official may reduce a standard fee to the concession level only after a waiver application has been rejected and the court official is of the opinion the person can pay a concession fee without hardship (reg 15). Refunds are available where a fee was not payable or was overpaid, but multiple explicit non‑refund situations are listed (reg 16(1)-(7)). A fee payer must supply evidence to establish their fee status when requested (reg 17(2)), and a court official can reinstate a correct higher fee and require payment if a lower fee was wrongly charged (reg 17(4)).

Excluded proceedings and continuing charge for some administrative items: The Regulations state that no fee is payable under these Regulations for certain classes of criminal and appellate matters unless the application is governed by Chapter I rules (reg 6(1)(a)-(e)). Despite the exclusion, certain administrative search and copy fees in items 25, 26 and 30 remain payable in those proceedings (reg 6(2)).

Administrative actors and discretion: “Court official” is defined to mean registrars and deputy registrars, while “judicial officer” includes judges, associate judges and judicial registrars (reg 5). The Regulations allocate to court officials the power to demand prepayment (reg 10(b)), to reduce fees under particular circumstances (reg 15), to refund in exceptional cases (reg 16(7)), and to require evidence of fee status (reg 17). The court itself may order a different party to bear a fee (reg 8(2)).

These concepts together create a precise operational model: bands of payers determine headline fee unit rates; the fee unit value is fixed separately; a set of procedural deadlines allocates cash flows; explicit waiver and refund routes are narrow and specified; and administration and some limited discretion rest with registrars and deputy registrars.

Litigants and representatives: The Regulations directly affect all parties who initiate, respond to or otherwise participate in County Court proceedings that attract fees under Schedule 1. The statutory charging bands subdivide litigants into three groups with distinct economic consequences. A concession fee payer (current Commonwealth health care card holder) receives the lowest column of fees (Sch 1, Column 5). A standard fee payer (a natural person, designated small not‑for‑profit or entity below the $200 000 turnover threshold, or certain estate administrators) pays the middle column (Sch 1, Column 4). Any remaining entity is a corporate fee payer and pays the highest column (Sch 1, Column 3) (reg 5; reg 7(2)-(4)).

Firms and commercial clients: Corporations, larger firms, trusts and other entities whose turnover exceeds $200 000 will typically be charged at the corporate rate. Where multiple parties jointly request a filing or service, the presence of just one corporate fee payer elevates the single fee payable to the corporate rate (reg 9). That rule concentrates the cost incidence: in multi‑party matters practitioners should expect a single fee at the highest relevant band.

Represented litigants and pro bono/legal aid recipients: The Regulations create an automatic waiver in specified representation contexts. Parties represented under specified pro bono schemes administered by the Victorian Bar, the Law Institute of Victoria, Justice Connect or represented by members of the Federation of Community Legal Centres are entitled to waiver (reg 14(1)(a)-(b)). Legal aid recipients under Commonwealth or State schemes are also eligible for waiver (reg 14(1)(c)). These waivers change the cash flows for law firms engaged in pro bono work and reduce direct financial barriers for represented parties.

Court administration and officials: Registrars and deputy registrars are the operational decision‑makers on fee status evidence (reg 17), on prepayment requests (reg 10(b)), on reductions of standard fees to concession levels in narrow circumstances (reg 15), and on exceptional refunds (reg 16(7)). Judicial officers have a more limited role in the fee scheme; the term is defined to include judges, associate judges and judicial registrars (reg 5), and the court may exercise discretion to alter which party bears a fee where an order is made on the court’s own motion (reg 8(2)).

Third parties and government agencies: The Regulations expressly exclude some government prosecutorial activity from ordinary charges: applications by the Office of Public Prosecutions or the Commonwealth Director of Public Prosecutions attract a different treatment under reg 6(1)(e). Criminal proceedings, sentencing matters and certain appeals are excluded from fee liability under reg 6(1)(a)-(d) unless an application is under Chapter I, although items 25, 26 and 30 remain payable (reg 6(2)).

Service providers and suppliers: The Schedule affects providers of court‑related services and suppliers who invoice for searches, copies, mediations and subpoenas. Administrative fees are explicit, for example item 26 for electronic file search with copy at 1 fee unit and item 30 for photocopying at 60 cents per page. Entities producing estimates for mediation must account for mediation fees payable in advance and for any additional mediation fee if duration exceeds the estimate (reg 13).

Accountants, compliance officers and in‑house counsel: The turnover test for standard fee payer status (reg 5(c)) requires a lookback to the financial year before the year in which a fee is payable. This pulls corporate finance processes and record keeping into fee status determinations when corporate entities assert entitlement to the standard band. The Regulations require production of evidence when requested (reg 17(2)) and permit reinstatement and recovery of undercharged fees when status was incorrectly claimed (reg 17(4)).

In short, the Regulations allocate cash liabilities across litigants according to an explicit banding system, place evidence and procedural obligations on fee payers, and give registrars and deputy registrars concrete operational powers to collect, reduce, refund and reinstate fees.

Duties to pay and timings: The primary duty under these Regulations is to pay the appropriate fee when required. The general rule is that fees are payable by the party, person or entity at whose request the document is filed or the service is rendered (reg 8(1)). For fees arising from the court’s own motion, the originating party pays unless the court orders otherwise (reg 8(2)). Deadlines are explicitly set for time‑critical fees. Setting down fees must be paid no later than six weeks before the hearing date, or if less than six weeks is available at the time the date is fixed, then the day after the matter is set down for hearing (reg 11(2)). First trial day hearing fees must be paid no later than five days prior to the date set down for hearing, or the day after the matter is set down if less than five days was available when the date was fixed (reg 12(3)). Other hearing day fees are due by the day before the hearing to which they relate (reg 12(4)). Mediation fees, based on estimated duration, must be paid no later than five days prior to mediation or the day after the date is fixed if less than five days notice was given (reg 13(2)).

Duty of evidence: A fee payer who claims a particular status (standard fee payer, concession fee payer or entitlement to waiver/refund) must provide information or evidence to a court official when requested (reg 17(2)). If the court official is satisfied, the payer is charged the appropriate fee or granted a waiver/refund (reg 17(3)). If a lower fee was charged incorrectly, the court official may reinstate the correct fee and require payment of the difference, and the fee payer is liable for the reinstated fee (reg 17(4)).

Duty to pay a single fee for joint requests: When multiple parties make a single joint request, only a single fee is payable and the applicable fee band follows a priority order: corporate fee payer takes precedence, otherwise standard fee payer takes precedence (reg 9). The consequence is that a single corporate party in a multi‑party request can increase the fee payable for everyone.

Right to waiver in specified circumstances: A fee is waived if, at the time it is payable, the party is represented under certain named pro bono schemes, represented pro bono by the Federation of Community Legal Centres, has legal aid, is imprisoned or detained, or is under 18 years old (reg 14(1)(a)-(e)). The list in reg 14 is specific as to named organisations and schemes. There is an important qualification in reg 14(2) that fees payable under items 25, 26 or 30 are not waived unless waiver is granted in accordance with s 79A(6) of the Act. The Explanatory Note to reg 14 reiterates that s 79A(6) provides a power to waive if payment would cause financial hardship.

Right to reduction after waiver rejection: If an applicant for waiver is rejected, a court official retains a limited power to reduce a standard fee to the concession level if the official is of the view the person can pay the concession fee without financial hardship (reg 15(1)(a)-(b)). That is not an open ordinary discretion to grant concession rates; it is conditional on a prior waiver rejection and the court official’s assessment.

Rights to refund and limitations: Refunds are available where a fee was paid but was not payable, or where a higher fee was paid by mistake (reg 16(1)-(2)). However, multiple non‑refund rules constrain those rights: no refund for a commencement fee when a matter is transferred to a lower court (reg 16(3)); no refund of a setting down fee if the matter does not proceed to hearing (reg 16(4)); no refund for hearing fees, or any fee encompassing the first day of hearing, where the hearing does not proceed (reg 16(5)); and no refund for mediation fees if the mediation does not proceed (reg 16(6)). Additionally, a court official may, in their discretion, refund fees for exceptional reasons (reg 16(7)).

Right to administrative action by court official and court orders: Court officials may require prepayment before filing or rendering a service (reg 10(b)). The court may order that a fee be paid by a different party if it makes an order on its own motion (reg 8(2)). Where a fee payer provides evidence of status, the court official is obliged to apply the fee or waiver consistent with that evidence (reg 17(3)).

Other procedural rights and duties: The Regulations include several procedural specifics which translate into duties: a setting down fee is payable only once per trial regardless of adjournment or relisting (reg 11(3)); a hearing fee is not payable where the sole purpose of the hearing is delivery of a reserved judgment (reg 12(2)); and mediation additional fees must be paid the day after any further mediation day exceeding the estimated duration (reg 13(3)).

Collectively, the Regulations create a deterministic set of payment obligations (who pays, when, how much), procedural proof duties (establishing status), narrowly defined waiver and reduction rights, and limited refund rights subject to enumerated exclusions. Operational compliance therefore requires careful alignment of fee payer classification, timing, payment and documentary proof.

Express penalties: The Regulations themselves do not create criminal penalties, fines or explicit statutory sanctions for non‑payment. They are a schedule of fees and administrative rules; no regulation in the text attaches a penal sanction to non‑payment. Where the Regulations reference the County Court Act 1958 (reg 2 authorising provision and reg 14(2) cross‑referring to s 79A(6)), they do not import any penalty provisions within themselves. The instrument therefore relies principally on administrative enforcement and court procedural levers rather than criminal enforcement.

Administrative enforcement mechanisms: The Regulations confer a number of practical enforcement levers for court officials and the court. A registrar or deputy registrar may require that a fee be paid before a document is filed or a service is rendered (reg 10(b)). That prepayment requirement is an immediate administrative control: the registry can deny filing until the fee is paid. For setting down and hearing fees, the Regulations impose hard payment deadlines (regs 11(2), 12(3)-(4), 13(2)), and practical registry practice will likely treat untimely payment as a bar to proceeding until payment is made. The court may, when it acts on its own motion, order that a fee be payable by a party other than the default payer (reg 8(2)). Registrars can reinstate a correct fee and require the party to pay the difference where a payer has been charged a lower fee than applicable (reg 17(4)). These are civil and administrative enforcement mechanisms that bind access to procedural steps in court.

Financial and procedural disincentives: The Regulations create financial disincentives that operate as behavioural enforcement. For example, the setting down fee is non‑refundable even if the trial does not proceed (reg 16(4)). That rule discourages parties from routinely setting matters down without regard to the risk of non‑prosecution. Similarly, the non‑refund rule for hearing fees encompassing the first day of hearing (reg 16(5)) may deter last‑minute withdrawals or failures to proceed.

Refund discretion and exceptional refunds: Although refunds are tightly circumscribed, a court official may refund a fee for exceptional reasons (reg 16(7)). This discretionary power acts as a safety valve where strict application of the non‑refund rules would produce manifest unfairness in individual cases. The Regulations do not elaborate criteria for “exceptional reasons”, leaving it to registry practice and administrative judgment.

Recovery of unpaid fees: The Regulations provide for reinstatement and recovery of undercharged fees (reg 17(4)), but they do not specify collection mechanisms such as debt recovery proceedings based on fee orders. The practical implication is that unpaid fees may be pursued through ordinary civil recovery mechanisms or be enforced by the court's control over procedural steps, rather than by a special penalty clause in the Regulations.

Interaction with statutory waiver power: Under reg 14(2) the waiver of items 25, 26 or 30 is constrained by s 79A(6) of the County Court Act 1958. That statutory provision provides the power to waive fees if payment would cause financial hardship. The existence of that statutory hook means that, for those administrative items, waiver is subject to an additional statutory test. The enforcement implication is that registrars and deputy registrars may require evidence and apply s 79A(6) criteria before waiving those specific fees.

Operational risks: Practical enforcement will depend heavily on registry procedures, timeliness of notice, availability of payment methods and the court’s willingness to exercise discretion. The Regulations give court officials the tools to require prepayment, demand evidence of status, reinstate undercharges and issue refunds in exceptional cases. They do not, however, prescribe a standardised remedy for systemic non‑payment or automated debt recovery.

In sum, enforcement is primarily administrative and procedural: non‑payment can prevent filing, setting down or hearing, allow the registrar to reinstate fees, and create a financial liability enforceable by ordinary collection rather than by penalties embedded in the Regulations.

Parent statute and waiver cross‑reference: The Regulations are made under section 79A of the County Court Act 1958 (reg 2). The instrument expressly notes that certain waivers for items 25, 26 and 30 are subject to section 79A(6) of the Act (reg 14(2) note), which provides a statutory power to waive fees on grounds of financial hardship. Thus the Regulations operate in tandem with the County Court Act to implement waiver conditions for particular administrative fees that the Regulations otherwise make payable.

Procedural rules and Chapter I: The definitional term Chapter I refers to the County Court Civil Procedure Rules 2008 or any subsequent rules that constitute Chapter I of the County Court Rules (reg 5). Regulation 6 excludes fees under these Regulations for a list of criminal and sentencing matters unless an application to which a fee relates is an application under Chapter I (reg 6(1)). That creates an interaction where procedural classification under Chapter I determines fee liability even when the Regulations otherwise exclude criminal or sentencing matters. The County Court Civil Procedure Rules therefore mediate which filings are feeable.

Criminal and sentencing statutes: The Regulations carve out criminal proceedings under the Criminal Procedure Act 2009 and matters under the Sentencing Act 1991 (reg 6(1)(a)-(b)), and matters to which Chapter III applies (the County Court Criminal Procedure Rules 2009) (reg 6(1)(d)), as generally not attracting fees under these Regulations. Appeals from the Magistrates' Court or the Children’s Court are likewise excluded (reg 6(1)(c)). Those cross‑references allocate the charging regime primarily to civil business run under Chapter I and reserve criminal work for a different treatment.

Interstate and federal interactions: The Schedule includes items that connect to other statutory regimes. Item 16 deals with applications under section 6 or 8 of the Judgment Debt Recovery Act 1984 and item 28 prescribes a fee for registering an interstate judgment. Item 5 provides a specific adjustment when a proceeding is transferred from the Magistrates' Court: the County Court commencement fee is reduced by any fee paid in the Magistrates' Court on commencement (Sch 1, item 5 and reg 16(3) clarifies no refund where matter is transferred to a lower court). Those provisions demonstrate direct operational linkages with other courts and interstate enforcement regimes.

Fee unit law and monetary conversions: The Regulations set fees by reference to fee units and rely on the Monetary Units Act 2004 for conversion into a dollar amount (Endnotes, Fee Units). The Monetary Units Act gives the Treasurer the power to fix the value of a fee unit for each financial year, and requires publication of that value in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. Consequently, the final dollar amount payable for a given Schedule item changes each financial year by executive action under the Monetary Units Act, not by amendment of these Regulations.

Associations incorporated under other Acts: The waiver provisions refer to specific named pro bono schemes administered by bodies incorporated under the Associations Incorporation Reform Act 2012 (reg 14(1)(a)-(b)). The effect is that entitlements to waiver are determined partly by reference to entities governed by other legislation which defines legal personality and the schemes under which they operate.

Subordinate legislation governance: The Endnotes note that the Regulations will sunset 10 years after the day of making on 23 October 2028 in accordance with the Subordinate Legislation Act 1994. That statutory sunset interacts with the instrument’s lifecycle and requires attention to future renewal or replacement under the subordinate legislation regime.

Procedure and evidence rules: The Regulations require production of documentary evidence to establish fee payer status (reg 17). Those evidentiary requirements will interface operationally with disclosure and confidentiality obligations under other laws and court rules, for example privacy or corporate disclosure regimes, although the Regulations themselves do not mandate specific documentary forms.

Administrative consequences of transfers and hearings: Reg 16(3) provides that where a matter is transferred to a lower court after commencement and a commencement fee has been paid, no refund is payable. This interacts with inter‑court transfer mechanisms and the usual procedural consequences of such transfers under the County Court Act and Magistrates' Court rules.

In summary, the Regulations sit within a mesh of governing instruments: the County Court Act for authorisation and hardship waiver, Chapter I for procedural classification, the Criminal Procedure Act and Sentencing Act for exclusions, the Monetary Units Act for fee valuation, and other statutes and rules for inter‑court procedures and entitlement definitions. Practitioners must therefore consider the Regulations alongside these other instruments when assessing fee obligations.

Instrument commencement and making: The County Court (Fees) Regulations 2018 were made on 23 October 2018 by the Governor in Council under s 79A of the County Court Act 1958 and commenced on 14 December 2018 (Endnotes, General information; reg 3). The Regulations replaced the interim instrument County Court (Fees) Interim Regulations 2017 that they expressly revoked (reg 4).

Notable amendment in 2022: The instrument incorporates amendments made by the County Court (Fees) Amendment Regulations 2022, S.R. No. 10/2022. The amendment regulation was made on 15 February 2022 and commenced on 1 March 2022 (Table of Amendments, 2). The 2022 amendment specifically revoked the definition of commencement fee within reg 5 (Reg. 5 def. of commencement fee revoked by S.R. No. 10/2022 reg. 4) and amended Schedule 1 (Sch. 1 amended by S.R. No. 10/2022 reg. 5). The published version at 1 March 2022 incorporates those changes.

Sunset provision: The Endnotes record that the Regulations will sunset 10 years after the day of making, i.e. on 23 October 2028, under the Subordinate Legislation Act 1994 (Endnotes, General information). That statutory sunset date is an external limitation on the instrument’s currency unless the Government renews, replaces or remakes the instrument in accordance with the subordinate legislation regime.

Reprints and references: The explanatory details in the Endnotes note that the definitional cross‑references to Chapter I and other rules relate to specific reprints and subsequent statutory rules. For example, the definition of Chapter I refers to the County Court Civil Procedure Rules 2008 as reprinted to S.R. No. 162/2015 and subsequently amended by several statutory rules. The Endnotes therefore provide a trace for the interplay between these Regulations and the procedural rule changes over time.

Style changes and statutory interpretive adjustments: The Endnotes also refer to style changes authorised by section 54A of the Interpretation of Legislation Act 1984 and interpretive rules under section 36 of that Act, which affect headings, examples, punctuation and the location of legislative items. These are housekeeping amendments to presentation rather than substantive fee changes, but they affect how the Regulations are read and cited.

Specific changes noted in the text: Within the body of the Regulations the instrument records a specific revocation of the reg 5 definition of commencement fee (S.R. No. 10/2022 reg 4), and the Schedule is annotated as having been amended by S.R. No. 10/2022 reg 5. The Endnotes’ Table of Amendments provides the dates of making and commencement for the 2022 amendment.

Amendments not yet in operation: The publication identifies that the version provided does not contain amendments not yet in operation (Endnotes, 3). That indicates the published version has been updated only to the extent that amendments have commenced.

Operational amendments that do not require legislative alteration: The fee unit conversion mechanism delegates dollar changes to executive action under the Monetary Units Act 2004 rather than to amendment of these Regulations. The Endnotes state the fee unit value for the 2021-22 financial year was $15.03 and that the Treasurer fixes and publishes the value for subsequent financial years. Therefore the Regulations’ dollar outputs may change annually without an amendment to the Regulations themselves.

Collectively, the instrument’s amendment history is modest: initial making and commencement in late 2018, revocation of a prior interim instrument, and a specific amendment package in early 2022 that altered definitions and Schedule entries. The sunset in 2028 establishes a statutory endpoint unless the subordinate legislation is renewed.

The text of the County Court (Fees) Regulations 2018 supplied contains no litigation history. No cases or judicial decisions are cited in the Regulations or Endnotes, and the instrument’s explanatory materials do not list judicial consideration, appeals or disputes about the Regulation in the body of the published text provided. The Endnotes contain reprint and amendment references but do not include any judgments, proceedings or case citations.

Practical consequence for practitioners: Because the instrument does not include any reported litigation, there is no statutory or annotated case law referenced within this text to guide interpretation of ambiguous provisions such as the scope of “exceptional reasons” for refunds (reg 16(7)), the precise application of the financial hardship test in s 79A(6) (reg 14(2) note), or the evidentiary threshold for establishing fee payer status under reg 17. In the absence of reported authority within the instrument, practitioners must rely on the plain words of the Regulations, administrative practice in the County Court registry and any subsequent judicial decisions post‑dating this version.

Monitoring for judicial developments: Practitioners should monitor County Court and appellate decisions that may interpret operational provisions such as reg 11(3) (single setting down fee for trials heard in parts), reg 12(2) (no hearing fee where the sole purpose is delivery of a reserved judgment) and reg 17(4) (reinstatement of undercharged fees). Any judicial clarification will directly affect how registrars exercise their discretion and how litigants approach payment and waiver applications.

Absence of litigation in instrument does not preclude future challenges: The lack of litigation history in the published text does not mean provisions are immune from challenge. Questions that could lead to litigious issues include the scope of waiver eligibility (reg 14), the limits of a court official’s discretion under reg 15 and reg 16(7), or whether procedural actions (such as denial of filing for non‑payment) raise justiciable administrative law issues. But any such litigation would be external to the instrument and will be developed in the courts and reported separately.

In short, the Regulations as published include no litigation history or cited authorities. Users must therefore treat interpretive uncertainty as unresolved by the instrument itself and rely on registry guidance or subsequent judicial pronouncements to fill gaps.

Single fee, highest applicable band: When multiple parties jointly request a filing or service, only one fee is payable and the presence of any corporate fee payer among the requestors converts the fee to the corporate rate (reg 9). A common practical error is expecting individual fees per party; the rule is single fee only. The priority rule can cause an unexpected hike in cost for otherwise low‑cost parties who participate in a joint application with a corporate party.

Setting down and adjournments: The setting down fee is payable only once per trial regardless of adjournment, relisting or partial hearing (reg 11(3)). Parties often assume each re‑listing will trigger a new setting down fee. The Regulations prevent that, but they also lock a party who pays the setting down fee into a non‑refundable position if the matter does not proceed (reg 16(4)). That creates a timing risk in scheduling and practical costs if matters are vacated.

Strict payment deadlines and prepayment power: The Regulations give registrars the power to require prepayment of a fee before accepting a document (reg 10(b)). For first trial day fees and setting down fees there are short hard deadlines (reg 11(2) and reg 12(3)). If a party misses the deadline and the registrar requires payment before filing, procedural steps may be delayed. Timetabling and firm billing processes must therefore accommodate those deadlines.

Non‑refund traps: Several fees are effectively non‑refundable. No refund is payable for a setting down fee if the matter does not proceed (reg 16(4)); no refund for a hearing fee (or a fee encompassing the first day of hearing) if the hearing does not proceed (reg 16(5)); and no refund for mediation fees if the mediation does not proceed (reg 16(6)). Additionally, if a matter is transferred from the County Court to a lower court, the commencement fee is not refunded (reg 16(3)). Parties should carefully consider the risk that fees may be sunk when deciding to set matters down.

Waivers are narrow and conditional: Automatic waiver is available only in specific circumstances and for particular named schemes or status (reg 14(1)). Where a party claims waiver through representation under a named pro bono scheme, the waiver is conditional on the representation existing at the time the fee is payable. For items 25, 26 and 30, waiver is not available unless s 79A(6) of the County Court Act 1958 is satisfied (reg 14(2)). Practitioners should not assume waivers are broadly available.

Reduction path is limited: A court official may reduce a standard fee to a concession fee only after a waiver application has been rejected and on the court official’s opinion that the person has sufficient means to pay the concession fee without financial hardship (reg 15). The reduction path is therefore not an alternative to a waiver application; it is a narrow administrative option that presumes a prior waiver rejection.

Proof of status and post‑payment reinstatement: If a party is charged a lower fee because of a claim to a particular status, the court official may later reinstate the correct higher fee and require payment of the difference (reg 17(4)). This makes it risky to assume fee status without contemporaneous documentary proof and can generate retrospective liabilities.

Fee unit volatility and rounding: Fees are in fee units and the Treasurer fixes the monetary value annually. The explanatory notes show the fee unit value for 2021-22 was $15.03. Fee payers must compute fees using the current fee unit value and be alert to rounding to the nearest 10 cents. Budget estimates and client quotations must therefore allow for annual movement.

Mediation fee estimation and follow‑up payment: Mediation fees are payable based on estimated duration and any extra fee for additional time must be paid by the day after the additional mediation day (reg 13(3)). Under‑estimation of mediation length can therefore create unexpected immediate cash obligations.

Exceptions and Chapter I dependence: Regulation 6 excludes criminal and sentencing matters from general fees, but the exclusion is qualified: if an application is an application under Chapter I, the fee may still apply (reg 6(1)). Practitioners working at the intersection of civil and criminal procedure must ensure correct procedural classification, as misclassification can lead to unexpected charges.

Administrative items behave differently: Items 25, 26 and 30 have distinctive behaviours. Item 26 (search for electronic file with a copy) is charged at 1 fee unit for all payers (Sch 1, item 26). Photocopying is charged at 60 cents per page (item 30). Search and copy fees may still be payable in proceedings otherwise excluded from fees under reg 6(1) (reg 6(2)). These administrative items are therefore often payable even where substantive fees are not.

Specific Schedule anomalies: Some Schedule items have unusual entries. For example, item 2 for commencement in the Adoption List has “N/A” in the corporate fee payer column (Sch 1, item 2). Practitioners should note where particular columns are inapplicable. Also, the concession fee column for many hearing days is fixed at 17.3 fee units regardless of day number, which creates a compressed cost structure for concession payers for protracted trials.

Transfer adjustments: When a proceeding is transferred from the Magistrates' Court the commencement fee in the County Court is reduced by any fee already paid in the Magistrates' Court (Sch 1, item 5). However, if a proceeding is transferred from the County Court to a lower court after commencement, no refund is payable (reg 16(3)). Parties should factor these asymmetric transfer rules into costs modelling.

Operational discretion and undefined terms: Terms such as “exceptional reasons” for refunds (reg 16(7)) are not defined. Similarly, the court official’s opinion under reg 15 is subjective. These leave room for administrative variation and inconsistent practice across registries.

Understanding these gotchas helps practitioners and clients avoid unnecessary costs, retrospective liabilities and procedural delay. The concrete remedial actions are in the Regulations themselves, so precise compliance prevents exposure to these traps.

Establish and document fee payer status early: On client intake, capture evidence relevant to fee classification: whether the client holds a Commonwealth health care card (concession fee payer), whether the client is a natural person or fits the standard fee payer not‑for‑profit/turnover thresholds, or whether the client is a corporate entity (corporate fee payer) (reg 5; reg 17(2)). Retain documentary proof of turnover for the prior financial year for entities claiming standard fee payer status (reg 5(c) and reg 17(2)). Where representation is pro bono or legal aid is provided, retain the certificate or formal authorisation from the named scheme bodies and the date of representation to trigger the waiver in reg 14(1).

Calculate fees using current fee unit value: For Schedule items expressed in fee units, multiply the fee unit figure in Schedule 1 by the current fee unit monetary value fixed by the Treasurer under the Monetary Units Act 2004, and round to the nearest 10 cents as permitted (Endnotes, Fee Units). Check the Government Gazette and the prescribed Victorian newspaper for the announced fee unit value before quoting clients or making payments.

Observe payment deadlines and who must pay: Identify who is the party “seeking the hearing” for setting down and hearing fees because that party bears the fee (regs 11(1) and 12(1)). Pay setting down fees no later than six weeks before the hearing date or as otherwise provided (reg 11(2)). Pay first trial day hearing fees no later than five days before (reg 12(3)), and other hearing day fees by the day before the hearing (reg 12(4)). For mediation, pay the mediation fee based on the estimated duration at least five days before mediation or the day after the date is fixed if less notice was given (reg 13(2)). To avoid registry refusal to accept filings, be prepared to prepay when requested by the court official (reg 10(b)).

Single fee for joint filings: When filing on behalf of multiple parties, coordinate with co‑litigants to identify the highest applicable band among the requestors because the presence of a corporate fee payer will elevate the fee to the corporate rate (reg 9). Agreement among parties about who pays can avoid disputes and late payments.

Apply for waivers correctly and in time: If a client qualifies for automatic waiver under reg 14(1), provide the registry with the relevant evidence at the time the fee is payable. For items 25, 26 or 30, where reg 14(2) applies, consider whether s 79A(6) of the County Court Act 1958 provides an additional statutory basis for waiver on grounds of financial hardship. Submit any waiver documentation early to avoid payment being required at the time of filing.

If waiver is refused, seek reduction where appropriate: If a waiver application is rejected for a standard fee payer, a court official may in limited circumstances reduce the fee to the concession level, but only if the court official is of the opinion the person can pay the concession fee without hardship and only after waiver rejection (reg 15). Prepare a short, persuasive submission demonstrating the client’s financial circumstances and addressing the court official’s assessment criteria.

Handle refunds with care: If a fee was paid in error, apply promptly for refund with supporting evidence (reg 16(1)-(2)). Be aware of the enumerated non‑refund situations: no refund for commencements transferred to a lower court (reg 16(3)), no refund for setting down fees where the matter does not proceed (reg 16(4)), no refund for hearing fees encompassing the first hearing day where the hearing does not proceed (reg 16(5)), and no refund for mediation fees if mediation does not proceed (reg 16(6)). If there are exceptional circumstances, lodge an application for refund under reg 16(7) with detailed reasons.

Keep records and receipts: Maintain contemporaneous records of fee calculations, fee unit values used, payment receipts and any correspondence with registrars concerning prepayment requests or fee status evidence. These records are essential in the event the registry reinstates a higher fee under reg 17(4) or if a refund is contested.

Plan for mediation fee overrun payments: When paying mediation fees based on an estimate, budget for additional fee units if the mediation exceeds the estimate and ensure the client understands the payment is due the day after the additional mediation day (reg 13(3)).

Manage transfers and commencement fees: If commencing in the County Court a proceeding transferred from the Magistrates’ Court, ensure the commencement fee is reduced by the fee already paid in the Magistrates’ Court (Sch 1, item 5). Conversely, if proceedings may be transferred to a lower court after County Court commencement, warn the client that the commencement fee is not refundable (reg 16(3)).

Check administrative item prices and prepare for per‑page charges: For searches and copies, check items 25-30: search for paper file item 25 at 4.9 fee units for corporate payers and lower bands for others, electronic file with copy item 26 at 1 fee unit for all payers, and photocopying item 30 at 60 cents per page (Sch 1). Where frequent copying is expected, estimate the likely page count to provide a realistic client cost disclosure.

Coordinate inter‑disciplinary compliance: Where your matter implicates other statutes or courts , for example registering an interstate judgment (item 28) or applications under the Judgment Debt Recovery Act 1984 (item 16) , integrate the fee rules into the wider litigation budget and ensure the relevant statutory forms and evidence are provided to avoid delays.

Establish internal billing and reminder systems: Given strict deadlines for payment and registrar power to require prepayment, set internal calendars to trigger payment action well before statutory cutoffs. Confirm payment clearance and obtain receipts before attempting to set down or proceed to hearing.

Engage early with registry for exceptional circumstances: If a client faces a unique hardship or procedural issue, contact the registrar early to outline the case and, if necessary, make an exceptional refund or waiver submission under reg 16(7) or s 79A(6).

In summary, compliance is a mix of administrative discipline and timely documentary proof. Clients and advisers must align filing and hearing timetables with payment deadlines, document fee status, and keep records to respond promptly to any registry enquiries or reinstatement demands.
