74Q Promotion appeals (1) The Commission in determining an appeal against the failure of the Authority to select a person for promotion must have regard to the merit of the person selected for promotion and the appellant. (2) In this section ***merit*** means— (a) skills, knowledge, aptitude and experience relevant to the requirements of the position; and (b) special qualifications, fitness (including physical fitness), diligence and good conduct.
