36A Determination of sole responsibility for fire prevention in certain areas S. 36A(1) amended by No. 20/2019 s. 156. (1) The Authority and the Secretary may jointly determine that either the Authority or the Secretary is solely responsible for the prevention of fires in any part of Victoria which lies outside the Fire Rescue Victoria fire district. (2) Notice of a determination under subsection (1), describing by plan or otherwise the part of Victoria affected by the determination must be published in the Government Gazette and a newspaper circulating generally in that part of Victoria. (3) A determination under subsection (1) takes effect on the day that it is published in accordance with subsection (2). s. 38, 5651 s. 2(1)(g).
