Country Areas Water Supply By-laws 1957

The by‑laws rest on a small set of legal and administrative concepts that structure compliance and enforcement.

1. Spatial scope and mapping: The by‑laws apply to "catchment areas and water reserves constituted for the purpose of the principal or any amending Act" (by‑law 2). Boundaries matter: several rules establish fixed radial distances from high‑water mark, wells, bores or reservoirs (50 m for closets, by‑law 4; 300 m for stables and for camping/picnicking, by‑laws 12(1) and 36(1); 500 m for pigs, by‑law 19A; 800 m for flora protection, by‑law 40(1)). The South West Settlement Area and Mungalup Dam Catchment are specified by schedules and coordinates (by‑laws 1(3); Schedule 1 and 4), with coordinate systems identified (Map Grid of Australia 1994, GDA94) and maps made available for inspection (by‑law 1(3) note).

2. Administrative actors and decision points: The CEO and inspectors are the central decision‑makers. Inspectors are appointed by the Corporation or the CEO (by‑law 1A(1)). The CEO can give notices, set compliance times, publish permitted substances in the Government Gazette, and prescribe restrictions (by‑laws 3, 11(2), 31, 33, 35(2), 36(2)). Inspectors exercise on‑site enforcement including entry, removal of offending items, and specifying remedial works (by‑law 32).

3. Duty/approval architecture: The by‑laws balance prescriptive technical obligations (for example construction dimensions in by‑law 6) with an approvals regime that centralises discretion in the CEO. Some activities are prohibited save with written CEO approval, notably use of artificial manures, poisons and industrial discharges (by‑laws 11(1), 29). Approval can be general (Gazette notice permitting use without prior approval, by‑law 11(2)) or specific (written permission for industrial discharge, by‑law 29(1)).

4. Technical standards: The by‑laws set minimum sanitary and handling standards. Earth closets must meet precise dimensions, ventilation and material requirements (by‑law 6). Nightsoil removal must follow specified handling, disinfection and washing processes and weekly cleaning schedules (by‑law 16). Receptacles for household refuse and nightsoil must be watertight, coverable, and regularly emptied, cleansed and disinfected (by‑laws 24-27).

5. Preventive prohibitions and spatial buffers: A consistent device is minimum separation distances (50 m, 300 m, 500 m, 800 m) tailored to the risk (closets, animal housing, pigs, flora), reflecting a preventive regulatory approach to protect source water quality (by‑laws 4, 10-13, 19A, 40).

6. Enforcement, remedies and cost allocation: Inspectors may remove offending material and direct remedial works; costs of removal are borne by owner/occupier (by‑law 32(2)). Criminal penalties for breaches are modest but continuing fines apply (by‑law 105(1)). Crucially, the by‑laws make explicit that the Corporation or Minister may recover expenses, loss or damage for which the responsible person is liable, under the principal Act s45(3) (by‑law 105(2)).

7. Cultural exemptions and limits: The by‑laws incorporate carve‑outs for Noongar people acting for "Aboriginal customary purpose" in relation to timber cutting/clearing, hunting for invertebrates/eggs, and flora removal in certain areas, but they condition those exemptions on limiting conduct to non‑entry upon reservoirs and watercourses and on other specific constraints (by‑laws 34(2), 35(3), 40(2)). The definition of "Aboriginal customary purpose" is provided in by‑law 1A(1).

8. Integration with external regimes: The by‑laws draw definitions from the Health (Miscellaneous Provisions) Act 1911 and the Health (Treatment of Sewage and Disposal of Effluent and Liquid Waste) Regulations 1974 (by‑law 1A(3) and 1A(1) respectively for "liquid waste"), and note that formal power to make them is now given by the Water Agencies (Powers) Act 1984 s34 (Notes). They also cross‑reference the principal Act for compensation recovery (by‑law 105(2)).

These concepts govern the chain from regulatory instrument to on‑the‑ground behaviour: mapping identifies regulated land, the CEO/inspectors decide permissible conduct, technical rules specify how to manage waste and sanitation, and enforcement instruments (notices, removal powers, fines and cost recovery) impose consequences for non‑compliance.

The by‑laws create obligations and restrictions that fall on several distinct actor groups. Identifying who is affected clarifies the distribution of compliance costs and decision rights.

• Owners and occupiers of premises within catchment areas. Multiple provisions place primary obligations on owners and occupiers: provide and maintain sanitary conveniences (by‑law 5), keep closets and receptacles clean (by‑law 6B), ensure pans are emptied as directed (by‑law 6B(3)), remove dung/manure and keep animal housing clean (by‑law 13), and supply and maintain refuse receptacles (by‑law 24). Owners and occupiers also bear the cost of required works directed by an inspector, and are liable for removal costs (by‑laws 4, 7, 32(2)).

• Contractors and service providers handling human wastes and refuse. Nightmen and contractors who remove nightsoil must treat or dispose of it in specific ways (by‑laws 15-16) and may charge amounts only as specified by a CEO‑approved contract (by‑law 17). They must use approved vehicles and follow disinfecting procedures (by‑law 16).

• Agricultural and industrial operators within catchment areas. Those conducting trades with offensive waste, factories, quarries or mines are covered by prohibitions or permit requirements. Abattoirs and offensive trades are confined to specific areas in the Schedule and require approved waste disposal arrangements (by‑law 21). Industrial dischargers require written permission from the CEO and must comply with permit terms (by‑law 29).

• Livestock owners. The by‑laws prohibit keeping swine within 500 m of a reservoir or feeder (by‑law 19A), restrict stabling within 300 m (by‑law 12), and subject animal owners to prompt removal and disposal duties in the event of death or slaughter (by‑law 22). Inspectors may prohibit straying or depasturing in catchment areas by Gazette notice and that prohibition binds owners (by‑law 20).

• Recreational users and the public. Bathing is prohibited except in CEO‑specified places and conditions (by‑law 31). Camping and picnicking are restricted within 300 m of reservoirs, wells or feeders unless otherwise specified by the CEO (by‑law 36). Fishing, hunting and shooting may be restricted by the CEO (by‑law 35).

• Noongar people in the South West Settlement Area and occupants undertaking Aboriginal customary purposes. The by‑laws define "Aboriginal customary purpose" (by‑law 1A) and provide limited exemptions for members of the Noongar people acting for those purposes in special provision catchment areas: timber cutting/clearing (by‑law 34(2)), hunting for certain invertebrates and eggs (by‑law 35(3)), and removal of flora within 800 m of reservoirs (by‑law 40(2)). Those exemptions are conditional: for example, the exempt person must not enter reservoirs or watercourses and must not cause adverse effects to water works.

• The Corporation, the Minister and their agents. The Corporation and the Minister exercise powers through the CEO and inspectors, and they are the parties entitled to recover expenses and enforce by‑laws (by‑laws 32(1)-(2), 105(2)). The by‑laws also protect Corporation and Minister property, e.g. flora on land under their care (by‑law 40).

• Regulatory decision‑makers. The CEO and appointed inspectors carry the practical authority to issue notices, publish exemptions or restrictions, inspect and enter properties, set compliance times, and approve or refuse permissions (by‑laws 11(2), 31, 32, 33, 35(2), 36(2)).

Spatially, the by‑laws operate where the principal Act constituted catchment areas and water reserves. Practical compliance therefore depends on the mapping in the schedules (Schedule 1, Schedule 4) and the Department of Water plan referenced in by‑law 1(3). The by‑laws make behaviour contingent on location and on receipt of CEO approvals. Those who own or occupy land within the specified buffers to reservoirs, feeders, bores or the high‑water mark are the principal subjects of day‑to‑day compliance obligations.

The instrument establishes a set of prescriptive duties and corresponding administrative rights for the CEO and inspectors. The legal obligations are concrete and in many cases spatially delimited.

Duties of owners and occupiers

• Provide and locate sanitary conveniences. Owners and occupiers must provide an earth closet with sufficient approved pans or septic tanks/other authorised apparatus as required by the CEO, and erect them where directed by an inspector (by‑law 5(1)-(2)). The by‑laws further prescribe construction specifics for earth closets and privies (by‑law 6) including dimensions, materials, ventilation, roof and door clearances and an impervious floor with specific falls.

• Maintain cleanliness and hygiene. Occupiers must keep sanitary conveniences "in a cleanly condition" and owners must maintain them in accordance with the by‑laws (by‑law 6B(1)-(2)). Pans are to be emptied and cleansed at least once a week or as directed by an inspector (by‑law 6B(3)).

• Follow nightsoil removal and treatment requirements. Nightmen and contractors must render nightsoil inoffensive, treat it in a destructor/desiccator/incinerator, or bury it outside catchment areas or otherwise as approved by an inspector (by‑law 15). The detailed handling, washing, disinfection and coating requirements for receptacles are set out in by‑law 16.

• Prevent nuisance and pollutant release. Owners/occupiers must ensure no overflow, offensive closet or pan, or refuse that might be carried into a feeder or well by stormwater (by‑laws 8, 26).

• Manage animal housing and refuse. Animal enclosures must be at least 300 m from certain water features, have watertight manure receptacles, and owners must remove manure to prevent water pollution (by‑laws 12, 13).

• Obtain approvals. Owners/occupiers must not use artificial manures, weed killers, poisons or discharge industrial liquid waste on catchment areas without CEO approval (by‑laws 11(1), 29(1)).

Rights and powers of the CEO and inspectors

• Issue notices and set compliance periods. The CEO and inspectors can give written notices requiring remedial steps, such as filling cesspools, removing or relocating closets, or cleansing receptacles; such work is generally to be completed within one calendar month of notice (by‑laws 3, 4, 7). The CEO determines the time for compliance as appropriate for each case (by‑law 33).

• Inspect and enter premises. Inspectors and authorised officers may enter land, houses or premises at any reasonable hour, with or without notice, to ascertain breaches, remove offending items, or take necessary steps to carry out the by‑laws (by‑law 32(1)).

• Recover costs. The cost of removal or any necessary acts performed under by‑law 32(1) is to be borne by the owner or occupier (by‑law 32(2)). The Corporation or Minister can recover expenses, loss or damage incurred as a consequence of a by‑law breach in the same manner as compensation under section 45(3) of the principal Act (by‑law 105(2)).

• Set technical or use parameters by Gazette notice. The CEO may specify substances that may be used without prior approval, or permit use in a specified manner by Gazette notice (by‑law 11(2)). The CEO may also prescribe bathing, hunting, camping and picnicking restrictions by notice or erected notices in the catchment area (by‑laws 31, 35(2), 36(2)).

Procedural features and limits

• Compliance windows are often fixed to "one calendar month" where specified (by‑laws 3, 4, 7), while by‑law 33 gives the CEO broader discretion to fix timeframes in "each case".

• Exemptions for Aboriginal customary purposes are tightly conditioned. The definition in by‑law 1A(1) sets the scope of "Aboriginal customary purpose" and the by‑laws that provide exemptions always attach behavioural limits, for example prohibiting entry onto reservoirs or watercourses, and prohibiting sale of take (by‑laws 34(2), 35(3), 40(2)).

• Technical prescriptiveness is both detailed and operational: equipment, dimensions, disinfectant strengths (by‑law 16 requires a disinfectant having germicidal value equal to a 5% solution of pure carbolic acid, or steam treatment for not less than 5 minutes) and coal tar coating of receptacles are required. Where the by‑laws are specific, compliance requires matching physical infrastructure and documented processes.

Liabilities and remedies

• Criminal penalties for most breaches are relatively modest (not exceeding $200 with daily continuing penalties up to $50, by‑law 105(1)), but administrative cost recovery may expose owners to greater monetary liability (by‑law 105(2); by‑law 32(2) for removal costs). The narrow criminal fine scale should therefore be read alongside the cost recovery route in the principal Act.

These duties and rights, read together, set out compliance obligations to be met by private landholders, businesses and service providers, while concentrating decision and enforcement authority in the CEO and inspectors.

The by‑laws combine criminal penalties, administrative enforcement powers, and a mechanism for private cost allocation. The enforcement architecture is administrative first, penal second, and cost‑recovery third.

Criminal penalties

• Default monetary penalty. For contraventions without an expressly prescribed penalty the by‑laws impose, on conviction, a fine not exceeding $200 (by‑law 105(1)). For continuing breaches after notice, a further penalty may be imposed of up to $50 for each day the breach continues after notice.

• Scope. The general penalty clause attaches to "any provision of these by‑laws, whether by act or omission, for which a penalty is not expressly prescribed" (by‑law 105(1)). The reprint does not list higher fines or other criminal sanctions in other provisions; most enforcement appears to rely on notices and remedial directions rather than frequent prosecution.

Administrative enforcement powers

• Powers of entry and remedial action. Inspectors and authorised officers may, at any reasonable hour and with or without notice, enter land, houses or premises to determine whether a breach is occurring and to remove or cause the removal of anything done in breach of the by‑laws, or take steps "as he may deem necessary" to carry out the provisions (by‑law 32(1)). The law makes the cost of removal or remedial acts the responsibility of the owner or occupier (by‑law 32(2)).

• Notices and compliance timeframes. Many provisions establish remedial notice regimes: cesspools must be cleaned and filled within one calendar month after written notice by or with the authority of the CEO (by‑law 3); closets within 50 m of high‑water mark or well must be taken down within one calendar month of notice (by‑law 4); closets or urinals may be ordered removed or re‑erected by an inspector, with the owner bearing cost and a one calendar month completion period (by‑law 7). By‑law 33 explicitly delegates to the CEO the determination of compliance timeframes "according to the nature of each case."

• Permit compliance enforcement. Where a CEO has given written permission for discharge or specified conditions for use, the by‑laws make compliance with permit requirements enforceable. For industrial wastes, the permittee "shall at all times comply with the requirements of the permit" (by‑law 29(2)), making non‑compliance a breach subject to remedial action and penalties.

Cost recovery and ancillary liabilities

• Administrative recovery under principal Act. The by‑laws provide that, in addition to penal consequences, "any expense, loss or damage incurred by the Corporation or the Minister in consequence of the breach of any by‑law shall be paid by the person committing the breach and recoverable in the same manner as compensation may be recovered under section 45(3) of the principal Act" (by‑law 105(2)). This cross‑reference places potential liability beyond the modest criminal fines and effectively allows the state to recover cleanup and remediation costs.

Operational enforcement features that drive behaviour

• Low fines, but removal and remediation costs borne by owners. The combination of relatively low criminal fines and the capacity to recoup remediation costs means the primary enforcement lever is administrative rather than criminal: inspectors can require remediation and charge owners for the cost of action taken under authority. This channel creates an incentive for owners to comply with notices quickly to avoid cost recovery.

• Strict procedural requirements for sanitation and receptacle handling. The by‑laws prescribe specific technical steps for cleaning and disinfecting pans and receptacles (by‑law 16). Non‑compliance can therefore be objectively identified and used as a basis for remedial orders or prosecutions.

• Delegation of broad discretionary powers to the CEO and inspectors. The CEO's ability to publish notices authorising substance use (by‑law 11(2)), to set bathing and camping restrictions (by‑laws 31, 36), and to determine time for compliance (by‑law 33), together with inspectors' powers of entry and removal (by‑law 32), concentrates practical enforcement discretion in the executive. Those decisions are administratively reviewable in theory, but the by‑laws do not set internal appeal processes.

Practical enforcement consequences

• Speed of remedial directions. The one‑month default compliance period in multiple provisions creates an operational rhythm: owners and occupiers often have a month to alter infrastructure or remove offending installations after being served notice (by‑laws 3, 4, 7). The CEO may vary timeframes case by case (by‑law 33), which can accelerate or extend compliance obligations.

• Receptor and vehicle standards for contractors are enforceable. Nightmen must use inspector‑approved carts/vehicles and follow disinfection and replacement protocols; failure to do so can lead to removal orders and liability (by‑law 16).

• Use of Gazette notices as a regulatory tool. The CEO can manage routine approvals and exemptions through Gazette notices (by‑law 11(2)), meaning regulated parties need to monitor public notices for permissive changes without case‑by‑case approval.

In short, enforcement is practical and administrative, led by inspectors and the CEO, with penalties available but cost recovery likely to be the more consequential financial exposure for regulated parties.

The by‑laws sit inside a network of statutory references and administrative instruments. Their operation depends on cross‑referenced definitions, enabling statutes and schedules.

Relationship to the principal Act and enabling power

• Made for the purposes of the Country Areas Water Supply Act 1947. The by‑laws state they take effect in catchment areas constituted under the principal Act (by‑law 1(1)). The compilation notes clarify that while the by‑laws have effect for the purposes of the Country Areas Water Supply Act 1947, the formal power to make them is now given by the Water Agencies (Powers) Act 1984 s34 (Notes, point 2). That means the by‑laws are subordinate instruments administered in the context of the modern statutory regime for water agencies.

Cross‑references for definitions and technical standards

• Health statutes and regulations. Several definitions and technical terms reference the Health (Miscellaneous Provisions) Act 1911 and the Health (Treatment of Sewage and Disposal of Effluent and Liquid Waste) Regulations 1974: the by‑law defines "cesspool", "drain", "house", "land", and "owner" as in s3 of the Health (Miscellaneous Provisions) Act 1911 (by‑law 1A(3)), and defines "liquid waste" by reference to the Treatment of Sewage Regulations (by‑law 1A(1)). This means aspects of sanitation and effluent handling in the by‑laws are intended to be read alongside state public health regulations and definitions.

• Principal Act compensation provision. By‑law 105(2) cross‑refers to section 45(3) of the principal Act for the mechanics of recovering expenses, loss or damage resulting from a breach. Practitioners must therefore consult the principal Act for procedural and practical recovery mechanisms. The reprint notes this cross‑reference.

Interaction with Aboriginal and native title contexts

• Schedules and native title overlap. Schedule 1's description of the South West Settlement Area references native title determination applications and registration dates, indicating that catchment mapping intersects with native title interests (Schedule 1 notes). The by‑laws incorporate culturally specific exemptions for the Noongar people in special provision catchment areas (by‑laws 34(2), 35(3), 40(2)). Those carve‑outs must be applied alongside native title law and other statutes governing indigenous rights; the by‑laws themselves limit exemptions by behavioural constraints (no entering reservoirs or watercourses; no sale).

• Limits and conditions on customary exemptions. The by‑laws set an internal definition of "Aboriginal customary purpose" (by‑law 1A(1)), which delineates permitted activities. Where those activities intersect with other statutory regimes (for example wildlife protection, fisheries, or land tenure), regulated persons and decision makers must reconcile multiple statutory obligations. The by‑laws do not displace other laws unless expressly stated.

Interaction with environmental and local laws

• Overlap with other pollution and environmental laws. The by‑laws prohibit polluting activities but do so within the specific remit of catchment protection. Discharge permits (by‑law 29) do not replace environmental licensing requirements under other statutory regimes; operators must therefore ensure compliance with all applicable state environmental approvals in addition to CEO permissions under these by‑laws.

• Interaction with local government planning and public health. Requirements for sanitary conveniences and refuse management draw on public health standards. Local government or state public health authorities may have overlapping powers, particularly where the Health (Miscellaneous Provisions) Act or its successors apply. The by‑laws adopt that regime’s definitions and technical standards by reference.

Administrative law implications

• Executive discretion embedded in Gazette notices and CEO directions. Because the CEO can publish notices specifying substances exempted from approval (by‑law 11(2)), and can set times for compliance (by‑law 33), the by‑laws provide substantial administrative discretion. That discretion is exercisable under enabling statutes and subject to administrative law principles; any judicial review or internal review would engage the standards of the authorising statute.

Temporal and transitional interactions

• The compilation table shows frequent amendments since 1957 and multiple reprints; the by‑laws contain deleted provisions and inserts (compilation table). Practitioners need to consider transitional application to activities and fees predating amendments (see compilation notes, particularly Water Agencies Amendment By‑laws 2008, note 8).

In practice, any enforcement, approval or exemption under these by‑laws should be handled with attention to parallel duties under the principal Act, the Water Agencies (Powers) Act 1984, health regulations, and other environmental and native title law. The by‑laws rely on external statutory frameworks for definitions and enforcement mechanisms, and the recovery mechanism explicitly imports the principal Act s45(3).

The by‑laws have an extensive amendment record stretching from initial gazettal in 1957 to the reprint dated 19 May 2017. The compilation table in the reprint provides the legislative timeline and records material insertions, deletions and date of effect for key changes.

Key points in the amendment chronology

• Initial commencement. The by‑laws commenced on 1 July 1957, applying to catchment areas constituted under the Country Areas Water Supply Act 1947 (by‑law 1(1); compilation table).

• Periodic technical and administrative updates. The compilation table lists numerous amendments across decades. Notably, amendments were made in the 1960s, 1970s and through the 1980s and 1990s, often synchronised with Water Authority and Water Agencies amendments (compilation table). These changes included definitional updates and administrative tweaks.

• Repeals of many provisions. Several by‑laws and entire divisions were subsequently deleted by later amendments and gazette notices. For example, by‑laws 37-39 were deleted on 14 November 2013 (see Division 3 notes), many provisions across Divisions 4-6 were deleted at various times (compilation notes under Division 3), and multiple miscellaneous by‑laws were deleted across the 1980s, 2000s and 2013 (Division 7 notes).

• Mapping and area definitions updated. The Mungalup Dam Catchment was specifically defined and added in 2013 (Schedule 4; by‑law 1(3) amended 15 Nov 2013). The South West Settlement Area was inserted into the by‑laws on 7 June 2016 with a detailed Schedule 1 description and Schedule 2 map (Schedule 1 inserted Gazette 7 Jun 2016). The by‑laws therefore reflect ongoing adjustments to spatial governance and mapping reference standards (GDA94 and UTM Zone 50 are cited for coordinates, by‑law 1(4) and Schedule notes).

• Cultural and customary practice accommodations. Amendments in 2016 added or clarified exemptions for Noongar people in special provision catchment areas (by‑laws 34(2), 35(3), 40(2); Gazette dates 7 Jun 2016 p. 1778-9). The insertion of a definition for "Aboriginal customary purpose" in by‑law 1A was adjusted across multiple years (see amendment history in by‑law 1A).

• Technical standard revisions. Over time, technical provisions governing sanitation, receptacle specifications, disinfection, and nightsoil removal procedures have been amended or reprinted (by‑laws 6, 16, 17). The reprint notes several amendments in 1995, 2001 and 2011 updating these matters.

• Enabling statute update. The compilation notes that although the by‑laws have effect for the purposes of the Country Areas Water Supply Act 1947, the formal power to make them is now given by the Water Agencies (Powers) Act 1984 s34 (Notes, point 2). That identifies a statutory housekeeping transition in the enabling instrument.

Practical implications of amendment history

• Frequent deletions indicate the by‑laws have been streamlined, with many earlier granular provisions removed. This matters for practitioners because their compliance checklists must be aligned to the current reprint and not older versions.

• Spatial definitions have been modernised with specific coordinate systems and maps. Owners and occupiers therefore should not rely on informal understandings of catchment boundaries; the by‑laws explicitly direct interested parties to public maps and Departmental plans (by‑law 1(3) note).

• The addition of customary use exemptions was relatively recent (2016) and tied to defined geographic areas. This indicates the by‑laws have been receptive to integrating cultural exemptions, but those exemptions are narrowly framed and conditional.

The compilation table in the reprint records every amending instrument, gazettal and commencement date to 2017 and should be consulted for finer points of historical application and transitional provisions. Practitioners should treat the reprint as the operative text and check for further amendments after 19 May 2017 when advising clients.

The reprinted by‑laws and the compilation material provided do not include reported judicial decisions applying or interpreting the by‑laws. The text itself does not cite any cases and the compilation table lists amendment instruments rather than litigation. Consequently, there is no litigation history referenced in this source material to cite.

Where litigation might arise, the by‑laws suggest likely factual and legal foci, drawn from the text:

• Interpretation disputes. Definitions in by‑law 1A(1), particularly "Aboriginal customary purpose" and "special provision catchment area", are textually dense and could be the subject of judicial interpretation where exemptions are asserted. The by‑laws set conditions for those exemptions (for example prohibiting entry onto reservoirs/watercourses, by‑laws 34(2), 35(3), 40(2)). Disputes could hinge on whether a proposed activity falls within the by‑law’s definition and whether the behavioural limits were respected.

• Administrative law challenges. The CEO’s discretion to publish Gazette notices specifying permitted substances (by‑law 11(2)), to set compliance timeframes (by‑law 33), and inspectors' powers of entry and removal (by‑law 32) could give rise to judicial review proceedings where affected persons allege unreasonable exercise of discretion, failure to observe procedural fairness, or jurisdictional error. Any such challenge would be grounded in administrative law principles and the enabling statute.

• Factual disputes about catchment boundaries. Given the by‑laws’ heavy reliance on spatial boundaries (Schedules 1 and 4, by‑law 1(3)), litigation could arise over whether particular land falls within a catchment area and therefore whether the by‑laws apply. The by‑laws reference maps and coordinate systems (by‑law 1(3) note; Schedule 1 notes), which would be put in evidence.

• Enforcement and recovery matters. The mechanism in by‑law 105(2) for recovering expenses and damage under the principal Act s45(3) creates a potential cause of action by the Corporation to recover remediation costs; the scope and quantum of those recoveries could be litigated if a regulated person disputes liability or the reasonableness of the costs incurred.

• Interplay with native title or other statutory rights. The schedules' references to native title determination applications indicate overlap with native title claims and determinations. Conflicts between by‑law restrictions and native title rights may raise questions of statutory interpretation or the priority of statutory grants, particularly given the tailored customary exemptions.

Because the source material contains no reported decisions, practitioners should consult external legal databases for post‑2017 case law and administrative determinations that might address these by‑laws. Where litigation is contemplated or anticipated, the key textual touchstones from the by‑laws are the definitions in by‑law 1A, the CEO and inspector powers (by‑laws 11, 32, 33), the procedural notice requirements (by‑laws 3, 4, 7), the spatial maps and schedules, and the cost recovery clause (by‑law 105(2)).

The by‑laws contain several detail‑heavy and potentially surprising provisions that can produce compliance risk if missed. These "gotchas" are concrete traps that arise from the text.

1. Small criminal fines, high administrative exposure. The criminal maximum is $200 and $50/day for continuing breaches (by‑law 105(1)). At first glance fines are modest. However, by‑law 105(2) imports the principal Act s45(3) recovery mechanism, expenses, loss or damage incurred by the Corporation or Minister may be recovered. Practical effect: remediation or removal costs imposed on owners/occupiers can exceed criminal fines, and those costs are recoverable via the principal Act. Do not treat the fine schedule as the sole financial exposure.

2. Tight, uniform compliance deadlines. Several remedial notices require completion "within one calendar month" (by‑laws 3, 4, 7). Owners who receive a written notice have limited notice periods. By‑law 33 does permit the CEO to set timeframes differently "according to the nature of each case", but default one‑month windows are common and operationally demanding.

3. Spatial buffers are precise and consequential. Multiple catchment‑protection distances are non‑negotiable in the text: 50 m for closets from high‑water mark or well/bore (by‑law 4); 300 m for stables and for camping/picnicking (by‑laws 12(1), 36(1)); 500 m ban for pigs (by‑law 19A); 800 m flora protection zone (by‑law 40(1)). Landholders who misjudge these buffers run a high risk of inspector notices and cost recovery.

4. Hard technical specifications: receptacle treatment and coating. By‑law 16 prescribes detailed cleaning, disinfecting and coating (coal tar) requirements for nightsoil receptacles, including disinfectant "having a germicidal value equal to a 5% solution of pure carbolic acid" or steam for not less than five minutes. These requirements may necessitate specialised equipment or contracts with specific contractors. Failure to meet the exact requirements can be a basis for orders or prosecution.

5. CEO‑approved contractual charges. Nightmen may charge only amounts specified in a contract approved by the CEO; they "shall not ask, demand, or receive more than the sums approved" (by‑law 17). This can constrain market pricing for waste removal services and requires suppliers to seek CEO approval for contracts.

6. Permits and Gazette notices can change routine practice. The CEO may specify substances that may be used without prior approval or authorise use in a specified manner by Gazette notice (by‑law 11(2)). Operators must monitor Gazette notices; a substance permitted without approval in one notice may later be withdrawn or restricted. Relying informally on permitted-use practices without documenting the applicable Gazette notice risks enforcement action.

7. Discretionary powers of entry "with or without notice". Inspectors can enter "with or without notice" at any reasonable hour (by‑law 32(1)). For property owners this means the state can inspect compliance proactively and take removal action on the spot, with costs charged back to the owner (by‑law 32(2)).

8. Limited and conditioned Aboriginal customary exemptions. The by‑laws provide narrow exemptions for Noongar people in special provision catchment areas, but they are tightly conditioned. For instance, timber cutting by a Noongar person for an Aboriginal customary purpose is permitted provided the person does not "enter into or upon a reservoir or watercourse" (by‑law 34(2)). Similarly, hunting for invertebrates or eggs is allowed only by hand or a hand‑held tool and cannot be sold (by‑law 35(3)). Non‑Noongar customary activities are not exempt.

9. Intersecting regulatory regimes. The by‑laws reference external statutes for definitions and powers (Health Act and regulations, principal Act, Water Agencies (Powers) Act 1984). Practitioners must ensure compliance with overlapping environmental, health and local government requirements; compliance with these by‑laws alone may not satisfy all statutory obligations.

10. Maps and coordinates matter; they are not merely illustrative. By‑law 1(3) specifically defines the Mungalup Dam Catchment by reference to coordinates annexed to a Department of Water plan and notes the map is available for inspection at the Department's Head Office and website. If a party claims ignorance of being within a catchment, the source maps are the controlling reference.

These operational details can produce enforcement outcomes that are disproportionate to casual expectations. The combination of precise technical requirements, latitude for the CEO/inspectors, and a cost recovery pathway makes administrative compliance and meticulous record keeping critical.

Compliance is a set of concrete steps: locate and map obligations, implement technical measures, secure required approvals, document interactions with the CEO/inspectors, and manage contractors to meet the explicit standards in the by‑laws.

1. Confirm whether land is within a catchment area and which rules apply. Consult Schedule 1, Schedule 4 and the referenced Department of Water plans and maps (by‑law 1(3) and Schedule notes). The by‑laws hinge on spatial application; start by establishing legal boundaries using the GDA94/UTM coordinate references the by‑laws require.

2. Maintain and document sanitary conveniences to the standards in the by‑laws. For houses and public/private places, ensure at least one sanitary convenience exists, and provide additional conveniences per the 1 per 20 persons rule for larger occupancies (by‑laws 6A(1)-(2)). Construct earth closets to the dimensions and materials specified (by‑law 6). Keep records of inspections, maintenance logs, cleaning schedules and any pans swapped per by‑law 16.

3. Use CEO/inspector guidance and seek approvals where required. Before applying artificial manures, poisons, weed killers, or discharging industrial wastes, obtain written CEO approval where required (by‑laws 11(1), 29(1)). Monitor Government Gazette notices for substances the CEO has specified as permitted without prior approval (by‑law 11(2)). Retain copies of any approvals or Gazette notices relied upon.

4. Contract nightmen/service providers under CEO‑approved terms. Nightmen may charge only under contracts approved by the CEO (by‑law 17). Ensure contractors use inspector‑approved vehicles, follow the prescribed disinfection and washing protocols, and replace pans as required (by‑law 16). Keep copies of CEO approvals for contractor charges and certificates of cleaning/disinfection where relevant.

5. Respect setback distances and containment requirements. Do not construct closets within 50 m of high‑water mark, wells or bores (by‑law 4); avoid stables and animal yards within 300 m of water features unless watertight manure containment and excavation works are provided (by‑laws 12(1)-(3)); do not keep swine within 500 m of reservoirs/feeders/wells (by‑law 19A). If animal housing exists, provide approved watertight manure receptacles and implement site works (embankment/excavation) as required by by‑law 12.

6. Implement refuse handling protocols. Provide watertight receptacles as required, empty and disinfect weekly or per inspector direction, and avoid depositing refuse where stormwater might carry it to feeders or wells (by‑laws 24-28). Ensure receptacles are covered and stored as directed and maintain cleaning logs.

7. Prepare for inspections and notices. Given inspectors’ power of entry without notice at reasonable hours (by‑law 32(1)), maintain records and evidence of compliance on site, and ensure staff are aware of inspection protocols. If a notice is received, note the compliance deadline; many default to one calendar month (by‑laws 3, 4, 7). Where compliance within that timeframe is impracticable, promptly communicate with the CEO to seek a variation under by‑law 33.

8. Keep records to resist cost recovery claims. Because the Corporation or Minister can recover expenses and other losses under the principal Act (by‑law 105(2)), document remedial actions taken, communications with inspectors and proof of maintenance to reduce exposure to claims for remediation costs.

9. Where Aboriginal customary activities are involved, verify conditions and limits. If engaging Noongar people or where customary activities are claimed, verify that the activity fits the by‑law definition of "Aboriginal customary purpose" (by‑law 1A(1)) and ensure conditions are respected (for example, no entry into reservoirs/watercourses; no sale of taken items; use only by hand or hand‑held tool where specified in by‑law 35(3)). Maintain contemporaneous documentation of the persons involved and the nature of the activity.

10. Integrate with other approvals and consult legal counsel where necessary. The by‑laws reference health regulations and the principal Act. Ensure compliance plans co‑ordinate with public health authorities, environmental regulators and native title offices where relevant. For complex matters such as permit applications for industrial discharges, or for dealing with ambiguous boundaries or conflicting statutory duties, seek legal advice and consider administrative review options if a CEO direction appears inconsistent with the enabling statute.

Checklist for routine compliance

• Map verification: obtain official map/coordinate confirmation from Department of Water or inspect the referenced plan (by‑law 1(3) note).
• Sanitation audit: check closets, pans, septic systems, and cleaning regimes against by‑law 6 and by‑law 16; implement weekly cleaning logs (by‑law 6B(3)).
• Waste contractor audit: confirm nightman contracts are CEO‑approved; verify vehicles and disinfection methods meet by‑law 16.
• Chemical usage: list fertilizers, pesticides, poisons intended for use and check Gazette notices or apply for CEO approval (by‑law 11).
• Animal management: confirm animals are outside prohibited distances or that appropriate containment works are in place (by‑law 12; by‑law 19A).
• Public use management: control bathing, camping and picnicking in accord with CEO notices and posted signage (by‑laws 31, 36).
• Records and correspondence: retain all notices from the CEO or inspectors, contracts approved by the CEO, cleaning logs, and any approvals or permit documents.

Concluding operational note

Compliance is primarily administrative and technical. Owners, occupiers and businesses will typically avoid enforcement costs not by relying on criminal fine thresholds but by ensuring remedial action can be effected quickly when required, by securing necessary CEO approvals in advance, and by documenting that practices meet the by‑law prescripts. Where disputes over CEO directions, permit conditions, or catchment boundaries arise, early legal and technical advice is prudent because the by‑laws delegate broad discretion to the CEO and inspectors and link liability to recovery under the principal Act.
