9 Treatment of detainees generally
Functions under this Act in relation to a detainee must be exercised
as follows:
(a) to respect and protect the detainee’s human rights;
(b) to ensure the detainee’s decent, humane and just treatment;
(c) to preclude torture or cruel, inhuman or degrading treatment;
(d) to ensure the detainee is not subject to further punishment (in
addition to deprivation of liberty) only because of the conditions
of detention;
(e) to ensure the detainee’s conditions in detention comply with
section 12 (Correctional centres—minimum living conditions);
(f) if the detainee is an offender—to promote, as far as practicable,
the detainee’s rehabilitation and reintegration into society.
