86 Nonsmoking areas
(1) The director-general may declare the whole or part of a correctional
centre as an area in which smoking is prohibited (a nonsmoking
area).
(2) However, the director-general may only declare the whole of a
correctional centre as a nonsmoking area if the director-general is
reasonably satisfied that appropriate therapeutic support is available
to help detainees at the correctional centre stop smoking.
(3) The director-general must take reasonable steps to bring each
non-smoking area to the attention of detainees, corrections officers
and other people who work at or visit the centre.
(4) Without limiting subsection (1), the director-general must ensure that
notices or signs are prominently displayed at or near each
nonsmoking area indicating that smoking is prohibited in the area.
(5) The Smoke-Free Public Places Act 2003 does not apply to a
