35 Escort officer functions etc
(1) This section applies if, under a law in force in the ACT, a person
required to be held in the director-general’s custody is to be escorted
anywhere by an escort officer.
(2) To remove any doubt—
(a) the escort officer is authorised to have custody of the person for
the purpose of escorting the person; and
(b) the person is also taken to be in the director-general’s custody;
and
(c) a corrections officer acting as the escort officer may, for the
purpose of escorting the person, exercise any function under this
Act that the officer may exercise in relation to a detainee
admitted at a correctional centre.
Examples of functions—par (c)
1 functions given to the officer under section 20 (Corrections officers—
functions) or delegated to the officer by the director-general (for
example, giving directions to detainees)
2 the officer’s functions under part 9.4 (Searches) or part 9.7 (Use of
force)
