223 Protection from liability (1) This section applies to a person who— (a) exercises, or has exercised, a function under this Act; or (b) is, or has been, otherwise involved in the administration of this Act. (2) The person does not incur civil liability for an act or omission done honestly and without recklessness for this Act. Note A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including regulations and the corrections rules (see Legislation Act, s 104). (3) Any civil liability that would, apart from this section, attach to the person attaches instead to the Territory.
