135 Effect of positive test sample from detainee
(a) a detainee is directed under this Act or the Crimes (Sentence
Administration) Act 2005 to provide a test sample; and
(b) the test sample provided by the detainee is positive.
(2) The director-general may have regard to the positive test sample in
making any decision in relation to the management of the detainee
under this Act.

Note The taking (in any way) of alcohol or a drug into the body is a disciplinary
breach (see s 152 (Meaning of disciplinary breach)). The results of the
analysis of a substance under this Act, signed by an analyst, is evidence
of the facts stated in the certificate (see s 226 (Evidentiary certificates)).

136 Alcohol and drug testing of corrections officers etc
(1) A regulation may make provision in relation to alcohol and drug
testing of—
(a) corrections officers; and
(b) public servants and other people who work at or visit
correctional centres, whether as employees, contractors,
volunteers or otherwise.
(2) In particular, a regulation may make provision in relation to any of
the following:
(a) the circumstances for testing, including when and where tests
may be conducted;
(b) the conduct of the tests.
