69 Prisoner not to be released on parole in certain circumstances
(1) [Section 69 Subsection (1) substituted by No. 25 of 2002, s. 10, Applied:01 Oct 2002] A prisoner who has been sentenced to a term of imprisonment is not to be released on parole in respect of that sentence if –
(a) the court has ordered that the prisoner is ineligible for parole pursuant to section 17 or 18 of the Sentencing Act 1997 ; or
(b) the prisoner is ineligible for parole by operation of section 17(3A) of that Act.
(2) [Section 69 Subsection (2) amended by No. 17 of 2025, s. 8, Applied:20 Oct 2025] If a prisoner is made the subject of a declaration under section 7 of the Dangerous Criminals and High Risk Offenders Act 2021 , the prisoner is not eligible to be released on parole until the declaration is discharged under that Act.
