### 39 Effect of directions, requirements and orders under sections 36, 36A, 36B, 37, 37A and 38
> > (1) [*\[Section 39 Subsection (1) amended by No. 72 of 2005, s. 83, Applied:20 Feb 2006\]*](/view/html/inforce/2006-02-20/act-2005-072#GS83@Hpa@EN) A direction or order for the removal of a prisoner or detainee for the purposes of [section 36](#GS36@EN) , [36A](#GS36A@EN) , [36B](#GS36B@EN) , [37](#GS37@EN) , [37A](#GS37A@EN) or [38](#GS38@EN) is sufficient authority –

> > > > (a) to every correctional officer, police officer or other person who is entrusted with the conveyance of the prisoner or detainee to keep and convey the prisoner or detainee accordingly; and
> > >
> > > > (b) [*\[Section 39 Subsection (1) amended by No. 72 of 2005, s. 83, Applied:20 Feb 2006\]*](/view/html/inforce/2006-02-20/act-2005-072#GS83@Hpb@EN) to every correctional officer, police officer or other person to keep and detain the prisoner or detainee in the course of the removal from prison, hospital, an institution or a secure mental health unit and for as long as is required for the purpose for which the prisoner or detainee is so removed.
