119 Transitional provision—Justice Legislation Amendment Act 2010 (1) This Act, as in force immediately before the commencement of Division 1 of Part 4 of the **Justice Legislation Amendment Act 2010**, continues to apply in respect of an application under Division 4 of Part 8 for a home detention order that was made but not determined by the Adult Parole Board before that commencement. (2) Despite the commencement of Division 1 of Part 4 of the **Justice Legislation Amendment Act 2010**, this Act, as in force immediately before the commencement of Division 1 of Part 4 of that Act, continues to apply in respect of a prisoner who was the subject of a home detention order immediately before that commencement. (3) Despite the commencement of Division 1 of Part 4 of the **Justice Legislation Amendment Act 2010**, this Act, as in force immediately before the commencement of Division 1 of Part 4 of that Act, continues to apply in respect of an offender who was serving a sentence of imprisonment by way of home detention under the **Sentencing Act 1991** immediately before that commencement.
