### 83 Transitional provision for retirement benefits
> > (1) Regulations of a kind referred to in [section 81](#GS81@EN) [(1)](#GS81@Gs1@EN) may provide for continuing entitlements under the *Retirement Benefits Act 1982* of a person who –

> > > > (a) has been appointed as a member of the Commission's staff under section 81B of the *Public Service Act 1922* of the Commonwealth; and
> > >
> > > > (b) immediately before that appointment was an employee within the meaning of the *Retirement Benefits Act 1982* –

> > and for the continuing application, as may be prescribed, of the *Retirement Benefits Act 1982* to that person.
